AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends approval of a resolution vacating existing roadway and utility easements. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No Yes BACKGROUND/J USTI A CATION: D.R. Horton received approval on 10 September 2018 of a final plat for the first phase of the Ashwood subdivision consisting of 27 single family lots. The City Council approved the preliminary plat and PUD -CUP for the development on 23 July 2018. The City Engineer identified that there is an existing roadway easement for Odean Avenue recorded with the property. The final plat provides for dedication of right-of- way for the west half of Odean Avenue. The final plat also dedicates drainage and utility easements at the perimeter of each single family lot and overlaying stormwater facilities as required by Section 21-8-12.A of the Subdivision Ordinance. The right-of-way and drainage and utility easements to be dedicated with the final plat make unnecessary the existing easement established when Odean Avenue was improved. As the existing easement no longer serves a public purpose, City staff recommends its vacation.
