BACKGROUND/JUSTIFICATION:
VHF Investments, LLC is proposing development of 117 single family lots on 87.09 acres located east of
Odean Avenue between 751h Street and 701h Street (CSAH 38). There is 1 single family dwelling within the
preliminary plat that will remain and another that is to be removed. The proposed development requires
consideration of applications for a Zoning Map amendment, PUD -CUP, preliminary plat, as well as vacation
of existing public right-of-way. A public hearing to consider the applications was held by the Planning
Commission at their meeting on 15 April 2019.
Mr. Henry Hansen was present as the developer and agreed with recommendations of City staff.
Residents attending the public hearing spoke to general concerns for traffic volume, speed, and roadway
conditions on Odean Avenue and 70th Street (CSAH 38). City staff explained the designation of these
streets as a major collector and minor arterial street, respectively, and their function for non -local traffic. A
concern was also expressed regarding traffic increases on Ogren Avenue and 71ST Street within LIN -BAR
Estates from residents of Hansen Heights. City staff explained Wright County access restrictions for a
minor arterial roadway that do not allow for another connection to CSAH 38 between LIN -BAR Estates and
Boulder Creek.
Residents as well as the Planning Commission also discussed the transitional lot requirements for proposed
lots abutting LIN -BAR Estates, which is zoned residential, and adjacent agricultural parcels.
The Planning Commission raised no significant concerns or questions regarding the proposed development.
The public hearing was closed and the Planning Commission voted 7-0 to recommend approval of the
applications. Findings of Fact and Decision have been drafted by City staff based on the recommendation
of the Planning Commission for consideration by the City Council.

BACKGROUND
VHF Investments, LLC is proposing development 117 single family lots on 87.09 acres located
east of Odean Avenue between 75th Street and 70th Street (CSAH 38). There is 1 single family
dwelling within the preliminary plat that will remain and another that is to be removed. The
proposed development requires consideration of applications for a Zoning Map amendment,
PUD -CUP, preliminary plat, as well as vacation of existing public right-of-way. A public hearing
to consider the applications has been noticed for the Planning Commission meeting to be held
on 15 April 2018.

ANALYSIS
Zoning. The subject site is zoned A-1, Agriculture Rural Service District consistent with the
polices of the 2012 Comprehensive Plan guiding that rural land uses be maintained as interim
until a property is rezoned to allow for development planned by the Future Land Use Plan.
The proposed development requires consideration of a Zoning Map amendment rezoning the
subject site to R-4, Residential Urban Single Family District, which allows single family dwellings
as a permitted use. A PUD -CUP is also being processed with the preliminary plat to allow for a
modification of certain lot requirements. Consideration of the Zoning Map amendment and
PUD -CUP is to be based upon (but not limited to) the following criteria established by the
Zoning Ordinance:
The proposed action's consistency with the specific policies and provisions of the Otsego
Comprehensive Plan.
Comment: The 2012 Otsego Comprehensive Plan includes the subject site within the East
Sewer District and guides the area for low density residential uses at 3.0 dwelling units
per acre or less. The gross density of the proposed subdivision is 1.34 dwelling units per
acre and net density is 2.45 dwelling units per acre. The proposed subdivision of single
family lots served by sanitary sewer and water utilities is consistent with the 2012
Comprehensive Plan.
2. The proposed use's compatibility with present and future land uses of the area.
Comment: The subject site is surrounded by the following existing and/or planned land
uses shown in the table below.

The proposed single family lots within the subject site are consistent with the existing
single family lots within Crimson Ponds West, Boulder Creek, and Ashwood. The
preliminary plat provides for transitional lots with greater width and area as required by
the Zoning Ordinance as a transition to the R-3 District lots within LIN -BAR Estates. The
proposed development will be compatible with the existing and planned land uses in the
area.
3. The proposed use's conformity with all performance standards contained within the
Zoning Ordinance and other provisions of the City Code.
Comment: The proposed preliminary plat will comply with all applicable development
regulations except as specifically modified by the PUD -CUP.
4. Traffic generation of the proposed use in relation to capabilities of streets serving the
property.

