Daniel Licht, AICP REPORT DATE: 11 June 2020 ACTION DATE: 9 September 2020 (120 days) RE: Otsego — Hunter Hills; Preliminary Plat / EAW TPC FILE: 101.02 BACKGROUND Otsego Land Investment, LLC has submitted plans for development of 59 single family lots as the first phase to subdivide 207.59 acres located east of Labeaux Avenue (CSAH 19) and north of 80th Street. Due to the area of the subject site, the developer is required to prepare an Environmental Assessment Worksheet (EAW) evaluating full development of the property proposed as at total of 579 dwelling units. Development entitlements will be limited to the first phase and includes applications for a Zoning Map amendment and PUD-CUP/preliminary plat as well as vacation of existing public right-of-way for a portion of 80th Street. A public hearing to consider the applications has been noticed for the Planning Commission meeting on 15 June 2020. A mandatory EAW is required for the preliminary plat per Minnesota Rules Section 4410.4300, Sudp. 19.1) for as connected action for residential development of more than 250 dwelling units. An EAW was prepared and published by the Environmental Quality Board on 26 May 2020 with the required comment period ending on 25 June 2020, The EAW document is available for review on the City website at www.ci.otsego.mn.us/publicnotice. Pursuant to Minnesota Rules 4410.1700, in deciding whether a project has the potential for significant environmental effects the need for an Environmental Impact Statement (EIS), the following factors are to be considered: Type, extent and reversibility of environmental effects. b. Cumulative potential effects of related or anticipated future projects. The extent to which the environmental effects are subject to mitigation by ongoing public regulatory authority. d. The extent to which environmental effects can be anticipated and controlled as a result of other environmental studies undertaken by public agencies or the project proposer, or of EISs previously prepared on similar projects. The proposed development is subject to review for compliance with the 2012 Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance, and Engineering Manual, as well as the other agency applications outlined in Paragraph 8 of the EAW. Compliance with these policies and performance standards will mitigate any potential significant environmental effects, which are not anticipated. City staff recommends that preparation of an EIS not be required. Surrounding Uses. The subject site is surrounded by the existing and planned uses shown in the table below. The character of the proposed development is similar to development of Arbor Creek to the south of 80th Street consistent with the Future Land Use Plan. The proposed development will also be compatible with existing rural residential single family dwellings in the area. The farmstead located to the east of the subject site is a registered feedlot under Section 11-27-2.B of the Zoning Ordinance, which provides for establishment a reciprocal setback for any new residential dwelling from buildings used to house farm animals. The Future Land Use Plan of the 2012 Comprehensive Plan guides the subject site for low density residential uses south of future 85th Street and low density residential uses (Large Lot) north of future 85th Street. Low density residential uses are defined by the 2012 Comprehensive Plan as single family development with a net density of 3.0 dwelling units per acre or less. The first phase preliminary plat consists of 38 single family lots and 21 single family villa lots. The overall concept plan for the subject site includes additional single family and single family villa homes, as well as twin homes and row townhomes located to the south of future 85' Street. The 207.59 acre subject site includes 17.16 acres of existing wetlands and right-of-way dedication for future 851h Street as a major collector street corridor will absorb 4.97 acres of the subject site for a net developable area of 184.33 acres. The net density of development of 579 dwelling units on 184.33 acres is 3.14 dwelling units per acre. While the single family and single family villa lots shown on the preliminary plat are consistent with the 2012 Comprehensive Plan, the density of the overall concept plan exceeds the guided 3.0 dwelling units per acre residential land use. The overall layout of the development is well conceived as a transition to 85th Street and planned medium -to -high density residential uses to the west with a variety of housing types. We recommend that application for preliminary plat approval of the single family villa homes within Blocks 10, 11, 12, 13, 26, 27, the twin homes, and row townhouses include a request to amend the Comprehensive Plan to guide those areas for Low -to -Medium Density Residential Use proposed to be zoned R-6, Medium Density Residential District to allow for development of the subject site as shown on the overall concept plan. Urban Service Staging Plan. The Urban Service Staging Plan of the 2012 Comprehensive Plan establishes boundaries for sewer districts and staging of sewer (and water) utility expansion. The 2012 Comprehensive Plan includes the policy that sewer capacity is only allocated to developments with approved final plats that have paid utility availability fees for access to utility capacity. There is capacity for 498 residential dwellings available at the current W-WWTF with a planned expansion included within the City's 2019-2024 Capital Improvement Plan. The W-WWTF has adequate available capacity for the proposed preliminary plat of 59 single family dwellings. The south portion of the subject site is included within the West Sewer District to which sewer and water utilities are available at Lander Avenue and 80th Street. The gravity limits for sewer service for the overall concept plan may be extended approximately to future 85th Street. The north portion of the subject site is within Urban Service Expansion Area W1. Sewer service to this area is planned to be extended west from a future lift station at Mason Avenue and 87th Street. Development north of future 85th Street would either be dependent upon construction of the planned lift station and extension of trunk sewer from Mason Avenue and 87th Street as private development occurs or for the City to allow construction of an interim lift station and forcemain to serve the area outside of the gravity sewer limits of the current West Sewer District. 3 Development of the north portion of the subject site using an interim lift station constructed at the developer's cost would require application for a Comprehensive Plan amendment to include the area within the West Sewer District. The City would only consider allowance of the interim lift station if undertaken in conjunction with the developer providing for construction of future 85th Street between Labeaux Avenue (CSAH 19) and the east line of the subject site. Construction of this section of 85th Street would include right-of-way acquisition by the developer outside of the subject site as necessary to provide adequate access to the overall concept plan for development of the subject site as discussed in subsequent paragraphs. Zoning. The subject site is currently zoned A-1, Agriculture Rural Service District. The developer is proposing to rezone the first phase preliminary plat to R-5, Single and Two Family Residential District to allow for the proposed 59 single family and single family villa lots. The proposed Zoning Map amendment rezoning the subject site to R-5 District is consistent with the low density residential land use designation of the 2012 Comprehensive Plan. The preliminary plat application also includes a request for a Planned Unit Development — Conditional Use Permit (PUD -CUP) related to development standards for the proposed single family villa lots and dwellings. Consideration of the Zoning Map amendment and PUD -CUP is to be based upon, but not limited to, the criteria established by Section 11-3-2.F and Section 11-4-2.F of the Zoning Ordinance, respectively: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. 2. The proposed use's compatibility with present and future land uses of the area. 3. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Portions of the overall concept plan that include two-family and row townhouse uses will require consideration of a Zoning Map amendment to rezone to R-6, Medium Density Residential District concurrent with preliminary plat applications for those future phases of development. As the Zoning Map action will apply only to the preliminary plat of 59 lots, no entitlement exists for development of the uses shown for the future phases of the overall concept plan. 11 Access. The subject site is accessed via 801h Street, which is a one -mile long straight roadway between Labeaux Avenue (CSAH 19) and MacIver Avenue. There are 3 rural residential dwellings and 1 farmstead west of Lander Avenue and 11 rural residential dwellings and 1 farmstead east of Lander Avenue accessing 80th Street. