RE: Otsego – Zoning Ordinance; Storm Shelter

Capstone Harvest Run, LLC has submitted application to the City regarding Section 11 -17-2 of
the Zoning Ordinance requiring a storm shelter to be provided within all slab-on-grade
residential dwellings.
City staff received an email from the applicant on 30 November 2018 that included a letter
from the Housing First Minnesota builders association dated 27 November 2018. The letter
from Housing First Minnesota questions the legality of the City’s zoning ordinance requirement
for a storm shelter. This issue requires further review by City staff, including input from the
City Attorney.
Due to the timing of receipt and the nature of the information, City staff advises the Planning
Commission to amend the agenda for the 3 December 2018 meeting to remove the public
hearing to consider the Zoning Ordinance amendment application.