Comment: The subject site is accessed via 75th Street and Odeon Avenue. Intra -
neighborhood street connections to LIN -BAR Estates also provide access to 70th Street
(CSAH 38). The 2012 Transportation Plan designates 75th Street and Odeon Avenue as
residential collector streets, whereas 70th Street (CSAH 38) is designated as a minor
arterial roadway serving regional transportation needs. These roadways have adequate
capacity to accommodate the traffic that will be generated by the homes within the
preliminary plat.
5. The proposed use can be accommodated by existing public services and facilities and
will not overburden the City's service capacity.
Comment: The subject site is located within the East Sewer District where the City
anticipates provision of services in support of urban development as guided by the
Future Land Use Plan; the proposed preliminary plat can be accommodated by existing
City services.
Access. The preliminary plat is accessed from Odean Avenue and 75th Street, which are
designated by the 2012 Comprehensive Plan as residential collector streets. Section 10-8-5. B.4
of the Subdivision Ordinance requires that access collector streets be spaced at least 500 feet
apart. The access to Odean Avenue is 640 feet south of 75th Street. The access to 75th Street is
aligned with Odell Avenue to the north within Crimson Ponds West 500 feet east of Odean
Avenue. The location of the accesses to 75th Street and Odean Avenue comply with the
requirements of the Subdivision Ordinance.
The proposed preliminary plat is also accessed by extension of streets from temporary dead -
ends within LIN -BAR Estates at Odell Avenue and 71St Street. These connections to existing
local streets provide for access to Odean Avenue and 70th Street (CSAH 38). Wright County has
begun reconstruction of 70th Street (CSAH 38) between Odean Avenue and Quaday Avenue.
The existing intersection at Ogren Avenue and 70th Street (CSAH 38) will be improved with a
right turn lane for west bound traffic as part of the Wright County project. Based on Wright
County spacing guidelines, the access to 70th Street (CSAH 38) at Ogren Avenue will likely be
restricted to right-in/right-out only at such time in the future as traffic volumes on CSAH 38
dictate expansion to a 4 lane divided roadway.
The preliminary plat also provides for street extension through the 2 rural parcels to the east of
the subject site to the north of 70th Street (CSAH 38). These street connections will provide for
future access to 70th Street (CSAH 38) at the intersection within Boulder Creek. This
intersection is planned to be a full access intersection with Packard Avenue south of 70th Street
(CSAH 38) to be realigned to this location at such time as the land south of the roadway
develops.
The multiple access points available to the proposed preliminary plat to adjacent collector and
arterial streets will allow for disbursement of traffic generated within the neighborhood,
provide connections between neighborhoods, and insure emergency vehicle access.

The preliminary plat also provides for future street connections to the exception parcel at the
northwest corner of the plat and the 5 acre parcel in the west center portion of the subject site
to allow for future resubdivision. The preliminary plat does not extend a public right-of-way
through Block 1 to the 2 lots at the southwest corner of the development. These lots are each
approximately 1 acre in area. The dimensions of these lots limit the ability to extend a City
street with a cul-de-sac turnaround for access that would allow for potential resubdivision.
Also, neither parcel could be further subdivided without assembling both lots and removing the
existing principal and accessory buildings.
Right -of -Way. The preliminary plat provides for dedication of right-of-way for the south half of
75th Street and east half of Odean Avenue abutting the subject site for 80 feet of right-of-way
for these existing streets. Local streets interior to the preliminary plat are provided with a 60
foot right-of-way. The proposed rights-of-way for City streets is consistent with the
requirements of Section 10-8-5.B.1 of the Subdivision Ordinance.
The preliminary plat provides 75 feet of right-of-way for the north half of 70th Street (CSAH 38),
which is subject to review and approval of Wright County.
Right-of-way platted with the plat of Hidden Haven to the east of PID 118-180-000010, which is
a parcel within the preliminary plat. The existing right-of-way is to be vacated as part of the
current application as it serves no public purpose based on the proposed subdivision design.
Streets. The proposed lots are to be accessed by local public streets. The proposed local
streets are to be 28 feet wide with concrete curb and gutter within a 60 foot wide right-of-way.
A 5 foot concrete sidewalk is provided on 1 side of all streets. Street names will be established
at the time of final plat approval in accordance with Section 10-8-10.13.13 of the Subdivision
Ordinance and the Wright County grid system. All street designs and construction plans are
subject to review and approval by the City Engineer.
Lot Requirements. The R-4 District establishes the minimum lot requirements shown in the
table below. The lots abutting existing 1 acre lots zoned R-3 District within LIN -BAR Estates are
subject to the lot requirements of the R -4A District in accordance with Section 11-66-8 of the
Zoning Ordinance.

