ORD 90-01 Adopting MN state building codeORDINANCE NO. 90-01 AN ORDINANCE ADOPTING THE MINNESOTA STATE BUILDING CODE; PROVIDING FOR ITS ADMINISTRATION AND ENFORCEMENT; REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REI^.OVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHTC. AREA AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES III THE CITY OF OTSEGO PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE; PROVIDING PENALTIES FOR THE VIOLATION THEREOF. NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Otsego as follows: Section 1. Building Code. The Minnesota State Building Code as such code may be from time to time amended, supplemented, or replaced in the future, pursuant to Minnesota Smites Section 16B.59 et. seq., and any Minnesota rules thereunder, is hereby adopted and incorporated by reference in this Ordinance as if set forth in full as the Building Code for the City of Otsego. One copy of said Code as it may be from time to time amended, supplemented or replaced under the above Statutes and Rules shall be on file in the office of the City Clerk. A. Administration Required. The chapters of the Minnesota State Building Code listed below shall be administered by the City of Otsego in accordance with Minnesota Statutes Section 168.59 et. seq. and any Minnesota Rules thereunder as such Statutes and Rules may be from time to time amended, supplemented or replaced. In the event said Statutes and Rules require in the future any of the below chapters to be deleted or additional chapters to be added, such chapters shall automatically be deleted from or added to this Ordinance and administered by the City of Otsego accordingly. 1. Chapter 1300 - Code Administration 2. Chapter 1305 - Adoption of Uniform Building Code (1985) by Reference; 3. Chapter 1315 - Electrical Code; 4. Chapter 1320 - Elevators and Related Machines 5. Chapter 1330 - Technical Requirements 6. Chapter 1340 - Facilities for the Handicapped 7. Chapter 1350 - Manufactured Homes 8. Chapter 1355 - Plumbing Code 9. Chapter 1360 - Prefabricated Structures 10. Chapter 1365 - Variation on Snow Loads B. Administration Optional. In addition to those items listed above, certain appendixes, standards and supplemental materials referenced as an optional part of the State Building Code are hereby adopted and incorporated byreference in the Building Code of the City of Otsego as if set foe rth in full: 1. Uniform Building Code Appendix Chapters: a. Chapter 1310, Building Security; b. Chapter 1335, Floodproofing Regulations, parts 1335.0300 to 1335.1200, Sections 2002 to 205.3. Section 2. Organization and Enforcement. The City of Otsego's organization and enforcement of the Code shall be as established by Chapter 2 of the Uniform Building Code 1985 Edition, as such Edition and Chapter therein may be from time to time amended, supplemented or replaced. The Code shall be enforced within the City limits of the City of Otsego. A. The City Council shall designate the Building Official for the jurisdiction of the Town of Otsego who shall be a State certified "Building Official" in accordance with Minnesota Statutes Section 16B.65, Subdivision 3, and any other State rules or regulations thereunder, as said Statute and rules or regulations may be amended, supplemented, or replaced from time to time. Section 3. Permits, Inspections and Fees. Permits, inspections, and collection of fees shall be as provided in Chapter 3 of the Uniform Building Code, 1985 Edition, as such Edition and Chapter therein may be from time to time amended, supplemented, or replaced from time to time. A. Building Permit Fee. The Building Official will determine building permit fees based on the values or valuation of the total proposed construction or total improvements. Minimum value or valuation, except in unique circumstances, will be established by utilizing whichever is the greater of contract bids, or the most current table of average construction cost in the State of Minnesota furnished by the Department of Administration which relates "Type of Construction" to "Occupancy Use" on a square footage unit base. B. Building Permit Fee Schedule. The table for determining building permit fees shall be known as Appendix A, and which shall be attached hereto and incorporated herein as Appendix A, to this Ordinance. Said permit fee schedule shall be that permit fee schedule presently in force and effect in Wright County, Minnesota. Section 4. Violations and Penalties. A. Any person violating any provision of this Ordinance shall, upon conviction, be subject, in accordance with the Uniform Building Code, 1985 Edition, Section 205 and Minn. Stat. 2 Secs. 412.231, 609.033 and 609.034, to a penalty of either a fine not to exceed $700.00 or imprisonment not to exceed more than ninety (90) days or both but in either case the costs of prosecution may be added. Said penalty and imprisonment provisions shall be automatically amended, supplemented, or replaced by any amendment, supplement, or replacement to the penalty or imprisonment provisions of Minn. Stat. Secs. 412.231, 609.033, and 609.034. B. Not withstanding the within and foregoing penalty, the City of Otsego may apply to the District Court for injunctive relief against any person violating any provision of this Ordinance. Section 5. Effective Date of Ordinance. The Ordinance shall be in force and effect from and after its passage and publication according to law.
