RECOMMENDATION:
Staff recommends accepting all public improvements associated with Crimson Ponds West 3rd Addition,
thus starting the warranty period.

BACKGROUND/JUSTIFICATION:
All improvements have now been completed including the final lift of pavement. Erosion control is still in
place until vegetation has been established and shall be removed prior to final acceptance at the end of the
warranty period. An initial acceptance walk-thru was conducted with City Staff, the developer, and
contractor on December 5th, 2017. As -built construction plans and all remaining items have now been
successfully completed.
The bituminous base and wear course paving have been completed but some of the bituminous testing
results did not meet the minimum densities. The failures are not severe enough to warrant removal but do
result in deductions to the paving contractor. An amount equal to $2,206.17 shall be retained by the City
for the failing material.
Staff recommends that all public improvements be initially accepted as of the date of the initial acceptance
walk-thru date of December 5, 2017. Per the Developer's agreement for Crimson Ponds West 3rd Addition,
the Developer warrants;
1. All public improvements, other than streets, within the plat as of the date of this resolution
commencing the one (1) year warranty period from this date.
2. All public street improvements within the plat as of the date of this resolution commencing the
two (2) year warranty period from this date.

CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS FOR
CRIMSON PONDS WEST 3RD ADDITION
WHEREAS, the City Council approved the final plat of Crimson Ponds West 3�d
Addition (the "plat"); and,
WHEREAS, the City and Developer entered into a Development Agreement May
17, 2016 for Crimson Ponds West 3rd Addition and recorded with Wright County
regarding approval of the plat and installation of required public improvements within the
plat; and,
WHEREAS, all public street improvements, including bituminous base and wear
course paving, curb and gutter, sidewalk, grading and erosion control have been
completed; and,
WHEREAS, all public utility improvements, including watermain and services,
sanitary sewer main and services, and storm sewer have been completed; and,
WHEREAS, all public improvements were constructed in accordance with City
standards, Code and approved plans within the plat; and,
WHEREAS, an initial acceptance inspection of the public improvements within
the plat was conducted on December 5, 2017 with City staff and the Developer, and all
remaining items have been successfully completed; and,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO
MINNESOTA THAT
1. The City accepts all public improvements, other than streets, within the plat as of
December 5, 2017 thus commencing the one (1) year warranty period from this
date.
2. The City accepts all public street improvements within the plat as of December 5,
2017 thus commencing the two (2) year warranty period from this date.
3. Upon conclusion of the respective warranty periods and completion of a final
acceptance inspection by City staff and satisfaction of any conditions of said final
inspection, improvements lying within public easements and public right-of-way
shall be come City property without further notice or action.
