AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends adoption of a resolution vacating a portion of an existing drainage and utility easement. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No Yes – 28 May 2019 BACKGROUND/JUSTIFICATION: TC Homes, Inc. is constructing townhouse buildings within Kittredge Crossings 7th Addition. The builder has encountered an issue siting a townhouse building on Lot 1, Block 13 due to a drainage and utility easement. The builder has applied to vacate a portion of the drainage and utility easement to allow for the building footprint. A public hearing has been noticed to consider the proposed vacation. The City Engineer has reviewed the application and determined that the easement can be vacated without impacting stormwater drainage or utilities. City staff has drafted a resolution for consideration and adoption by the City Council following closure of the public hearing. WHEREAS, the City Council approved the final plat of Kittredge Crossings 7th Addition onFebruary 28, 2005; and, WHEREAS, easements were dedicated to the City for public drainage and utility purposes as described by Exhibit A that are within the plat of Kittredge Crossings 7th Addition; and, WHEREAS, the TC Homes, Inc. has acquired lots within Kittredge Crossings 7th Addition for the purposes of constructing residential dwellings in accordance with the final plat; and, WHEREAS, TC Homes, Inc. has applied for vacation of the drainage and utility easement described by Exhibit A; and, WHEREAS, the City Council held a public hearing at their regular meeting on 28 May 2019 to consider the vacation request, preceded by required published and mailed legal notice; and, WHEREAS, the City Council heard all parties interested therein and closed the public hearing; and, WHEREAS, the City Engineer recommends that the drainage and utility easements described by Exhibit A serve no useful public purpose; and, WHEREAS, the City Council having considered all information received related to the proposed vacation and easement dedication finds that vacating the existing drainage and utility easement as described by Exhibit A would be in the public interest; and, NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Otsego that Otsego hereby orders: 1. That the drainage and utility easements located in the City of Otsego, Wright County, State of Minnesota described by Exhibit A are hereby vacated. 2 2. The City Council hereby determines that the vacation of said drainage and utility easement shall cause no damage to any abutting or nearby property owners and therefore no damages are awarded to any such property owners.
