AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends approval of an ordinance amending the City Code to address alcohol consumption. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: City staff identified that the park and trail rules outlined in Title 8, Section 7 of the City Code do not address alcohol consumption within City parks. City policy has been that alcohol consumption by persons of legal age is allowed within City parks limited only to non -glass containers. This unwritten policy is in conflict with the provisions of Section 5-1-9 of the City Code which makes consumption of alcohol within City parks a public nuisance unless specifically authorized. City staff has drafted an amendment to Section 8-7-3 of the City Code to state this policy as ordinance. BUDGET INFORMATION FUNDING: BUDGETED: NA NA ORDINANCE NO.: 2018-14 CITY OF OTSEGO COUNTY OF WRIGHT, MINNESOTA AN ORDINANCE AMENDING PARK AND TRAIL REGULATIONS OF THE CITY CODE RELATED TO ALCOHOL. THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN: Section 1. Section 5-1-9.A.2 of the City Code is hereby amended to read as follows: 2. No person shall consume intoxicating liquor or 3.2 percent malt liquor in any public parking lot OF OR aRy park without Gity authorization. Section 2. Section 8-7-3 of the City Code is hereby amended to include the following provisions: T. Alcohol. 1. Consumption of alcoholic beverages is prohibited within City parks except by persons twenty-one (21) years of age during allowed park hours, 2. Alcohol shall only be consumed from containers made of materials other than plass. Section 3. This Ordinance shall become effective immediately upon its passage and publication.
