ORDINANCE NO. 91-22
AN ORDINANCE DIVIDING THE AREA WITHIN THE LIMITS OF
THE CITY OF OTSEGO INTO AN URBAN SERVICE TAXING DISTRICT
AND A RURAL SERVICE TAXING DISTRICT
The City Council of the City of Otsego, Wright County,
Minnesota, does ordain as follows:
Section 1
Pursuant to the representation's made to the Minnesota
Municipal Board during the hearing to incorporate as the City of
Otsego, the City of Otsego hereby divides the area within the city
limits into an Urban Service District and Rural Service District,
constituting separate taxing districts for the purpose of all
municipal property taxes except those levied for the payment of
bonds and judgments and interest thereon.

The Rural Service District shall include only such unplatted
and platted lands which need not be contiguous to one another, are
rural in character, and are not developed for commercial,
industrial, or urban residential purposes and for these reasons are
not benefited to the same degree as other lands by municipal
services financed by general taxation in the judgment of the City
Council.
The Urban service district shall include all lands within the
boundaries'of the City which are not included in the rural service
district.
Section 4
Whenever any unplatted parcel or lot or portion of a platted
parcel of land included in the Rural Service District is hereafter
developed for commercial, industrial or residential purposes, or
basic urban services such as water, sewer, or street improvements
are extended to such lots, portion of a platted parcel or unplatted
parcel, or whenever application is made for a permit for
construction of a commercial, industrial or residential building or
improvement; or whenever such improvement or building is commenced
without a permit; or the lot, portion of a platted parcel or
unplatted parcel otherwise fails to meet the criteria for inclusion
in the Rural Service District, the City Council shall make and
enter an order by resolution transferring the entire unplatted
parcel or the entirety of the lots affected in the platted parcel
from the Rural Service District to the Urban Service District and
not just a portion of the unplatted parcel or the platted lot
unless a deed which physically divides such unplatted parcel or
platted lot has been filed for record in the office of the Wright
County Recorder or an unplatted parcel is platted. The City
Council shall review annually the tax ratio applicable to all
platted parcels classified within the rural district and ascertain
whether or not such platted parcels still qualify for inclusion
within the rural service district.
Section 5
Those parcels of land meeting the Rural Services District
criteria as set forth above receive approximately 100 percent
(_L00 of the benefits resulting from tax supported municipal
services as compared to parcels of land like value in the Urban
Service District. That accordingly there should be a 0 percent
( 0 %) reduction of tax. The approximate benefit ratio, pursuant
to Minn. Stat. 272.67 is hereby declared to be 1 to 1
between those parcels in the urban district. Said benefit ratio
shall not apply on municipal taxes levied for payments of bonded
indebtedness, interest or judgments thereon.
Section 6
By amendment of this ordinance, the benefit ratio may be
changed, and lands may be added to or removed from the Rural
Service District, but no amendment shall be required to remove
lands by the procedure provided for in Section 4 of this ordinance.
Section 7
This ordinance shall become effective after hearing and
publication as provided by law, and after a certified copy has been
filed with the Wright County Auditor pursuant to Minn. Stat. Sec.
272.67.
