ITEM 4.2 12.10.2018 MinutesITEM 4.2 OTSEGO CITY COUNCIL MEETING OTSEGO PRAIRIE CENTER MONDAY, DECEMBER 10, 2018 Call to Order. Mayor Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Corey Tanner and Jason Warehime. Absent: Councilmember Tom Darkenwald. Staff: Andy MacArthur, City Attorney; Daniel Licht, City Planner; Ron Wagner, City Engineer; Adam Flaherty, City Administrator/Finance Director and Tami Loff, City Clerk. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum. Special Presentation: Distinguished Service Award Presented to Vern Heidner. Mayor Stockamp presented a plaque to Councilmember Vern Heidner for his years of service to the City. The Mayor, City Council, City staff and residents spoke in appreciation of CM Heidner. Otsego River Riders Snowmobile Club Representative Jim Sorenson, 13603 95th Street NE, gave an update on the club. He said the club will have a representative at the City Council meetings throughout the season for any complaints or questions. Chuck and Rachel Landon, 14400 89th Street NE, questioned their property valuation and why the taxes keep going up with all the new homes that are being built. Mr. Landon also stated concern with a home on Odean Avenue and 89th Street that has some code enforcement items. City Planner Licht said the City goes out on a complaint basis and that will be added to the list. City Administrator/Finance Director Flaherty explained that the city only makes up 27% of the total cost you see on your tax statement, and that the rest is Wright County and the School District. He said this will be explained further in the Item 5.1 presentation. Ms. Landon asked how to get your taxes reassessed. City Administrator/Finance Director Flaherty explained that the Local Board of Appeal and Equalization meeting is the avenue for that appeal, and that meeting is usually held in April; each property owner will receive a notice in March which will notify you of the date of the meeting. Jerome Bauer, 6683 Odean Avenue NE, spoke on Code Enforcement; he questioned the inoperable vehicle ordinance and who makes the determination of what is operable. City Planner Licht explained that City staff does when they administer the zoning ordinance. They evaluate from the stand point that the vehicles appears operable (no flat tires, windows in place, current tabs etc.) 2. Consider Agenda Approval. CM Heidner motioned to approve as written. CM Heidner motioned to approve. Seconded CM Tanner. All in favor. Motion carried. 4. Public Hearings: 4.1 To consider the 2019 Fee Schedule. A. City Clerk attests to legal notice. B. Presentation of the proposed fee schedule. C. Open for Public Comments, D. Close the Public Hearing. E. Approve Ordinance 2018-13. City Clerk Loff attested that all the proper noticing, posting and publishing has been completed. City Clerk Loff presented the staff report. Mayor Stockamp opened for public comments at 7:34 PM. Hearing no public comment Mayor Stockamp closed the Public Hearing at 7:36 PM. CM Warehime questioned the Rental Inspection fees. City Planner Licht explained it's the same fees that were just approved by the City Council in October (Ordinance 2018-11). CM Warehime motioned to approve Ordinance 2018-13 establishing the fee schedule of city fees for 2019 and publication of summary form. Seconded by CM Tanner. All in favor. Motion carried. 5. 5.1 2019 Budgets and Property Tax Le A. Truth in Taxation Presentation. B. Public Input. C. Council Action: 1. Consider Resolution 2018-78 Adopting the 2019 Annual Operating Budgets. 2. Consider Resolution 2018-79 Setting Final Property Tax Levy for Taxes Payable 2019. 3. Consider Resolution 2018-80 Adopting the 2019-2028 Capital Improvement Plan. City Administrator/Finance Director Flaherty presented the 2019 Budget and Property Tax Levy. There was no public input. CM Tanner motioned to approve Resolution 2018-78 adopting the 2019 Annual Operating Budgets. Seconded by CM Warehime. All in favor. Motion carried. CM Tanner motioned to approve Resolution 2018-79_Setting Final Property Tax Levy for Taxes Payable 2019. Seconded by CM Warehime. All in favor. Motion carried. CM Tanner motioned to approve Resolution 2018-80 Adopting the 2019-2028 Capital Improvement Plan. Seconded by CM Warehime. All in favor. Motion carried. 