AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends accepting all public improvements associated with Harvest Run, thus starting the warranty period. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/J UST I FI CATI O N: All improvements have now been completed including the final lift of pavement. Erosion control is still in place until vegetation has been established and shall be removed prior to final acceptance at the end of the warranty period. An initial acceptance walk-thru was conducted with City Staff, the developer, and contractor on October 15th, 2019. All remaining items have now been successfully completed. Staff recommends that all public improvements be initially accepted as of the date of the initial acceptance walk-thru date of October 15th. 2019. Per the Developer's agreement for Harvest Run, the Developer warrants; 1. All public improvements, other than streets, within the plat as of the date of this resolution commencing the one (1) year warranty period from this date. 2. All public street improvements within the plat as of the date of this resolution commencing the two (2) year warranty period from this date. BUDGET INFORMATION FUNDING: BUDGETED: N/A N/A RESOLUTION NO. 2019-72 CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA ACCEPTING PUBLIC IMPROVEMENTS FOR HARVEST RUN FIRST ADDITION WHEREAS, the City Council approved the final plat of Harvest Run First Addition (the "plat"); and, WHEREAS, the City and Developer entered into a Development Agreement March 28, 2018 for Harvest Run and recorded as Document No. A1367633 with Wright County regarding approval of the plat and installation of required public improvements within the plat; and, WHEREAS, all public street improvements, including bituminous base and wear course paving, curb and gutter, sidewalk, grading and erosion control have been completed; and, WHEREAS, all public utility improvements, including watermain and services, sanitary sewer main and services, and storm sewer have been completed; and, WHEREAS, all public improvements were constructed in accordance with City standards, Code and approved plans within the plat; and, WHEREAS, an initial acceptance inspection of the public improvements within the plat was conducted on October 15, 2019 with City staff and the Developer, and all remaining items have been successfully completed; and, NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO MINNESOTA THAT 1. The City accepts all public improvements, other than streets, within the plat as of October 15, 2019 thus commencing the one (1) year warranty period from this date. 2. The City accepts all public street improvements within the plat as of October 15, 2019 thus commencing the two (2) year warranty period from this date. 3. Upon conclusion of the respective warranty periods and completion of a final acceptance inspection by City staff and satisfaction of any conditions of said final inspection, improvements lying within public easements and public right-of-way shall be come City property without further notice or action.
