AGENDA ITEM DETAILS RECOMMENDATION: City staff and the Planning Commission recommend approval of site and building plans, vacation of existing drainage and utility easements, and a revised final plat. No Yes BACKGROUND/JUSTIFICATION: The preliminary plat of Pleasant Creek Farms was approved on 14 April 2003 to include 324 townhouse dwelling units. Lennar constructed townhouse dwellings through Pleasant Creek Farms 4th Addition. The undeveloped portions of Pleasant Creek Farms 4th Addition north of 77th Street were preliminary platted as single family lots with City Council approval on 13 January 2013. There are four dwelling units within one building unbuilt south of 77th Street that remain owned by Lennar. Lennar has submitted plans for construction of this buildings. The revised plans are subject to site and building plan review in accordance with Section 2-9-2 of the Zoning Ordinance. A revised final plat and vacation of existing drainage and utility easements is also required as the footprint of the proposed building is larger than the unit lots established with the Pleasant Creek Farms 4th Addition final plat. The Planning Commission reviewed the application at their meeting on 4 June 2018. Mr. Josh Metzer of Lennar was present as the applicant. A public hearing is not required for the application and there were no public comments. The Planning Commission had no concerns with the proposed construction. The Planning Commission voted 5-0 to recommend approval of the application subject to the conditions outlined on the attached findings and resolution. The Comprehensive Plan guides the subject site for medium -to -high density residential uses. Development of townhouse dwellings provides for housing options within Otsego other than traditional single family homes. Townhouse dwellings are an appropriate land use within areas guided for medium -to -high density residential uses. Zoning. The subject site is zoned R-6, Medium Density Residential District. The R-6 District allows for townhouse dwellings as a permitted use. The subject site is also governed by a PUD - CUP allowing for development of townhouse uses in a unit/base lot configuration with multiple principal buildings within a base lot as approved on 14 April 2003. Surrounding Land Uses. The subject site is surrounded by the existing and planned land uses shown in the table below. The proposed townhouse buildings are consistent with the land use approved with the original development plan for Pleasant Creek Farms and will not cause combability issues with surrounding uses. The proposed townhouse building is a row structure with each dwelling unit having a front/rear exterior wall. The dwelling units are 1,719 square feet or 1,774 square feet in area and each has three bedrooms. The building is two stories and have a similar profile to the previous row -style buildings built by Lennar south of 77th Street west of the proposed building. The proposed dwelling units are slightly larger than the previously approved townhouse dwellings that had floor areas ranging from 1,517 square feet to 1,633 square feet. Each dwelling unit has an attached garage that is at least 428 square feet in area. The exterior of the proposed building includes horizontal lap siding of vinyl or LP smartside and a brick wainscoting. The exterior materials are similar to that of the existing buildings. Colors for the proposed building must be coordinated with that of the four color packages offered with the existing buildings to ensure visual harmony. Storm shelter. Section 20-17-12 of the Zoning Ordinance requires construction of a storm shelter for any dwelling unit without abasement, The proposed dwelling units are to be walk out units with a basement. A storm shelter will not be required for these dwelling units. 2 Landscape Plan. The developer has provided a landscape plan for the foundation of The building. The landscape plan includes a variety of shrubs and evergreens of sizes that comply with the requirements of Section 20-19-2.B.3 of the Zoning Ordinance. The developer must add deciduous shade trees along Lambert Avenue consistent with the existing front yard plantings to the west along 77th Street consistent with the approved landscape plan. Access. The proposed buildings will be accessed from 76th Street and Lambert Avenue. These public streets were constructed with the Pleasant Creek Farms 4th Addition final plat. Lot Requirements. Lot requirements for lot area per dwelling unit and lot coverage for Pleasant Creek Farms were established based on the overall development plan as shown in the table below. The proposed building to be constructed within the revised final plat also complies with the setback requirements shown below. Minimum Total Lot Area Minimum Lot Area Per Unit Maximum Bldg. Connection of sewer and water utilities will be subject to review and approval of the Building Official as part of the building permit. The developer must pay sewer and water connection charges for each dwelling unit at the time a building permit is issued for the building in accordance with the City's current fee schedule. Grading Plan. The revised building plan will not significantly alter the approved grading plan. Any modifications of the grading plan will be subject to review and