The R-4 District lots all exceed the minimum lot area, width and depth requirements of the
Zoning Ordinance. The proposed R-4 District lots north of 72nd Lane and east of Ohland Avenue
and the R -4A District lots abutting LIN -BAR Estates meet the minimum area and width
requirement, but not the minimum depth requirement. These lots are proposed to be135 feet
deep based upon the area available between LIN -BAR Estates and the rural residential
exception parcel that limits the ability to have blocks on both sides of the public street meeting
the minimum depth requirement. The reduced depth of these blocks is to be accommodated
through approval of a PUD -CUP. The subdivision design for these lots are consistent with the
intent of the transitional lot requirements.
Landscaping. Section 11-19-2.13.1 of the Zoning Ordinance requires single family lots to be
provided at least 2 trees per lot or a total of 232 trees for the proposed preliminary plat (not
including the lot platted with the existing house). The developer has submitted a landscape
plan that illustrates trees along the street boulevards with a note that 1 tree will be installed by
the builder for each lot. The City allows trees to be planted in the boulevard in R-5 or R-6
Districts where the 25 foot front yard setback limits area in the front yard for a shade tree. The
35 foot setback within the R-4 District is sufficient for a tree to be located within the front yard
outside of the public right-of-way. The landscape plan is to be revised to indicate that the
builder will install 2 trees per lot at the time of construction.
A landscape buffer yard is required to be provided within the yards abutting 75th Street, Odean
Avenue, and 70th Street (CSAH 38) in accordance with Section 11-19-3.13 of the Zoning
Ordinance. The landscape plan provides for installation of the required buffer yard with a mix of
evergreen and deciduous trees.
The types of proposed trees are appropriate and the sizes of trees to be planted in accordance
with the landscape plan complies with Section 11-19-2.13.3 of the Zoning Ordinance.
Park and Trail Dedication. The Future Parks and Trails System Plan included in the 2012
Comprehensive Plan does not identify acquisition of park land from the subject site. The City
has developed the Lefebvre Creek Greenway from 75th Street east through the Boulder Creek
development to Palmgren Avenue. The developer will dedicate Outlot A (Phase 3) to the City
that includes Lefebvre Creek and wetlands below the ridgeline along the east portion of the
development. The phasing plan is to be revised to deed Outlot A (Phase 3) to the City with the
initial final plat. Deeding this parcel will not be credited for park and trail dedication purposes
and these requirements for the preliminary plat are to be satisfied by payment of a cash fee in
lieu of land calculated on a per lot basis at the time of final plat approval. The City will utilize
Park Dedication funds to construct a trail from Ohland Avenue through Outlot A (Phase 3) to
the Lefebvre Creek Greenway providing park access to the proposed development, as well as
LIN -BAR Estates.

Grading Plan. The developer has submitted grading and drainage plans for the proposed
preliminary plat. There are wetlands Outlot A (Phase 3) which will be preserved by dedication
of the outlot to the City. Outlot A (Phase 3) and the outlot at the center of Block 2 (Phase 2)
/Block 3 (Phase 3) are to be deeded to the City in accordance with Section 10-8-12.D of the
Subdivision Ordinance. All grading, drainage, erosion control issues, and any wetland impacts
are subject to review and approval by the City Engineer.
Utility Plan. The developer has submitted utility plans for extension of sanitary sewer and
water utilities to serve the proposed lots. The developer will be required to pay the Sewer and
Water Availability Charges in effect at the time of final plat approval. All utility plans are
subject to review and approval of the City Engineer.
Easements. Drainage and utility easements are shown to be dedicated at the perimeter of all
lots and over stormwater facilities as required by Section 10-8-12.A of the Subdivision
Ordinance. All drainage and utility easements are subject to review and approval of the City
Engineer.
Environmental Review. Minnesota Rules 4410.4300, Subd. 36.A requires that an
Environmental Assessment Worksheet (EAW) be prepared for any land use conversion involving
80 acres or more. Although the gross area of the subject site is 87.09 acres, only 64.3 acres will
be converted to urban use by development of the preliminary plat. An EAW is not required for
the proposed preliminary plat.
Phasing Plan. The developer has submitted a proposed plan for phasing development of the
subject site summarized in the table below and the attached plan set. Each phase will require
approval of a final plat with the timing of each phase determined by market conditions. The
City guarantees access to sewer and water capacity only for developments that have received
final plat approval and executed development agreements to pay for these utilities.

