AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends approval of a resolution releasing the lot within Otsego Preserves used as an interim lift station. ARE YOU SEEKING APPROVAL OF A CONTRACT? No No BACKGROUND/JUSTIFICATION: An interim sewer lift station was constructed on Lot 9, Block 5 Otsego Preserves 2nd Addition to provide sewer service to the Otsego Preserves development. The final platting of Magnolia Landing to the south of Otsego Preserves has allowed for relocation of the permanent lift station for this sewer shed and removal of the interim facility. Construction of the permanent lift station has been completed, accepted by the City Engineer and is in operation. City staff has drafted a resolution to release its use of the lot to the property owner. The lot is zoned R-4, Single Family Residential and has been platted for construction of a single family dwelling. BUDGET INFORMATION FUNDING:' BUDGETED: NA CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2020-34 RELEASING CITY USE OF LOT 9, BLOCK 5 OTSEGO PRESERVES 2ND ADDITION WHEREAS, the final plat of OTSEGO PRESERVES 2ND ADDITION was approved by the City Council on 24 January 2005; and WHEREAS, LOT 9, BLOCK 5, OTSEGO PRESERVES 2ID ADDITION included interim municipal sewer improvements owned and maintained by the City until such time as permanent infrastructure was constructed; and WHEREAS, the City has completed construction of permanent municipal sewer improvements in conjunction with the plat of Magnolia Landing; and WHEREAS, whereas the City has removed the interim municipal sewer improvements and restored LOT 9, BLOCK 5, OTSEGO PRESERVES 2ND ADDITION; and WHEREAS, the City no longer has a use for LOT 9, BLOCK 5, OTSEGO PRESERVES 2ND ADDITION as provided for by the conditions of final plat approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA THAT: 1. The City Council does hereby release its use of LOT 9, BLOCK 5, OTSEGO PRESERVES 2ND ADDITION for interim municipal sewer facility purposes. 2. LOT 9, BLOCK 5 OTSEGO PRESERVES 2"d ADDITION remains subject to the drainage and utility easements dedicated with the final plat of OTSEGO PRESERVES for public purposes. 3. The City Council hereby determines that the release of the City's use of LOT 9, BLOCK 5, OTSEGO 2ND ADDITION shall cause no damage to the property owner or abutting or nearby property owners and therefore no financial awards are made to any such property owners.
