AGENDA ITEM DETAILS RECOMMENDATION: City staff is recommending that the City Council conduct the public hearing for consideration of the Kadler Avenue and 73rd Street Improvement Project. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? Yes Yes — Held May 14, 2018 BACKGROUND/J USTI FICATION: The City is conducting this public hearing for the Kadler Avenue and 73rd Street Improvement Project in accordance with Minnesota Statute 429.031 Subdivision 1. This is the second public hearing for this respective project but is required to be conducted again given the time elapsed since the initial public hearing as well as the change in project scope to include 73rd Street. Previous City action in accordance with Minnesota Statute 429 includes: - Feasibility Report Authorized November 2016 and Accepted March 2017 - Initial Public Hearing Called for in April 2017 and Conducted in May 2017 - Ordering Plans and Specifications in April 2017 - Plans and Specifications Accepted and Competitive Bid Process Authorized in March 2018 - Secondary Public Hearing Conducted on May 14, 2018 - Improvement Ordered on May 14, 2018 - Project Bids Presented to City Council for Consideration on May 14, 2018 The project does include proposed special assessments to two parcels owned by the same entity. That entity will be signing a waiver of right to appeal the assessment amount as outlined in the development agreement for the industrial park proposal being considered by the City Council on May 14, 2018. The remaining project funding is sourced from a grant from MN DEED and a general property tax levy. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TEE CITY OF OTSEGO, MINNESOTA: Said improvements are necessary, cost-effective and feasible as detailed in the feasibility report. 2. It is advisable, expedient and necessary that said improvements as described in the Notice of Hearing thereon be constructed, and the same hereby ordered made. The improvement described in said Notice of Hearing are hereby designated and shall be known as Kadler Avenue and 73`d Street Project, Improvement Project No. 17-04. ADOPTED by the Otsego City Council this 14th day of May, 2018.
