ITEM 2.12_1 OTSEGO PLANNING COMMISSION MEETING OTSEGO CITY HALL May 04, 2020 7:00 PM Call to Order. Chair Offerman called the meeting to order at 7:00 PM. Roll Call: Chair Alan Offerman, Commissioner Charles Foster; Present via teleconference: Commissioners Vern Heidner, David Thompson, Aaron Stritesky. Absent: Commissioners Pam Black, Jim Kolles, and Richard Nichols; Present: City Council: CM Tom Darkenwald. City Staff: City Planner Daniel Licht and City Deputy Clerk Bethany Benting. 1. Announcements: City Planner Licht stated that Commissioners Stritesky, Thompson, and Heidner are participating via teleconference in accordance with Minnesota Statute 13D.015. Commissioner Stritesky joined via teleconference at 7:02 PM. 2. Consider the following minutes: 2.1 Planning Commission April 6, 2020. Commissioner Thompson motioned to approve the minutes as written. Seconded by Commissioner Heidner. Roll Call: Those for; Offerman, Foster, Heidner, Thompson, Stritesky. Those opposed; None. Motion carried. 5-0 3. Public Hearin_ Items: 3.1 White: A. Zoning Map amendment rezoning from A-1 District to A-2 District. B. Conditional use permit to allow for subdivision of the property into two parcels each allowed one (1) single family dwelling. City Planner Licht presented the Planning Report. Applicant, Mary White, was present and agreed to the staff report. John Holthaus, Keller Williams Reality asked to confirm the 44 -acre parcel would have a development entitlement. City Planner Licht confirmed yes. Chair Offerman opened the Public Hearing at 7:07 PM. There were no public comments. Chair Offerman asked if subdivision of the 12 -acre parcel would come back to the Planning Commission for approval. City Planner Licht said yes. Commissioner Heidner asked about restrictions for a house location on the property. City Planner Licht said a condition requiring adherence to the ghost plat was not recommended as it is the property owner's decision if they want to locate the house in a way that meets the subdivision plan. Commissioner Heidner asked if the development rights can be transferred to another land owner. City Planner Licht said that transfer of development rights to another property is allowed by conditional use permit. Commissioner Thompson to verify that a transfer of development rights to a different landowner would come before the Planning Commission for approval. City Planner Licht stated yes. Commissioner Thompson motioned to recommend approval of a Zoning Map amendment rezoning the subject site from A-1 District to A-2 District based on a finding that the request is consistent with the criteria outlined in Section 11-3-2.F of the Zoning Ordinance. Seconded by Commissioner Heidner. Roll Call: Those for; Offerman, Foster, Heidner, Thompson, Stritesky. Those opposed; None. Motion carried. 5-0 Commissioner Stritesky motioned to approve a conditional use permit allowing administrative subdivision of a lot with an area less than 20 acres within the A-2 District, subject to the following conditions as presented. Seconded by Commissioner Heidner. Roll Call: Those for; Offerman, Foster, Heidner, Thompson, Stritesky. Those opposed; None. Motion carried. 5-0 Chair Offerman said the applications will go to the City Council meeting on Monday May, 11, 2020 at 7 PM. 4. Update on City Council actions. CM Darkenwald updated the Planning Commission on recent City Council actions. 5. Update on future Planning Commission Agenda items.
