CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
AN ORDINANCE AMENDING ORDINANCE NO. 94-3 PROVIDING AN EXCEPTION FOR
LIMITED CONSTRUCTION AND BUILDING PERMITS WITHIN THE LeFEBVRE
WATERSHED DISTRICT MORATORIUM AREA SUBJECT TO CERTAIN CONDITIONS
AND STIPULATIONS.
THE CITY COUNCIL OF THE CITY OF OTSEGO ORDAINS:
Section1. Section 4 of Ordinance No. 94-3 is hereby amended
by adding the following provision:
(6) Agricultural use, single family detached dwelling and
accessory structure building permits on lots of record
existing on or before 28 February 1994 subject to the
approval of the City Engineer and the City Building
Official provided that:
(a) The construction will not result in water discharge
which is beyond the capability of the affected
storm drainage system nor will it adversely affect
either the authorized indepth storm water drainage
study of the area or acquisition of necessary
drainage easements.
(b) The area to be modified as part of the construction
is minimized to the extent possible.
(c) A grading and drainage plan is submitted for review
and subject to the approval of the City Engineer.
(d) A certificate of survey precisely locating the
siting and footprint of any structure(s) and
driveways and parking areas is submitted for review
and subject to the approval of the City Engineer
and the City Building Official.
(e) Within thirty (30) days of the issuance of a
certificate of occupancy, an as -built drainage and
grading plan is submitted by the property owner.
(f) A security in an amount determined by the City
Engineer and pursuant to a legal agreement, as
determined by the City Attorney, is provided to the
City prior to the issuance of a building permit.
Said security shall cover grading and drainage cost
estimates and preparation of as -built grading and
drainage plans.
(g) Prior to the issuance of a building permit, the
dedication of any drainage and utility easements to
the City, if such are deemed necessary by the City
Engineer or are required by City Ordinance.
Section 2. This Ordinance shall become effective immediate
upon its passage and publication.
