No No BACKG ROUN D/J USTI FI CATI ON: Elk Inn Partners, LLC is in the process of selling the Holiday Inn property in Otsego Waterfront Fourth Addition. Title examination of the property indicates that there are two outstanding Developers Agreements affecting the property, one Agreement is for the overall Otsego Waterfront and the other relates specifically to the Holiday Inn property. The Developers Agreements date back to 2002 and 2003. EII< Inn Partners, LLC has requested that the City release the property from the terms and conditions of these Agreements. I have reviewed the Developers Agreements and have checked with City staff regarding outstanding assessments or financial obligations. All of the obligations in the two listed Agreements have been satisfied. Therefore, City staff recommends that the City release the property from these Agreements as requested.
