Staff recommends approval of a resolution accepting public improvements for Martin Farms 3rd Addition.

BACKGROUND/J U STI FI CATI O N:
All public improvements have now been completed including the final lift of pavement. Erosion control is
still in place in some areas until vegetation has been established, but will be removed prior to final
acceptance at the end of the warranty period.
An initial acceptance walk-thru was conducted with City Staff, the developer, and contractor September 30,
2019. As -built construction plans and all remaining items have now been successfully completed.
Staff recommends that all public improvements be initially accepted as of the date of the initial acceptance
walk-thru date of September 30, 2019. Per the Developer's agreement for Martin Farms 3rd Addition, the
Developer warrants;
1. All public improvements, other than streets, within the plat as of the date of this resolution
commencing the one (1) year warranty period from this date.
2. All public street improvements within the plat as of the date of this resolution commencing the
two (2) year warranty period from this date.

CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
ACCEPTING PUBLIC IMPROVEMENTS FOR
MARTIN FARMS 3RD ADDITION
WHEREAS, the City Council approved the final plat of Martin Farms 3rd Addition
(the "plat"); and,
WHEREAS, the City and Developer entered into a Development Agreement
March 22, 2016 for Martin Farms 3rd Addition and recorded as Document No. Al 314473
with Wright County regarding approval of the plat and installation of required public
improvements within the plat; and,
WHEREAS, all public street improvements, including bituminous base and wear
course paving, curb and gutter, sidewalk, grading and erosion control have been
completed; and,
WHEREAS, all public utility improvements, including watermain and services,
sanitary sewer main and services, and storm sewer have been completed; and,
WHEREAS, all public improvements were constructed in accordance with City
standards, Code and approved plans within the plat; and,
WHEREAS, an initial acceptance inspection of the public improvements within
the plat was conducted on September 30, 2019 with City staff and the Developer, and
all remaining items have been successfully completed; and,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO
MINNESOTA THAT
1. The City accepts all public improvements, other than streets, within the plat as of
September 30, 2019 thus commencing the one (1) year warranty period from this
date.
2. The City accepts all public street improvements within the plat as of September
30, 2019 thus commencing the two (2) year warranty period from this date.
3. Upon conclusion of the respective warranty periods and completion of a final
acceptance inspection by City staff and satisfaction of any conditions of said final
inspection, improvements lying within public easements and public right-of-way
shall be come City property without further notice or action.
