CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF OTSEGO
TO PROVIDE FOR SELF-PERPETUATING ADOPTION OF THE CURRENT
MINESOTA STATE BUILDING CODE.
THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN:
Section 1. Ordinance No. 99-1 adopted by the Otsego City Council on 27
January 1999 is hereby repealed in its entirety.
Section 2. Chapter 4, Section 1 of the Otsego City Code is hereby adopted to
read as follows:

4-1-1: BUILDING CODE:
A. The Minnesota State Building Code, established pursuant to Minnesota Statutes
1613.59 to 16B.75, including all of the amendments rules and regulations
established, adopted and published from time to time by the Minnesota
Commissioner of Administration, through the Building Codes and Standards
Division is hereby adopted by reference as the building code for this jurisdiction,
excepting of the optional chapters unless specifically adopted in Section 4-1-1.13
and Section 4-1-1.0 of this Section. The code is hereby incorporated in this
Section as if fully set out herein.
B. The Minnesota State Building Code, established pursuant to Minnesota Statutes
16B.59 to 16B.75 allows the Municipality to adopt by reference and enforce
certain optional chapters of the most current edition of the Minnesota State
Building Code.
The following optional provisions identified in the most current edition of the
State Building Code are hereby adopted and incorporated as part of the building
code for this municipality.
1. 1335 Floodproofing Regulations parts 1335.0600 to 1335.1200
2. 1306 Special Fire Protection Systems 1306.0020 subpart 2
4-1-2: APPLICATION, ADMINISTRATION AND ENFORCEMENT:
A. The application, administration, and enforcement of the code shall be
in accordance with Minnesota State Building Code. The code shall be
enforced within the extraterritorial limits permitted by Minnesota
Statutes, 16B.62, subdivision 1, when so established by this ordinance.
B. This code enforcement agency of this municipality is called the
Department of Building Safety.
C. This code shall be enforced by the Minnesota Certified Building
Official designated by this Municipality to administer the code
(Minnesota statute 1613.65) subdivision 1.
4-1-3: PERMITS AND FEES:
A. The issuance of permits and the collection of fees shall be as authorized in
Minnesota Statute 1613.62, Subdivision 1.
B. Permit fees shall be assessed for work governed by this code in accordance
with the fee schedule adopted by the City of Otsego: Ordinance No. 2003-
25. In addition, a surcharge fee shall be collected on all permits issued for
work governed by this code in accordance with Minnesota statute 16B.70.
4-1-4: VIOLATIONS AND PENALTIES: Violation of this Code is a
misdemeanor as established by Minnesota Statute 16B.69. (Ord. 2003-26,
December 22, 2003)
Section 4. This Ordinance shall become effective immediately upon its
passage and publication.
