ITEM 3.2A 2.25.2019 MinutesITEM 3.2A OTSEGO CITY COUNCIL MEETING OTSEGO PRAIRIE CENTER MONDAY, FEBRUARY 25, 2019 Call to Order. Acting Mayor Darkenwald called the meeting to order at 7:00 PM. Roll Call: Acting Mayor Tom Darkenwald. Councilmembers: Corey Tanner and Jason Warehime. Absent: Mayor Jessica Stockamp and Councilmember Tina Goede. Staff: Adam Flaherty, City Administrator/Finance Director; Daniel Licht, City Planner; Ron Wagner, City Engineer; Andy MacArthur, City Attorney; and Tami Loff, City Clerk. Pledge of Allegiance: Acting Mayor Darkenwald led in the Pledge of Allegiance. 1. Open Forum. Brad Hackenmueller, 12267 67th Street NE, said he has spoken to the City Planner, Associate City Planner and the City Adminstrator regarding notices he has received for not removing the snow from the sidewalk in front of his house. He is asking the City Council for an exception from the City Code. He explained that he bought his five acres of land back in 1995, built a house when it was all farm fields around him. Then in the early 2000's the land was sold around him, and development and city sidewalks came through. He said he didn't clean off his sidewalk for quite awhile and it was not an issue and then two years ago he got a code enforcement notice. He stated there are dual sidewalks; one on the other side of the road from him and only one other house on his side of the street that he lives on so it didn't make sense to clean off. He explained his driveway is gravel and he would have to get a different equipment set up to clear the city sidewalk. City Planner Licht said he does recall those conversations and with it being an unique situation. He explained the development that occurred around this property and how we ended up with the situation. He explained that the City Code is specific that sidewalks adjacent to property must be cleared and it doesn't include a provision for any exceptions. He further said the city could take action to post signage at either end saying the sidewalk is closed during the winter or a more permanent solution would be for the four property owners that this sidewalks abuts to request for it to be removed and have the area restored. This option could save costs in the future to have it replaced or maintained. Acting Mayor Darkenwald questioned how many people would be using this sidewalk when you have the sidewalk right across the street. City Planner said he wouldn't expect many to use it but it is the shorter way to get to the park. CM Darkenwald also questioned if the property that has sidewalk on the front, side and back has to maintain all that. City Planner Licht said yes. CM Warehime asked how many years the sidewalk would be good for if we don't maintain and let it go. City Planner Licht estimated around 20 years. CM Warehime asked if the City has a cost to remove it. City Planner Licht said no not at this time. After additional discussion the City Council concurred they would like to get input from the other three surrounding residents; City staff to reach out to those residents and bring back a recommendation to the March 11 City Council meeting. 2. Consider Agenda Approval. City Adminstrator/Finance Director Flaherty requested to remove Item 3.4 due to a scheduling conflict; this will be rescheduled for a later date. CM Warehime motioned to approve with removal of Item 3.4. Seconded by CM Tanner. All in favor. Motion carried. 4. Public Works: 4.1 Accent Bids and Award Contract for the 2019 Street Maintenance Proiect. City Engineer Wagner presented the staff report. City staff is recommending the low bid from ASTECH Corporation. CM Tanner motioned to accept bids and award the contract for the 2019 Street Maintenance Project, City Project No. 19-01 to Asphalt Surface Technologies Corporation (a.k.a. ASTECH Corporation) of St. Cloud, MN in the amount of $193,531.63. Seconded by CM Warehime. All in favor. Motion carried. 4.2 Accept Bids and Award Contract for the 2019 Micro- Surfacing Project. City Engineer Wagner presented the staff report. City staff is recommending the low bid from ASTECH Corporation. CM Warehime motioned to accept bids and award the contract for the 2019 Street Mirco- Surface Project, City Project No. 19-02 to to Asphalt Surface Technologies Corporation (a.k.a. ASTECH Corporation) of St. Cloud, MN in the amount of $129,768.60. Seconded by CM Tanner. All in favor. Motion carried. 5. Administration: 5.1 Consider Cost Sharing Agreement between Evans Park, Inc. and City of Otsego. The City Council originally entered into a cost sharing agreement with Evans Park, Inc. to construct a pedestrian bridge over the storm water retention pond in Carrick's Landing Park which is adjacent to the Guardian Angels Riverview Landing. City Adminstrator/Finance Director Flaherty reviewed the request to revise the cost sharing agreement from $77,159.00, or $38, 579.50 per party to $117,705.00, or $58,852.50 per party. Troy Hanson, Guardian Angels/Evans Park Inc. Chief Finance Officer, explained that orginal agreement included preliminary estimates and that with out that agreement they didn't want to incur engineering and design costs until the cost-sharing agreement was approved. Kraus Anderson has completed additional design and has obtained final costs as outlined in the request. City Engineer Wagner said with the expansion of the bridge from 100 to 120 ft and the additional concrete and the delivery of the two piece bridge it increased the price. CM Tanner stated he was under the impression this project was set to go after it was approved last year and that all the engineering was done at that point. Jim Beckwith, Kraus Anderson, explained the delay. Acting Mayor Darkenwald asked when would the project be completed. Mr. Beckwith stated once approved, its around a three month lead-time for the bridge to be manufactured and delivered; so he would estimate around a May start date and June finish date. CM Warehime asked if this has been discussed by the Parks and Recreation Commission. City Engineer Wagner said Parks and Recreation Director Ross Demant was part of the discussion and he was fine with the maintenance side. City Engineer Wagner further stated he is ok with the proposed bridge 2/25/19 plan. City Planner Licht explained that the Parks and Recreation Commission previously looked at the proposal and were supportive of it. Acting Mayor Darkenwald stated his concern with voting on this without input from Mayor Stockamp or CM Goede. CM Warehime stated he feels comfortable with making the decisions this evening after discussion. CM Warehime motined to approve the revised agreement between the City of Otsego and Evans Park, Inc. regarding shared improvement costs within Outlot A, Otsego Waterfront East. Seconded by Acting Mayor Darkenwald. Motion carried 2-1. CM Tanner opposed. 6. City Council Reports and Updates. CM Warehime said Albertville Fire Department had their annual party and he attended that for the city and Acting Mayor Darkenwald gave an update on the last Planning Commission meeting. 7. Staff Reports and Updates. City Adminstrator/Finance Director Flaherty said the League of MN Cities is hosting a meeting at Dehn Country Manor this Wednesday, February 27 at 2:30 PM and Wright County has scheduled an Open House for County Road 39 Project for Tuesday, March 5, 2019 from 4:30-6:00 PM, here at Prairie Center, 8899 Nashua Avenue. City Clerk Loff reminded the City Council of the photo session scheduled for March 11, 2019 at 6:30 PM. City Attorney MacArthur spoke on the Transportation Districts Legislation and recommended that if the City Council gets a chance, the League of Minnesota Cities is looking for input from Cities. This would be allowing cities to establish transportation districts. 8. Adjourn. CM Warehime motioned to adjourn. Seconded by CM Tanner. All in favor. Motion carried. Adjourned at 8:09 PM.