RECOMMENDATION
The preliminary plat for Hansen Heights is consistent with the policies of the Comprehensive
Plan and requirements of the Zoning Ordinance and Subdivision Ordinance. Our office
recommends approval of the applications subject to the conditions outlined below.

and a PUD-CUP/preliminary plat for Hansen Heights, subject to the following conditions:

COVER SHEET
1. Please include a north arrow with the project location. Also, it would be helpful if some
existing street names were labeled.
2. An existing conditions sheet(s) shall be provided. This shall include the following:
a. Show and label widths of existing streets and show buildings, ect within 150' of
the project boundary.
b. Location, size, and elevations of existing sewers, culverts, and other underground
facilities within 150' boundary.
c. Boundary lines of adjoining unsubdivided or subdivided land, identified by name
and ownership within 150'.
d. Minimum of NWL and 100 -year flood elevations for all storm ponds, wetlands,
creeks and rivers shall be shown.
e. The proposed existing well locations within 150' of the project boundary shall be
shown.
f. Existing zoning classifications for land in and abutting the subdivision.
g. Include 2 -foot contours. Also include any water courses, marshes, wooded areas,
rock outcrops, power transmission poles and lines. Locations and results of soil
borings, percolation tests, etc.
h. Existing pond, creek and wetland NWL and 100 -year flood elevations.
OVERALL LAYOUT AND PHASING PLAN
Please rename the streets as follows: 72nd Lane shall be 73 d Street, 73�d Street shall be
74"' Street, 74 1h Street shall be Ohland Avenue.
4. Additional property in the west central area and to the southwest of the proposed plat
have also been "ghost" platted per anticipation of including these properties in the
development in the near future. The inclusion of the west central property would
potentially require some redesign but these ghost plats are in general agreement concept
discussions with City staff. The inclusion of the west central property would potentially

PRELIMINARY PLAT
5. Minimum 10' easements shall be provided along all rear lot lines (i.e. lots along Outlot
A).
GRADING AND DRAINAGE PLANS
6. The House Pad Typical does not correspond with the way House Pad elevations are shown
for each Lot.
7. Garage floor elevation shall be a minimum of 18" above the adjacent top of curb.

8. Driveway slopes shall have a maximum 10% slope. Some of the driveway slopes appear
to be calculated from the back of curb to garage, missing the sidewalk where present.
Where sidewalk is present driveway slopes shall be calculated from the using a 4%
boulevard and 2% sidewalk cross slope, the remaining slope from the edge of sidewalk to
garage floor maximum slope is 10%.
A minimum of 1.5' of freeboard is required from all EOF's to the lowest openings for all
houses. (i.e. L3, B3 should be a minimum of 930.0 for overflow in SW of lot)
10. It appears that an EOF — 924.6 existing for the low area between L1,B1 and L2,131 Phase
2 across the existing driveway to the north. This EOF is not covered by a D&U easement
therefore it could be raised in the future. The proposed low opening for these lots is 926.5
and 927.4 respectively. No other EOF existing that would provide the needed freeboard.
These house elevations shall be revised so that they have the necessary freeboard or a
drainage and utility easement over the existing lots EOF.
11. Some grading is shown beyond the project boundary along the west side of Ogren
Avenue. Written permission shall be obtained from the property owner before this
grading.
12. The EOF for the central infiltration basin appears to be 914.9. All low openings of houses
surrounding this pond shall be a minimum of 1.5' above this elevation or a minimum of 3'
above the HWL of back-to-back 100 -year storms.
13. The wet sedimentation basin shall have a control (cable concrete) overland overflow.
14. Sheet C2.6, the trail grade cannot be read. The trail shall not exceed 8%.
15. A maximum of 4' would be allowed from the house elevation to the side lot line elevation
(10' side yard setback) to not exceed a 4:1 slope. There are a number of houses with +5'
of difference. These will require retaining walls or the elevations adjusted.
SANITARY AND WATER UTILITY PLANS
16. Sanitary sewer shall be provided for future service to the area west of Odean Avenue and
Linbar Estates. Provide sanitary sewer stubs at the following locations and invert
elevations:
a. 912.00 at the western stub of 73rd Street (West of Odean Avenue).
b. 912.50 at the southern stub of Odell Avenue (South of 72nd Lane).
17. Provide sewer and water service stubs to the existing Lot located to the west of the
proposed intersection of 74`I' Street and Odell Avenue.
18. Provide a hydrant at the end of the proposed watermain stub west of the intersection of
731d Street and Odean Avenue.

