BACKG R O U N D/J USTI FI CATI O N:
In January 2018, the City of Otsego entered into an Asset Transfer Agreement with Elk River Municipal
Utilities (ERMU) to transfer ownership of certain street lighting systems within the City of Otsego. These
lighting systems were located in Waterfront West, Waterfront East and Great River Centre. There are 92
existing decorative lights within these three development areas.
ERMU has informed the City of their desire to begin replacement of the streetlight system within
Waterfront West, where there are 28 lights being considered for replacement. This development is being
considered for replacement due to multiple reasons. The first is that there are currently multiple damaged
lights that need to be replaced; and second, that finding replacements for the existing lights is very difficult
and also very expensive.
ERMU has provided the City with two options for replacement of the existing lights. The first option is a
"cobra" style light that is a more contemporary looking light, and there is no cost to the City for this option.
The second option is an "acorn" style, and would be considered more of a decorative light, and is an
upgrade, and the City would be responsible for $1,000 per light.
The Public Works Subcommittee initially discussed this information at its April 17, 2019 meeting and the
City Council discussed this matter at the April 22, 2019 meeting and asked for clarification on the following:
1) Confirmation on lawful uses of funds available in the Above Standard Street Lighting Fund.
The City's Above Standard Street Lighting Fund was established in accordance with Minnesota
Statute §428A, Special Service Districts. The current balance of available funds is $89,718.97. The
City Attorney has reviewed the statute and has stated the opinion that the funds are only available
for use to provide the special services in the district.
2) Whether any other lighting options were available.
ERMU has confirmed that no additional lighting options are available.
Since the previous discussions, ERMU has installed both lighting options within Waterfront West for
viewing and comparison by the City Council. ERMU has also provided clarification that the existing tall light
poles (illumination of the roadway) will be retrofitted with the "cobra" style fixture at the same time as the
short light poles (illumination for pedestrian uses).
ERMU has informed City staff that once they receive the light poles and fixtures, the lead time for
completing installation would be approximately 8-10 weeks.
