ORDINANCE NO. 91-06
AN ORDINANCE PLACING A MORATORIUM ON THE CITY OF OTSEGO ZONING
ORDINANCE, SECTION 604.4 CONDITIONAL USES, HOME EXTENDED
BUSINESSES, PROHIBITING CONSIDERATION OF HOME EXTENDED BUSINESSES
FOR A PERIOD OF SIX (6) MONTHS.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of
Otsego as follows:
Section 1. Moratorium. So as to allow the newly created
City of Otsego to properly plan for, address, and control
potential new home extended businesses, no applications shall be
considered, and no conditional use permit shall be issued by the
City for a new home extended business as regulated by Section
604.4'Conditional Uses, Home Extended Businesses, of the City of
Otsego Zoning Ordinance for a period of 180 days from the
effective date of passage of this Ordinance.
This moratorium will not affect those legally approved home
extended business in existence at the time of passage of this
Ordinance.
Section 2. Violation. The City may enforce any provision
of this Ordinance by mandamus injunction or any other appropriate
civil remedy in any court of competent jurisdiction.
Section 3. Effective Date and Term of Ordinance. This
Ordinance shall be in force and effect from its passage and
publication according to law and shall be in effect until the
date of approval of a new Zoning Ordinance by the City of Otsego,
or one hundred eighty (180) days from the date of passage of this
Ordinance, whichever occurs first.