19. All pipe shall be a minimum of 15" diameter except for the first pipe in a run.
(i.e pipe from CB 110 to CB 109 shall be minimum of 15").
20. Three existing storm water basins exist adjacent to the project boundaries. These existin
basins discharge overland through the new development. Controlled outlets will be
required to handle these potential discharge/overflows since the regrading of the area will
block this drainage. Provide storm sewer connections to allow storm water outlets from
the following:
a. Existing storm pond located to the west of the proposed intersection of 74"' Street
and Odell Avenue. I.E. — 920.0.
b. Existing pond (dry) located to the south of proposed Lot 5, Block 6 (Phase 3), I.E.
923.0.
c. Existing pond (dry) located to the west of proposed Lot 1, Block 2 (Phase 4), I.E.
917.00.
STREET PROFILE PLANS
21. Please provide horizontal curve data. All vertical and horizontal curves shall meet 30
mph design speed requirements. A number of vertical curves do not meet the minimum K
values or lengths.
STORM WATER POLLUTION PREVENTION PLAN
22. Inlet protection shall be installed on all of the nearest catch basins and.culverts located
downstream from the construction entrance(s) along Odean Avenue and 75"' Street.

23. Please include recommended R -Value provided by the geotechnical engineer used to
determine the street section.
SURFACE WATER MANAGEMENT
24. Please submit a geotechnical exploration report.
25. Currently, the total site runoff for the proposed during a 2 -year rainfall is shown as more
than with the existing conditions. This is not allowed and shall be lowered so that the
total site runoff for the proposed is not more than the existing during a 2 -year rainfall.
The total site runoff during the 10 -year and 100 -year rainfalls appear to meet this
requirement.
26. A portion of the area south of the project boundaries (mostly in Linbar Estates) is not
accounted for in the stoimwater model. This models shall be revised to incorporate
drainage areas outside of the project boundaries where it will affect the Hansen Heights
development.

A RESOLUTION APPROVING VACATION OF EXISTING PUBLIC RIGHT-OF-WAY
WITHIN THE HANSEN HEIGHTS PRELIMINARY PLAT.
WHEREAS, public right-of-way was dedicated with the final plat of Hidden
Haven; and,
WHEREAS, VHF Investments, LLC has requested approval of a preliminary plat
to be known as Hansen Heights; and,
WHEREAS, the preliminary plat of Hansen Heights provides a subdivision design
with public streets that does not utilize the right-of-way that was dedicated with Hidden
Haven; and,
WHEREAS, the public right-of-way within Hansen Heights make unnecessary
that public right-of-way described by Exhibit A; and,
WHEREAS, VHF Investments, LLC has applied for vacation of the existing public
right-of-way described by Exhibit A; and,
WHEREAS, the Planning Commission held a public hearing at their regular
meeting on 15 April 2019 to consider the vacation, preceded by required published and
mailed legal notice; and,
WHEREAS, the City Council heard all parties interested therein and closed the
public hearing; and,
WHEREAS, the public right-of-way described by Exhibit A serves no useful
public purpose; and,
WHEREAS, the City Council having considered all information received related
to the proposed vacation finds that vacating a portion of the existing right-of-way as
shown on Exhibit A would be in the public interest; and,
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Otsego
that Otsego hereby orders:
1. That the public right-of-way located in the City of Otsego, Wright County, State of
Minnesota described by Exhibit A are hereby vacated.
2. The City Council hereby determines that the vacation of said public right-of-way
shall cause no damage to any abutting or nearby property owners and therefore
no damages are awarded to any such property owners.
3. The vacation shall be effective upon approval of a final plat for Hansen Heights.

lot requirements and performance standards established under a Planned Unit Development
Conditional Use Permit (PUD -CUP); single family dwellings are a permitted use within the R-

E. The Planning Commission and City Council must take into consideration the possible effects
of the request with their judgment based upon (but not limited to) the criteria outlined in

Street (CSAH 38). The 2012 Transportation Plan designates 75th Street and Odean
Avenue as residential collector streets, whereas 70th Street (CSAH 38) is designated
as a minor arterial roadway serving regional transportation needs. These roadways
have adequate capacity to accommodate the traffic that will be generated by the
homes within the preliminary plat.
5. The proposed use can be accommodated by existing public services and facilities
and will not overburden the City's service capacity.
Finding: The subject site is located within the East Sewer District where the City
anticipates provision of services in support of urban development as guided by the
Future Land Use Plan; the proposed preliminary plat can be accommodated by
existing City services.
