ORD 05-20ORDINANCE NO.: 2005-20 CITY OF OTSEGO COUNTY OF WRIGHT, MINNESOTA AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF OTSEGO TO ESTABLISH A PUD DISTRICT FOR LAND INCLUDED WITHIN MISSISSIPPI SHORES 6T"17 TH AND 8T" ADDITIONS. THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN: Section 1. The official Zoning Map of the Otsego Zoning Ordinance is hereby amended to change the zoning classification of the property legally described as Lots 3, 4 and 5, Block 1 Mississippi Shores 6t' Addition, Lot 1, Block 1 Mississippi Shores 7t' Addition and Lot 1, Block 1 Mississippi Shores 8t' Addition, City of Otsego, County of Wright, State of Minnesota. Section 2. The property is hereby rezoned from B-3, General Business District to PUD, Planned Unit Development District designation. Section 3. The uses allowed within the PUD District shall be the same as provided for by the B-3 District. Section 4. The minimum lot area and width requirements within the PUD District shall be the same as provided for by the B-3 District. Section 5. Setbacks within the PUD District shall be as follows: CSAH 39 CSAH 42 Frontage Street Park Avenue Side Rear 30ft. 30ft. Oft. 30ft. 10ft. or 35 ft. abutting an R District at the perimeter of the PUD; Within the PUD District a 201t. separation between buildings shall be maintained. Section 6. Cross access and off-street parking easements shall be established over each lot within the PUD District. Section 7. Each property within the PUD District shall enter into a land -lease agreement with the City to provide for all maintenance of the access drive within City right-of-way and to allow use of areas within the right-of-way for parking stalls to comply with off-street parking requirements for individual uses within the PUD District. Section 8. Provision of off-street parking for uses within the PUD District shall comply with Chapter 21 of the Zoning Ordinance. Section 9. Redevelopment of any individual lot within the PUD District shall be subject to the PUD District Design Guidelines dated . The PUD District Design Guidelines are subject to review and approval of City staff. Section 10. All signs shall conform to Section 37 of the Zoning Ordinance. Section 11. The zoning map of the City of Otsego shall not be republished to show the aforesaid rezoning, but the City Clerk shall appropriately mark the zoning map on file in the City Clerk's office for the purpose of indicating the rezoning hereinabove provided for in this Ordinance, and all of the notations, references and other information shown thereon are hereby incorporated by reference and made part of this Ordinance. Section 12. This Ordinance shall become effective immediately upon its passage and publication. PASSED by the Otsego City Council this 26th day of September, 2005.
