RESOLUTION NO. —�
RESOLUTION APPROVING THE PLAT
OF COUNTRY RIDGE
WHEREAS, Developers Country Ridge Partnership, Steven Scharber and
Tony Emmerich have proposed a plat to be know as Country Ridge; and
WHEREAS, a preliminary plat and final plat have been presented for
review, have been reviewed and recommendations for approval have
been made by the City Attorney, the City Engineer, and City Planner
subject to certain conditions; and
WHEREAS, Developers have substantially complied with applicable
City ordinances regarding subdivisions and have submitted the
required data for review, and
WHEREAS, Developers will execute a Developers' Agreement which
contains provisions relating to most of those concerns regarding
the plat; and
WHEREAS, an EAW on the subject plat has been drafted, published
and comments received on the same and Findings of Fact have been
made, there has been a declaration that no EIS is necessary, and
that concerns brought up by the commentators have been addressed
and some included as provisions in the Developer's Agreement; and
WHEREAS, the City Council has reviewed the plat, Developers'
Agreement, EAW, responses to the same, and additional information
received.
THEREFORE, LET IT BE RESOLVED that the City of Otsego hereby
approves the Final Plat of Country Ridge contingent upon the
following:
1. Developer's Agreement is fully executed by Developers and
fee owners or, alternatively, Developer's Agreement is
fully executed by Developers and recorded warranty deed
or proof of same be provided to the City Attorney's
office evidencing fee title in Developers.
2. All fees and escrow amounts required by Developers'
Agreement and administrative and legal fees incurred to
date are fully paid.
3. An Irrevocable Letter of Credit in the amount contained
in The Developers Agreement, and in form acceptable to
the City, is provided to the City.
4. Restrictive Covenants are submitted to City Attorney for
approval and are recorded when plat and Developer's
Agreement are recorded.
5. The City declares that no EIS is necessary on the plat.
6. Resolution vacating River Road is passed.

Exhibit "A"
Specifications
* Bid proposal form shall be corrected to show correct project
name and a minimum size culvert with aprons of 15" diameter.
Temporary erosion control should be added.
Special Provisions
* The specified density method of 100% standard proctor in the
upper three feet of subgrade and 100% standard proctor for
aggregate base shall be used.
* The bituminous mixture shall be either Type 31 or Type 41
(base or .wear course) as required with 120 to 150 penetration
bituminous material. Mixtures shall be compacted to 95% of
the Marshall density value. Only virgin materials are to be
used for Type 41 wear.
* Seeding shall be applied at a rate of 50 pounds per acre and
fertilizer at a rate of 400 pounds per acre.
* Reference to jute fabric to the river bank is not applicable.
* Owner/developer are responsible for constructing, maintaining
and removal of temporary erosion control measures as needed or
required.
* Final grading plan:
Identify culvert sizes
Identify symbol(s) used on the southwest and southeast
corners of the intersections with future 85th Street.
* Ultimate development plan:
Correct future lot splits on Lots 5 and 6, Block 7.
There shall be no future street shown between Lots 5 and
6.
