BACKGROUND/JUSTIFICATION:
Annually, the Council reviews proposed fees to be adopted as part of the City Code for the upcoming year.
City staff has outlined the adjustments to the fee schedule for 2019 in the attached draft. Some items to
note include:
Water & Sewer Availability/Connection Charges; these increases were based off of an index from
Engineering News -Record (ENR) from November 2017 to November 2018.
Rental Housing License; updated per adopted Ordinance 2018-11.
Collector Street Access Fees; removed from the fee schedule per City Attorney.
Park Dedication Fee; The formula for calculating the fee paid by developers for parks in lieu of land
dedication has been revised to adhere to Statuary requirements. Minnesota Statutes 462.358.2b(C) states
that when the City elects to receive a cash fee in lieu of land dedication, the fee must be based on the
average value of unplatted land to which sewer and water utilities are available at the time of final plat
approval. The calculation of the park land dedication fee for 2019 is shown below. The raw land value is
based on the price D.R. Horton paid for the Ashwood subdivision in September 2018 according to Wright
County records. The percentage of land dedication is based on the recommendations of the
Comprehensive Plan.

The proposed ordinance also includes amendments to the Subdivision Ordinance addressing sidewalk and
trail construction. Sub -dividers are required to provide for sidewalks along one side of all local streets,
commercial and industrial streets), and along cul-de-sacs only where needed to access parks, open spaces
or greenways. Sub -dividers will also be required to provide for construction of trails along major roadways
where designated by the Comprehensive Plan. Trails within greenways or parks will be a City cost
responsibility funded, in part, by park land dedication fees. Prior to this fee schedule, the cost of trails
along public streets was credited to the park and trail dedication fee paid by the sub -divider if constructed
by them.
Administrative Code Enforcement; The draft ordinance repeals two sections of the City Code related to
administrative code enforcement. The first provision provides for a 15% penalty for unpaid administrative
citations. This penalty is addressed as part of the assessment process where interest is applied. The
second provision repeals a provision escalating the cost of additional administrative citations by 25%. This
provision was established when the initial administrative citation amounts were $100 for most violations.
The current administrative citation amount of $200 is the maximum recommended by the City Attorney to
correspond to criminal penalty amounts.

Section 4. Section 10-5-3.A of the City Code (Subdivision Ordinance — Final Plats)
shall be amended to include the following provision:

established by Section 3-1-2 of this Code.

Section 5. Section 10-8-7 of the City Code (Subdivision Ordinance — Sidewalks and
Pedestrian Ways) shall be amended to read as follows:
10-8-7: SIDEWALKS AND PEDESTRIAN WAYSTRAILS:
A. The subdivider shall provide for adequate revisions fey pedestrian movement
within the subdivision, along the subdivision, and to adjoining property shall be
provided in compliance with the Comprehensive Plan-a4id,, policies established
by the City Council and this Section.
B. Sidewalks:
1. Concrete sidewalks shall be constructed along one side of all local
residential streets.
2. Concrete sidewalks shall be constructed along both sides of residential
minor collector streets and commercial/industrial streets, except where a
trail is determined to be required by theCity.
3. A sidewalk shall not be required along cul-de-sac streets unless
necessary to provide access to a public park, open space or other
sidewalk or trail.
C. Trails. Trails shall be constructed along collector streets, arterial streets, and
other designated roadways as shown in the Comprehensive Plan.
D. All sidewalks and pedestrianwayargils shall be designed and constructed
according to established City standards set forth by the Engineering Manual.
E. The subdivider shall be responsible for the payment of the cost of constructing
sidewalks and trails required by this Section adjacent to public streets.
Section 6. This Ordinance shall become effective January 1, 2019 upon its passage
and publication according to law.

AN ORDINANCE ESTABLISHING A FEE SCHEDULE FOR CITY SERVICES,
PERMITS AND LICENSES FOR 2019.
THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN:
Section 1. Section 1-5-5.A of the City Code (Administrative Enforcement)
establishing a 15% penalty for unpaid administrative citations is hereby repealed in its
entirety and subsequent subsections renumbered accordingly.
Section 2. Section 1-5-6 of the City Code (Administrative Enforcement —
Subsequent Violations) is hereby repealed in its entirety.
Section 3. Section 2-4-2 of the Otsego City Code is hereby adopted establishing
a fee schedule for City services, permits and licenses for 2019:
