AGENDA ITEM DETAILS RECOMMENDATION: That the Council approve the attached Resolution Reapportioning Assessments on the Kevin Lefebvre property. ARE YOU SEEKING APPROVAL OFA CONTRACT? No No BACKGROUND/JUSTIFICATION: Property Owner Kevin Lefebvre has requested reapportionment of the pending City assessment against his property, PID 118-500-221301 totaling 35.08 acres. The request is for purposes of transfer of a portion of the property (26.27 acres) to Henry Hansen Enterprise in order to establish the Parrish Meadows development. Minnesota statutes allow the City Council to reapportion an existing assessment by resolution. The City Administrator has calculated the reapportionment as set forth in the attached Resolution. City staff recommends that the City approve the assessment reapportionment. SUPPORTING DOCUMENTS ATTACHED: • Resolution Reapportioning Assessment Against Property- Lefebvre Parcel POSSIBLE MOTION PLEASE WORD MOTION AS YOU WOULD LIKE ITTO APPEAR IN THE MINUTES: Motion to Approve Resolution Reapportioning Assessment Against Property- Lefebvre Parcel BUDGET INFORMATION FUNDING: BUDGETED: N/A N/A CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO. 2019-73 RESOLUTION REAPPORTIONING ASSESSMENT AGAINST PROPERTY- LEFEBVRE PARCEL WHEREAS, Kevin Lefebvre, Property Owner, has requested an Administrative Split of his property identified as PID 118-500-221301 containing 35.08 acres and designated as the Original Parcel within the City of Otsego; and WHEREAS, Henry Hansen Enterprise is acquiring 26.27 acres of the Original Parcel, designated as the Purchased Parcel; and WHEREAS, Kevin Lefebvre will retain 8.81 acres, designated as the Remainder Parcel; and WHEREAS, the City of Otsego has outstanding assessments for improvements to CSAR 42 against the Original Parcel in the current amount of $731,870.83 as of November 8, 2019; and WHEREAS, Minnesota Statute 429.071, subdivision 3 empowers the City Council to reapportion assessments upon subdivision of land NOW, THEREFORE it is hereby resolved by the City Council of the City of Otsego, Wright County, Minnesota as follows: The CITY OF OTSEGO hereby apportions the $731,870.83 assessment against the Original Parcel as follows; $548,068.61 is hereby apportioned to the Purchased Parcel and $183,802.22 is hereby apportioned to the Remainder Parcel. 2. Apportionment of the Assessment as set forth above is contingent upon granting of the Administrative Split and purchase of the property. APPROVED this 12th day of November, 2019 by the Otsego City Council.
