BACKGROUND/JUSTIFICATION:
DR Horton final platted Zimmer Farms 6th Addition on 28 November 2005 consisting of 13 lots for
townhouse buildings. The ownership of the townhouse units was later divided through a Common
Interest Community (CIC) declaration. Lewski Properties, LLC has acquired the 6 lots within Zimmer Farms
6th Addition that remain unbuilt upon. The applicant is proposing to subdivide the 6 lots into 46 unit lots
such that the future buyers will own their unit and the ground immediately underneath the dwelling.
■ Comprehensive Plan. The subject site is guided by the 2012 Comprehensive Plan for Medium -to -
High Density Land Uses. The proposed final plat is consistent with the Future Land Use Plan of the
2012 Comprehensive Plan.
■ Zoning. The subject site is zoned R-6, Medium Density Residential District. Townhomes are an
allowed used within the R-6 District.
■ Preliminary Plat Consistency. The preliminary plat identifies 46 units within the 6 buildings
platted as Blocks 8-13, Zimmer Farms 6th Addition. The 46 unit lots within 6 blocks shown on the
proposed final plat is consistent with the preliminary plat.
Access. Private access drives were constructed by DR Horton to access the townhouse dwellings
within Zimmer Farms 61h Addition and remain within the base lot owned by the Heritage Estates
CIC. The applicant has provided documentation of an agreement between Heritage Estates CIC and
Marlowe Townhomes Home Owners Association for access and shared maintenance of the private
drives.
Utilities. Sewer and water connections were extended to the proposed townhouse lots by DR
Horton with the initial development of Zimmer Farms 6th Addition. These are single connections
based on the existing CIC configuration of the plat. Section 8-2-1.A of the City Code requires
individual water connections to townhouse dwellings platted as unit lots. The City Engineer and
Utilities Department are requiring installation of individual water meters and shut off valves for
each unit within a room accessible by the City. The HOA documents will also address shared
liability of all of the units within a single building as to any repairs or maintenance to the joint
sewer line from the building.
DR Horton paid %2 of the combined utility availability and connection charges for the 46 townhouse
units at the time Zimmer Farms 6th Addition was approved in accordance with the fee structure in
place at the time. The applicant will be required to pay % of the combined utility availability and
connection charges for the 46 townhouse units at the time of building permit for each building.
The remaining utility availability and connection charges will be based on the City's current fee
schedule in effect at the time a building permit is applied for.
Grading Plan. A grading plan was approved with the Zimmer Farms 6th Addition final plat that
includes the subject sites. Verification that the proposed construction of each of the 6 townhouse
buildings complies with the grading plan will be verified at the time of building permit. All grading
and drainage issues are subject to review and approval of the City Engineer. Stormwater impact
fees for Otsego Creek for the subject site were paid at the time of final plat approval for Zimmer
Farms 6th Addition.
■ Park Dedication. Park dedication fees in lieu of land for the subject site were paid at the time of
final plat approval for Zimmer Farms 6th Addition. No additional park dedication is required for the
final plat changing the lots for the 6 buildings into 46 unit lots within 6 building.
■ Development Agreement. There are no public improvements being installed with the final plat.
Any private improvements, including driveways and landscaping, will be addressed by securities
provided at the time a building permit is issued. No development agreement is required for the
proposed final plat.
■ Homeowners Association. The applicant has provided documents to establish a homeowner's
association for the proposed townhouse unit lots. The homeowner's association documents are
subject to review and approval of City staff and are to be recorded concurrent with the final plat.
■ Recording. Section 10-5-3-13.8 of the Subdivision Ordinance requires recording of the final plat
within 100 days of City Council approval.

FINDINGS & DECISION
Final Plat
FINDINGS: Based upon review of the application and evidence received, the Otsego City Council now makes
the following findings of fact:
A. The legal description of the property is Lot 1, Block 8; Lot 1, Block 9; Lot 1, Block 10; Lot 1, Block 11;
Lot 1, Block 12; Lot 1, Block 13, Zimmer Farms 6th Addition, City of Otsego, Wright County,
Minnesota.

The property lies within the West Sewer District and is guided for Medium -to -High Density
Residential uses by the 2012 Otsego Comprehensive Plan, as amended.
The property is zoned R-6, Medium Density Residential District.
The City Council approved the Zimmer Farms 6th Addition final plat on
The applicant is proposing a final plat to subdivide the 6 lots each for a townhouse building into 46
unit lots for 6 townhouse buildings.
The Request for Council Action dated 26 May 2020 prepared by the City Planner, The Planning
Company LLC, is incorporated herein.
Final plats are processed in accordance with Section 10-3-3 of the City Code and do not require
review by the Planning Commission.
DECISION: Based on the foregoing information and applicable ordinances, the request is hereby APPROVED,
subject to the following conditions:
1. All grading, drainage, and erosion control plans are subject to review and approval by the City
Engineer.
2. All utility issues are subject to review and approval of the City Engineer, including:
a. Individual water meters and shut off valves for each unit shall be installed within a room
accessible by the City.
b. Shared liability of all of the units within a single building as to any repairs or maintenance to
the joint sewer line from the building shall be included within homeowner's association
documents to be recorded with the final plat.

The developer shall pay at the time a building permit is issued a fee equal to one-half of the
combined total of utility availability and connection charges as set forth on the City fee schedule then
in effect.
4. The developer shall establish a homeowner's association concurrent with recording of the final plat;
documents establishing a homeowners association shall be subject to review and approval of City
staff.
5. The final plat shall be recorded within 100 days of City Council approval as required by Section 10-5-
3-6.8 of the Subdivision Ordinance.
