NOTICE OF COMPLETION OF PROCEEDINGS
VACATION OF A PLATTED
DRAINAGE EASEMENT
The City of Otsego, Wright County, Minnesota did, on the Bch day of June, 1998, by
Resolution No. 98- 15 duly passed by a four-fifths or greater vote of the entire Otsego
City Council vacate the platted drainage easement located in the Otsego Industrial Park
and legally described as follows:
(See attached Exhibit A)
The above -referenced resolution is on file and available for inspection at the Otsego City
Hall, 8899 Nashua Avenue N.E., Elk River, MN 55330.

RESOLUTION 98-15
RESOLUTION VACATING A PLATTED DRAINAGE EASEMENT ON LOT 2, BLOCK 1,
OTSEGO INDUSTRIAL PARK
WHEREAS, R.J. Ryan Construction, Inc. has submitted a request to vacate the
platted drainage easement legally described on attached Exhibit A, within Lot 2, Block 1,
Otsego Industrial Park;
WHEREAS, the vacation of the platted drainage easement legally described it
attached Exhibit A is necessary to allow for a proposed office/warehouse use on Lot 2,
Block 1, Otsego Industrial Park;
WHEREAS, the City Engineer has reviewed the proposed grading and drainage
plan and has found the proposed site improvements to be adequate for controlling storm
water runoff within the Otsego Industrial Park plat and that the platted drainage easement
legally described in attached Exhibit A serves no useful public purpose;
WHEREAS, the Planning Commission held a public hearing on 6 May 1998 to
consider the vacation of the platted drainage easement legally described on attached
Exhibit A and after closing the public hearing, recommended approval of the applicant's
request;
WHEREAS, the planner's report dated 23 April 1998 and memorandum dated 20
May 1998 are incorporated herein;
WHEREAS, the City Engineer's memorandums dated 27 April 1998, 20 May 1998,
and 21 May 1998 are incorporated herein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OTSEGO RESOLVES
THAT the platted drainage easement legally described in attached Exhibit A is hereby
vacated subject to the conditions outlined in the planner's memorandum dated 20 May
1998.

All that part of the drainage and utility easement over, under and across Lot 2,
Block 1, Otsego Industrial Park, Wright County, Minnesota, lying Northerly of the
Southerly 280.00 feet thereof and; all that part of the drainage and utility easement
over, under and across Lot 2, Block 1, Otsego Industrial Park, Wright County,
Minnesota, described as the East 20.00 feet of the West 30.00 feet of the North
270.00 feet of the South 280.00 feet thereof.
EXCEPT; a permanent easement for drainage and utility purposes over, under
and across Lot 2, Block 1, Otsego Industrial Park, Wright County, Minnesota, lying
10.00 feet Southwesterly of and adjoining the Northeasterly line of said lot 2 and
lying Northerly of the Southerly 280.00 feet of said Lot 2 and; a permanent
easement for drainage and utility purposes over, under and across Lot 2, Block 1,
Otsego Industrial Park, Wright County, Minnesota, lying 10.00 feet easterly of and
adjoining the Westerly line of said Lot 2 and lying Northerly of the Southerly 280.00
