BACKGROUND/JUSTIFICATION:
First Choice Builders are constructing a single family dwelling at 9760 105th Street NE (Lot 8, Block 1) within
Norin Landing. To accommodate the proposed single family dwelling, the builder has been working with
the City Engineer on vacation of a portion of the drainage and utility easement within the rear yard;
comments from the City Engineer are attached. Subject to the comments of the City Engineer, the
drainage and utility easement can be vacated without impacting drainage of surrounding properties.

RE: Lot 8, Block 1 Norin Landing Easement Vacation and Lot Revisions
We have reviewed the Certificate of Survey for Lot 8, Block 1 Norin Landing by Taylor Land
Surveyors, Inc. dated 12/19/17 and offer the following comments:
1. Revising the house type from a Lookout to a Walkout and the associated elevation changes
appear to acceptable as proposed.
2. An Emergency Overflow (EOF) of 903 exists in the rear yard swale. With the revised house
elevations, the EOF shall be lowered to 902.3. This EOF and elevation shall be labeled on the
plan.
3. The vacation of a portion of the easement in the rear yard is acceptable as proposed. The
easement was intended to cover a cross drainage swale which is being rerouted and covered
by additional drainage and utility easement.
4. The new drainage swale shall have drainage arrows (spot elevations would be helpful) and the
% grades labeled in the drawing.

CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
A RESOLUTION APPROVING VACATION OF EXISTING DRAINAGE AND UTILITY
EASEMENTS WITHIN LOT 8, BLOCK 1 NORIN LANDING.
WHEREAS, the City of Otsego approved a final plat of Norin Landing, City of
Otsego, Wright County, State of Minnesota; and,
WHEREAS, the Norin Landing Final Plat included dedication to the City of
drainage and utility easements; and,
WHEREAS, First Choice Builders are the property owners of Lot 8, Block 1 Norin
Landing; and,
WHEREAS, the property owners have applied for vacation of a portion of the
drainage and utility easement dedicated within Lot 8, Block 1 as described by Exhibit A;
and,
WHEREAS, the City Council held a public hearing at their regular meeting on 22
January 2018 to consider the vacation, preceded by required published and mailed
legal notice; and,
WHEREAS, the City Council heard all parties interested therein and closed the
public hearing; and,
WHEREAS, the Request for Council Action dated 22 January 2018 prepared by
the City Planner, The Planning Company LLC, is incorporated herein; and,
WHEREAS, the drainage and utility easements described by Exhibit A serve no
useful public purpose; and,
WHEREAS, the City Council having considered all information received related
to the proposed vacation and easement dedication finds that vacating a portion of the
existing drainage and utility easement as described by Exhibit A would be in the public
interest; and,
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Otsego
that Otsego hereby orders:
1. That the drainage and utility easement located in the City of Otsego, Wright
County, State of Minnesota described by Exhibit A is hereby vacated.
2. The City Council hereby determines that the vacation of said drainage and utility
easement shall cause no damage to any abutting or nearby property owners and
therefore no damages are awarded to any such property owners.
