BACKGROUNDIJUSTIFICATION: Chapter 5, Section 2 of the City Code establishes regulations regarding the use of firearms within the City. The City Code includes designation of a No Discharge Zone whereby use of firearms as defined by the City Code) is prohibited except under the limited circumstances allowed by Section 5-2-3 of the City Code. The No Discharge Zone is established by publication of a map graphically depicting areas to be subject to these restrictions. The No Discharge Zone map may be updated by resolution of the City Council and is reviewed annually. This review typically includes the addition of new areas to the No Discharge Zone for which development approvals have been granted changing the character of the area from rural to urban and causing potential public safety issues related to the discharge of firearms. The current No Discharge Zone map was established in 2010. There have been no new developments approved since 2010 that would cause additional area to be added to the no discharge zone. The City Council did approve a special hunt for parcels south of 78 1h Street and north of 7 OM Street between Odean Avenue and Quaday Avenue within the No Discharge Zone. City staff has had discussions with a developer regarding reestablishment of preliminary plat approvals for these properties and development may be expected to begin in the Spring 2014. As such, we would not recommend removal of these parcels from the No Discharge Zone as part of this update. No other changes to the No Discharge Zone map are recommended. Section 5-2-7.A of the City Code provides that unless an update of the No Discharge Zone map is approved by the City Council and published the prior map remains in effect. As such, this item is for City Council discussion and no action is required. City staff also discussed the need for an additional buffer zone around City parks following a property owner target shooting to the south of Prairie Park this summer. All of the City's parks except Prairie Park are in areas surrounded by the No Discharge Zone whereas Prairie Park's south boundary is the border of the No Discharge Zone. To address this situation, City staff recommends an amendment to Section 5-2-4 of the City Code to add a minimum 500 foot setback from public parks and open space for the permitted use of firearms outside of the no -discharge zone. THE CITY COUNCIL OF THE CITY OF TSEGO DOES HEREBY ORDAIN: Section 1. Section 5-2-4 of the City Code is hereby amended to add the following provision: F. By any person using projectiles for target practice or hunting provided that the discharge occurs at least five hundred (500) feet from any property line abutting public park property not including wildlife management areas or other State owned land on which hunting is allowed). Section 2. This Ordinance shall become effective immediately upon its passage and publication.