approval of the City Engineer as part of the building permit process. Storm water area charges have already been paid for the final plat. All grading, drainage, and erosion control issues are subject to review and approval of the City Engineer. Easements. Outlot F, Pleasant Creek Farms 4th Addition is overlaid by drainage and utility easement as the base lot surrounding the three buildings. The revised final plat increases the area of the unit lots for the proposed building absorbing a portion of Outlot F. The revised final plat requires vacation of the existing drainage and utility easement, which will be rededicated over Outlot A of the proposed Pleasant Creek Farms 5th Addition final plat. Due to timing for consideration of the applications, the City Council will hold the required public hearing for consideration of the drainage and utility easement vacation. All easements are subject to review and approval of the City Engineer. Park and Trail Dedication. The final plat of Pleasant Creek Farms 4th Addition included payment of park and trail fees in lieu of land dedication. No additional dwelling units will be created by the Pleasant Creek Farms 5th Addition final plat. Therefore, no additional park and trail dedication is required for the proposed final plat. Development Agreement. There are no public improvements being installed with the revised final plat and the subject site remains subject to the development agreement for Pleasant Creek Farms 4th Addition. As such, no new development agreement will be required for the revised final plat. Homeowners Association. The proposed townhouse dwellings will be included in the existing Homeowners Association for Pleasant Creek Farms. The developer has notified the Homeowners Association of its intent to construct the proposed buildings. RECOMMENDATION The proposed site and building plans, vacation of existing drainage and utility easement, and proposed Pleasant Creek Farms 5th Addition final plat comply with the requirements of the Zoning Ordinance and Subdivision Ordinance. Our office recommends approval of the applications as outlined below. POSSIBLE ACTIONS A. Motion to recommend approval of site and building plans, vacation of existing drainage and utility easements, and final plat for Pleasant Creek Farms 5th Addition subject to the following conditions: Colors for the exterior materials for each of the proposed buildings must be coordinated with that of the existing buildings, subject to approval by the Zoning Administrator. 2. The landscape plan shall be revised to add deciduous shade trees along 76th Street and Lambert Avenue and in the yard along 77th Street consistent with the approved landscape plan, subject to review and approval by the Zoning Administrator. 3. The developer shall pay utility connection charges in the amount established by the City Code for each dwelling unit at the time a building permit is issued. 4. All utility issues are subject to review and approval of the Building Official. All grading, drainage, and erosion control issues are subject to review and approval of the City Engineer. .19 All easements are subject to review and approval of the City Engineer. B. Motion to recommend the application be denied based on a finding that the request does not comply with the requirements of the Zoning Ordinance or Subdivision Ordinance. C. Motion to table. C. CITY COUNCIL MEETING: 11 June 2018 FINDINGS: Based upon review of the application and evidence received, the Otsego City Council now makes the following findings of fact: A. The legal description of the property is Lots 1-4, Block 22 and Outlot F, Pleasant Creek Farms 4th Addition, City of Otsego, Wright County, State of Minnesota. B. The property lies within the West Sewer District and is guided for medium to high density land uses by the 2012 Otsego Comprehensive Plan, as amended. C. The property is zoned R-6, Medium Density Residential District and governed by a PUD - CUP approved by the City Council on 14 April 2003. D. The applicant is requesting approval of site and building plans and a revised final plat to be known as Pleasant Creek Farms 5th Addition to allow for construction of a building including four townhouse dwelling units. E. Applications for site and building plan review are processed in accordance with Section 9 of the Zoning Ordinance. F. Final plat applications are processed in accordance with Section 21-3-3 of the Subdivision Ordinance G. The planning report dated 29 May 2018 prepared by the City Planner, The Planning Company LLC, is incorporated herein. H. The Engineering Review dated 6 June 2018 prepared by the City Engineer, Hakanson Anderson Inc., is incorporated herein. The Otsego Planning Commission considered the application at their meeting on 4 June 2018; based upon review of the application and evidence received, the Planning Commission recommended by a 5-0 vote that the City Council approve the request based on the aforementioned findings. DECISION: Based on the foregoing information and applicable ordinances, the request is hereby APPROVED, subject to the following conditions: 1. Colors for the exterior materials for each of the proposed buildings must be coordinated with that of the existing buildings, subject to approval by the Zoning Administrator. 1 2.
