IS A PUBLIC HEARING REQUIRED? No No BACKGROUNDIJUSTIFICATION City Council authorized the project in August. The improvement is complete and the assessment needs adopting in order to be included on the 2014 property taxes. The larger property owner to the west (Mr. Coenner) has completed the required construction to divert his drainage area away from Needham Avenue; therefore the assessment proposed in the assessment roll should remain the same, SUPPORTING DOCUMENTS: X ATTACHED NONE s Resolution 2013-54 o Assessment Rall LOTION: (Please word motion as you would like it to appear In the minutes) Motion to approving Resolution 2013-54 Adopting Assessment regarding the storm water improvement designated as Needham Avenue Drainage, BUDGET INFORMATION FUNDING; BUDGETED; X YES Assessment 220 Storm Water — Out of District for City of ONO Otsego portion of assessment ACTION TAKEN a APPROVED AS REQUESTED o DENIED o TABLED o OTHER (List changes) COMMENTS: RESOLUTION NO. 2013-64 RESOLUTION ADOPTING ASSESSMENT WHEREAS, pursuant to proper notice duly given as required by law, the council has previously held a public hearing regarding the feasibility of a storm water improvement project designated as Needham Avenue Drainage, said Project being undertaken pursuant to Minnesota Statute Chapter 444; and WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was given, and the hearing was held thereon on the 11th day of March, 2013, and which all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, the City Council authorized the Project and approved the assessment against individual property owners at a regularly scheduled City Council meeting on August 2, 2013, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO, MINNESOTA: 1, Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included in hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it, and said assessment is an equitable distribution of the costs related to making the drainage improvements, 2, Such assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable on or before the first Monday in January, 2014 shall bear interest at the rate of four and one quarter percent (4 Y4%) per annum from the date of the adoption of this assessment resolution, To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2013, To each subsequent installment when due shall be added interest for one year on all unpaid installments, 3, The owner of any property so assessed may, at any time prior to certifications of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city clerk, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the city clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes.
