AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends approval of an ordinance amending provisions of the City Code related to biosolid disposal sites. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKG RO UN D/J USTI FICATION: Title 5, Section 3 of the City Code regulates waste collection and disposal facilities within the City. Section 5-3-8 prohibits waste disposal facilities within Otsego with the only exception being for land application sites for biosolid materials generated at the City's Wastewater Treatment Facilities (WWTFs). The City has discussed with the City of St. Michael an agreement for applying to the Minnesota Pollution Control Agency for a permit to allow a new land disposal site in Otsego that would be used on an emergency basis by St. Michael and regular use by Otsego after 2020. Otsego will be the MPCA permit holder and allow St. Michael access to the proposed site for land application of its biosolids. The agreement between Otsego and St. Michael addresses the operational relationship for use of the proposed site. The joint use of the proposed site for land application of biosolids requires amendment of the City Code that currently allows land application of biosolids generated by City WWTFs. The revised language for Section 5-3-8.13.5 would allow for land application of biosolids to sites permitted by Otsego. This amendment will allow for the City to permit the proposed application site and allow for St. Michael to utilize the site subject to the separate agreement. ORDINANCE NO.: 2020-06 CITY OF OTSEGO COUNTY OF WRIGHT, MINNESOTA AN ORDINANCE AMENDING THE CITY CODE RELATED TO BIOSOLID DISPOSTAL SITES. THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN: Section 1. Section 5-3-2 of the City Code (Solid Waste Collection and Disposal - Definitions) is hereby amended to revise the following definition: SLUDGE1310SOLID: Any solid, semisolid or liquid waste generated from a Municipal, commercial or industrial wastewater treatment pIapt=acility, water supply treatment pla-ntfacility• or air contaminant treatment facility, or any other waste having similar characteristics and effects, Minnesota Statutes section 116.06, subdivision 21.f Section 2. Section 5-3-8.13.5 of the City Code (Solid Waste Collection and Disposal — Waste Disposal Facilities and Methods) is hereby amended to read as follows: 5. SludgeBiosolid Disposal Sites: Sites designated any the City GeunGil for which the Minnesota Pollution Control Agency has issued a permit to the City for use for d+spesal of sludgeland application of biosolids generated by Municipal wastewater treatment plantsfacilities owned and operated by the City shall be exempt from the prohibition established by subsection 131 of this section. Section 3. This Ordinance shall become effective immediately upon its passage and publication.
