City staff recommends that the Council approve Quit Claim Deed from City of Otsego to US Home
Corporation.

BACKGROUND/JUSTIFICATION:
In 2017 the Otsego City Council approved the Plat of Highlands of River Pointe and a Developers
Agreement. The Developers Agreement required that US Home (the Developer) deed to the City certain
Outlots.
The City currently owns Outlots A, B, C and D of Highlands of River Pointe. The designation of the Outlots in
the Developers Agreement and planning documents was based upon a preliminary version of the Final Plat.
However, the final version of the Final Plat added an additional Outlot E which is currently owned by US
Homes. In the preliminary version of the Plat there was no Outlot A as currently identified, instead Outlot A
was Outlot B in the recorded Final Plat.
The Final Plat identifies Outlot A as a parcel that was to be returned to the Lahn Family. The City's interest
is in Outlots B, C, D and the new Outlot E. Attached are proposed quit claim deeds transferring Outlot A to
US Homes and transferring Outlot E from US Homes to the City. This will correct the misidentification error
in the Final Plat.
City staff is recommending that the City approve and execute the Quit Claim Deed conveying Outlot A from
the City to US Homes with the understanding that US Homes will execute the Quit Claim deed conveying
Outlot E from US Homes to the City. The relevant documents are attached to this Request.

As of 2/20/2018:
U. S. Home Corp. is the current fee owner of Outlot E, Highlands of River Pointe.
The City of Otsego is the current fee owner of Outlot A (as well as Outlots B, C, and D) by virture of QCD filed 8/10/2017
as Doc. No. 1350530.