6. Community Development: 6.1 Resolution 2018-81 Amendment Urban Service Staqinq Plan and Future Land Use Plan maps of the Comprehensive Plan. City Planner Licht presented the staff report. CM Heidner asked if the school split the 80 acres of their parcel. City Planner Licht said correct, the school building is sitting on a lot, the soccer fields to the west 12/10/18 of the building are sitting on an Outlot and the area to the north is unplatted. City Engineer Wagner said for further explanation that is where the City extended the water and sewer lines as part of the MacIver Avenue project so that when the school comes into potentially put in a second school, the City would run water and sewer through an easement across that property. CM Heidner motioned to adopt Resolution 2018-81 amending the Comprehensive Plan to revise the boundaries established by the Urban Service Staging Plan. Seconded by CM Tanner. All in favor. Motion carried. 6.2 Meadows of Riverpointe 3rd Addition Revised Final Plat and Development Agreement. City Planner Licht presented the staff report. Applicant Josh Metzer, Lennar was present and thanked City staff and agrees with the staff report. CM Warehime questioned the applicant if the HOA will continue to maintain the trails that they will be installing. Mr. Metzer said yes it will be set up the same as the other additions. Mayor Stockamp said she knows in that area, there are issues with residents trying to get out on the County road walking, and noted the other entrance that is planned you have them coming off of CSAH 36, and asked is there enough shouldering in that area that we are being thoughtful that there eventually could be a trail on the north or south of the road there. City Planner Licht said with the Preliminary Plat it was reviewed that they would dedicate enough right-of-way to allow for eventual trail construction along that corridor. CM Warehime asked the applicant how the sales are for the properties south of CSAH 36. Mr. Metzer said they are doing well. CM Heidner motioned to approve the revised final plat of Meadows of Riverpointe 3rd Addition subject to the conditions stipulated in the findings of fact and decision, and adopt Resolution 2018-82 approving a development agreement. Seconded by CM Warehime. All in favor. Motion carried. 7. Public Works: 7.1 Order Preparation of Plans and Specifications for the 2019 Street Preventative Maintenance Project. City Engineer Wagner presented the staff report. CM Warehime questioned the maintenance on the loop road by P & F; City Engineer Wagner explained it has been about 6-7 years since it was paved and ,it did not fare well without the second coat so now it needs the seal coat to extend the life. CM Warehime motioned to approve Hakanson Anderson to prepare plans and specifications for the 2019 Street Maintenance Project, City Project No. 19-01. Seconded by CM Tanner. All in favor. Motion carried. 7.2 Order Preparation of Plans and Specifications for the 2019 Street Micro -Surface Project. City Engineer Wagner presented the staff report. CM Warehime motioned to approve Hakanson Anderson to prepare plans and specifications for the 2019 Street Micro -Surface Project, City Project No. 19-02. Seconded by CM Heidner. All in favor. Motion carried. 8. City Council Resorts and Updates. CM Warehime said that Albertville Fire Department is holding their annual Andy's Pizza Fundraiser on December 17tn 9. Staff Resorts and Updates. City Administrator/Finance Director Flaherty reminded the City Council of the Riley Martin CPA Open House Thursday, December 13, 2018 starting at 3:00 PM. City Clerk Loff reminded the City Council of the Advisory Commission dinner set that same evening at 6:30 PM. City Planner Licht said there will be a Planning Commission meeting on December 17, 2018 to continue the discussion on Storm Shelters. 12/10/18 CM Warehime asked the status on the setbacks related to fire code. City Planner Licht said City staff is working on this and it will be brought to the Planning Commission sometime this winter. 10. Adjourn. CM Heidner motioned to adjourn. Seconded by CM Warehime.
