AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends adoption of a resolution vacating existing drainage and utility easements within the the E-WWTF plat. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No Yes; Held on 27 April 2020 BACKGROUND/JUSTIFICATION: The City of Otsego has initiated a preliminary and final plat to combine the two (2) existing parcels that comprise the E-WWTF into a single lot. The preliminary and final plat was approved by the City Council at their meeting on 24 February 2020. There are existing drainage and utility easements within one (1) of parcels that must be vacated for the final plat to be recorded. A public hearing to consider the vacation of the existing drainage and utility easements within the preliminary/final plat has been noticed for the City Council meeting on 27 April 2020. The vacated drainage and utility easements will be replaced by those easements shown on the preliminary/final plat as required by Section 10-8-12 of the Subdivision Ordinance and as approved by the City Engineer. SUPPORTING DOCUMENTS ATTACHED: ■ Resolution 2020-26 CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2020-26 VACATIING EXISTING DRAINAGE AND UTILITY EASEMENTS WITHIN THE PLAT OF OTSEGO EAST WASTEWATER TREATMENT FACILITY WHEREAS, the City Council approved the final plat of the Otsego East Wastewater Treatment Facility on 24 February 2020; and, WHEREAS, there are existing drainage and utility easements as dedicated over Outlot A, RIVERPLACE 2ND ADDITION, Wright County, Minnesota as shown on Exhibit A; and, WHEREAS, the approved plat includes dedication of drainage and utility easements as required by the Subdivision Ordinance; and, WHEREAS, the dedication of drainage and utility easements with the plat supersede and make unnecessary the existing drainage and easements; and, WHEREAS, City of Otsego has initiated vacation of the existing drainage and utility easements; and, WHEREAS, the City Council held a public hearing at their regular meeting on 27 April 2020 to consider the vacation, preceded by required published and mailed legal notice; and, WHEREAS, the City Council heard all parties interested therein and closed the public hearing; and, WHEREAS, the existing drainage and utility easements as dedicated over Outlot A, RIVERPLACE 2ND ADDITION, Wright County, Minnesota as shown on Exhibit A serve no useful public purpose; and, WHEREAS, the City Council having considered all information received related to the proposed vacation and easement dedication finds that vacating the existing permanent easement as shown on Exhibit A would be in the public interest; and, THAT: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA 1 1. That the drainage and utility easements as dedicated over Outlot A, RIVERPLACE 2ND ADDITION, Wright County, Minnesota as shown on Exhibit A are hereby vacated. 2. The City Council hereby determines that the vacation of said drainage and utility easement shall cause no damage to any abutting or nearby property owners and therefore no damages are awarded to any such property owners.
