ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/J USTI FICATION: All improvements have now been completed including the final lift of pavement. Erosion control is still in place until vegetation has been established and shall be removed prior to final acceptance at the end of the warranty period. An initial acceptance walk-thru was conducted with City Staff, the developer, and contractor on August 2, 2017. Items identified at this walk-thru were completed by September 27, 2017. The As -built construction plans have been accepted as of November 17, 2017. All items are now complete. Staff recommends that all public improvements be initially accepted as of the date of the initial acceptance walk-thru date of August 2, 2017. Per the Developer's agreement for Arbor Creek 3rd Addition — Phase 3, the Developer warrants; 1. All public improvements, other than streets, within the plat as of the date of this resolution commencing the one (1) year warranty period from this date. 2. All public street improvements within the plat as of the date of this resolution commencing the two (2) year warranty period from this date. BUDGET INFORMATION FUNDING: BUDGETED: N/A RESOLUTION NO. 2018-16 CITY OF OTSEGO COUNTY OF WRIGHT, MINNESOTA RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS FOR ARBOR CREEK 3RD ADDITION — PHASE 3 WHEREAS, the City Council approved the final plat of Arbor Creek 3 d Addition - Phase 3 (the "plat"); and, WHEREAS, the City and Developer entered into a Development Agreement September 29, 2015 for Arbor Creek 3rd Addition — Phase 3 and recorded with Wright County regarding approval of the plat and installation of required public improvements within the plat; and, WHEREAS, all public street improvements, including bituminous base and wear course paving, curb and gutter, sidewalk, grading and erosion control have been completed; and, WHEREAS, all public utility improvements, including watermain and services, sanitary sewer main and services, and storm sewer have been completed; and, WHEREAS, all public improvements were constructed in accordance with City standards, Code and approved plans within the plat; and, WHEREAS, an initial acceptance inspection of the public improvements within the plat was conducted on August 2, 2017 with City staff and the Developer, and all remaining items have now been successfully completed. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO MINNESOTA THAT 1. The City accepts all public improvements, other than streets, within the plat as of August 2, 2017 thus commencing the one (1) year warranty period from this date. 2. The City accepts all public street improvements within the plat as of August 2, 2017 thus commencing the two (2) year warranty period from this date. 3. Upon conclusion of the respective warranty periods and completion of a final acceptance inspection by City staff and satisfaction of any conditions of said final inspection, improvements lying within public easements and public right-of-way shall be come City property without further notice or action.
