04-15 19 Planning Commission MinutesOTSEGO PLANNING COMMISSION MEETING OTSEGO CITY HALL APRIL 15, 2019 7:00 PM Call to Order. Chair Black called the meeting to order at 7:00 PM. Roll Call: Chair Pam Black; Commissioners: Jim Kolles, David Thompson, Vern Heidner, Aaron Stritesky, Richard Nichols, and Alan Offerman; Absent: Commissioner Roger Mord; City Council: Mayor Jessica Stockamp. City Staff: City Planner Daniel Licht and Administrative Assistant Kelly Thelen. 1. Announcements: Chair Black announced that Items 3.1 and 3.2 will be continued to the May 6, 2019 agenda at the applicants' request. 2. Consider the following minutes: 2.1 April 1, 2019 Planning Commission Meeting. Commissioner Thompson motioned to approve. Seconded by Commissioner Offerman. All in favor. Motion carried. 3. Public Hearing Items: 3.1 Harvest Run East: (Per applicant this will be continued to May 6) A. Zoning Map amendment rezoning from A-1 District to R-4 District and R-5 District. B. PUD -CUP related to lot requirements. C. Preliminary Plat. D. Vacation of existing drainage and utility easement. Chair Black opened the Public Hearing at 7:02 PM. There were no public comments. Chair Black brought the discussion to the Planning Commission members at 7:02 PM. Commissioner Offerman motioned to continue May 6. Seconded by Commissioner Stritesky. All in favor. Motion carried. 3.2 Insurance Auto Auctions, Inc: (Per applicant this will be continued to May 6) A. Concept Plan for development of a 100 acre auto auction facility. Chair Black brought the discussion to the Planning Commission members at 7:03 PM. Commissioner Thompson motioned to continue May 6. Seconded by Commissioner Kolles. All in favor. Motion carried. 3.3 Gilman: A. Zoning Map amendment to rezone the property from R-2, Residential Long Range Urban Service District (Large Lot) to A-1, Agriculture Rural Service District. City Planner Licht presented the Planning Report. Robert and Heidi Gilman, 6939 Packard Avenue Northeast, applicant, agreed with report. Ms. Gilman stated they have lived there 24 years and wanted pet goats for enjoyment for them and their grandkids. Ms. Gilman researched goats and found them good for the soil. Ms. Gilman added they keep their property up and do not think the goats will be any harm with other animals in the area. Chair Black opened the Public Hearing at 7:09 PM. Chris and Kari Haeska, 14833 70th Street Northeast, supported the rezoning but would also like their property moved to A-1. Ms. Haeska stated they have been there 23 years and got a CUP for horses. Mr. Haeska stated he wouldn't want buyers to worry about a CUP or rezoning fee. Ms. Gilman added the scenery and landscape in Otsego has been enjoyed over the years; many people appreciate having the five acre lot with the animal opportunity. Ms. Gilman stated her support for the Haeska's that would like their land rezoned also. Sam Clark, 14960 70th Street Northeast, stated that he supported the rezoning. Chair Black brought the discussion to the Planning Commission members at 7:12 PM. Commissioner Nichols asked if they move forward is there a limit to the number of goats. City Planner Licht replied the limit is based on animal units; they could have up to 50 goats on this property. Minutes of the Otsego Planning Commission April 15, 2019 Page 3 Commissioner Kolles questioned if they would have to deal with Wright County like a farm does. City Planner Licht answered that under 10 animal units they do not need permit from Wright County. Chair Black returned to the public for additional comment at 7:15 PM. There were no other comments from the public. Chair Black closed the public hearing at 7:15 PM. Commissioner Offerman commented 50 goats sounds like a lot but it could change over time; is there a time limit for the permit. City Planner Licht replied that the goats will be allowed as a permitted use as long as it does not become a nuisance. Commissioner Thompson motioned to recommend approval of a Zoning Map amendment rezoning the subject site from R-2 District to A-1 District based on a finding that the request is consistent with the Comprehensive Plan. Seconded by Commissioner Stritesky. All in favor. Motion carried. 3.4 Hansen Heights: A. Zoning Map amendment rezoning from A-1 District to R-4 District. B. PUD -CUP related to lot requirements. C. Preliminary Plat. City Planner Licht presented the Planning Report. Henry Hansen, 14886 70th St NE, VHF Investments, LLC, applicant, agreed with report. Mr. Hansen stated they are looking at the exception parcel adjacent to Odean Avenue and will pursue in the future to make the neighborhood more functional. Chair Black opened the Public Hearing at 7:28 PM. Sam Clark, 14960 70th Street Northeast, questioned the difference in the first slide with his property in comparison with the letter sent out. City Planner Licht answered the site location map accidentally included Mr. Clark's parcel in Hansen Heights. Mr. Clark said thank you. Gary and Clara Inman, 7272 Odean Avenue Northeast, commented on the bad condition of Odean Avenue and requested the street be repaved with all the additional houses being built and increased traffic in the area. Mr. Inman also stated his trouble with getting to their mailbox on the other side of the Odean Avenue and would like it to be more accessible. City Planner Licht responded that Odean Avenue Northeast has Minutes of the Otsego Planning Commission April 15, 2019 Page 4 been constructed as a major collector street with two lanes and shoulder in both directions with adequate capacity for planned development in the area. City Planner Licht added there could be an opportunity to lower the speed limit as development occurs on both sides of the roadway or provide a four-way stop at 75th Street in the future. City Planner Licht said that mailbox location is a Post Office decision. Beth Murphy, 7490 Odean Avenue Northeast, commented she lives on the corner of the fun and has many concerns with living in a construction zone due to area development. Ms. Murphy added over the winter she had two cars in her yard from the poor driving and weather; her mailbox is in the trash can from getting hit; and the visibility is low with snow and the increased trucks. Mr. Inman asked if a fire department is going to be constructed in the area. City Planner Licht replied that the City Council has completed a Fire Service Study and one area recommended for a fire station is on Odean Avenue Northeast, but the City does not have land acquired. Mr. Clark said he does not object to Hansen Heights and agreed with safety concerns of Mr. Inman and Ms. Murphy. Glen Berscheit, 14790 71St Street Northeast, commented he is very concerned at the amount of traffic that will go past his house. Mr. Berscheit stated he would like the access from CSAH 38 closed. City Planner Licht replied that when Lin Bar Estates was platted, 71St Street was constructed as a future street for adjacent development. City Planner Licht continued that CSAH 38 is a minor arterial roadway with access locations determined by Wright County; Wright County has approved the proposed preliminary plat conditioned on there being no additional accesses to CSAH 38. Mr. Berscheit shared he is still concerned about the increase traffic through Lin Bar Estates. Mr. Clark asked if can there be opportunity for public meetings for people living on Odean Avenue and CSAH 38 to discuss concerns about traffic. City Planner Licht responded that the issues are typically addressed during a comprehensive plan process and this hearing is specifically for Hansen Heights. City Planner Licht stated the transportation element of the City's Comprehensive Plan was recently updated in 2018 and Wright County is currently updating their Transportation Plan and encouraged residents to be involved in that process. Ms. Gilman agreed development cannot be stopped which is wonderful for all people involved that want to live there. Ms. Gilman added that attention to driving of people is different than when the plans were first made. Ms. Gilman commented the upcoming stoplight at Quaday Avenue Northeast and the roundabout on CSAH 38 at Odean Avenue Northeast will reduce speed and cause drivers to be more attentive to driving. Minutes of the Otsego Planning Commission April 15, 2019 Page 5 Mr. Clark said it seems no one has a problem with the development and the Comprehensive Plan is great on paper but not practical for the area. Mr. Clark recommended for the City staff to watch an afternoon of traffic so they see the problems first hand and come back with a real plan. Chair Black brought the discussion to the Planning Commission members at 7:44 PM. Commissioner Nichols questioned how would they develop in future if the 118-500- 284201 parcel is acquired. City Planner Licht said lots will be accessed from Odell Avenue Northeast resulting in maybe six more lots. City Planner Licht added they could redesign a larger area of the preliminary plat to improve the overall layout. Commissioner Thompson commented on the lots backing up to Lin -Bar Estates where the acre lots abut more than two of the proposed lots. City Planner Licht replied with the curved street at the corner of Lin -Bar Estates, the lots get wider to the rear, which differs from lots with 90 -degree side lot lines. Chair Black returned to the public for additional comment at 7:48 PM. Mr. Clark asked why transition lots are required only abutting Lin -Bar Estates and not the other adjacent parcels. City Planner Licht replied that the transitional lots are required only when abutting residentially zoned properties. Lin -Bar Estates is zoned R-3 District and the other adjacent parcels are zoned A-1 District. Mr. Inman questioned if they do not make an agreement what will happen with the street that stops at the four acre exception parcel. City Planner Licht responded the street would be constructed to the property line. The owner of the four acre parcel could later extend the street and utilities to subdivide. Mr. Clark asked if the City Council takes public comment. Chair Black replied that comments are required to be made during this public hearing. Chair Black closed the public hearing at 7:52 PM. Commissioner Nichols asked for clarification on lot requirements chart on page 2 of the planning report. City Planner Licht explained that the two rows are for the interior and transition lots and that he would clarify the table. Commissioner Thompson asked about the requirement for 100 foot lot depth. City Planner Licht said R-4 District lots are required to have 100 foot lot depth and transition lots abutting Lin -Bar Estates are to be 135 foot lot depth. Minutes of the Otsego Planning Commission April 15, 2019 Page 6 Commissioner Nichols motioned to recommend approval of a Zoning Map amendment rezoning the subject site from A-1 District to R-4 District based on a finding that the request is consistent with the criteria outlined in Section 11-3-2.17 of the Zoning Ordinance. Seconded by Commissioner Stritesky. All in favor. Motion carried. Commissioner Thompson motioned to recommend City Council approval of a vacation of existing public right-of-way and a PUD-CUP/preliminary play for Hansen Heights, subject to the ten conditions. Seconded by Commissioner Offerman. All in favor. Motion carried. 4. Update on City Council actions. Mayor Jessica Stockamp updated the Planning Commission on recent City Council actions. 5. Update on future Planning Commission Agenda items. City Planner Licht updated the commissioners on possible future agenda items. Mayor Stockamp asked about providing notification when applications are requested to be continued. City Planner Licht replied that continuations have posted on website as soon as we know. The Planning Commission discussed adding to future Public Hearing Notices to check website for updates and that the meeting agenda and packets are on website. Mayor Stockamp suggested the City require that the Public Hearing notice be resent at the applicant's cost. The Planning Commissioners concurred with renoticing continued public hearings. City Planner Licht said that City staff will implement these ideas. 6. Adjourn. Commissioner Stritesky motioned to adjourn. Seconded by Commissioner Offerman. All in favor. Motion carried.
