AGENDA ITEM DETAILS
Section 10-5-3.13.8 of the Subdivision Ordinance requires a final plat to be recorded within 100 days after
approval. The TIF agreement also required that construction for the Riverbend North development be
initiated prior to 31 December 2018. City staff is continuing to work with the Developer on the conditions
of approval adopted by the City Council. However, given the time of year and language requiring
construction be started in 2018, City staff advised the Developer that a request for an extension of the
project approvals would be appropriate. Written request for such an extension to 1 April 2019 was
received from Mr. Casey Darkenwald on 15 November 2018.
City staff recommends the City Council approve the extension request and direct City staff to modify the
development agreement, utility connection agreement, and TIF agreement as necessary to reflect the date
by which the agreements must be executed, the final plat recorded, and construction of Riverbend North
initiated. City staff notes that this action relates only to initiation of the project and does not affect the
construction completion dates or other terms of the TIF agreement.

Motion to approve the request of Darkenwald Corporation for extension to 1 April 2019 to execute the
Riverbend North development agreement, Riverbend Mobile Home Park utility connection agreement, and
Riverbend Tax Increment Financing (TIF) agreement and record the Riverbend North Final Plat.
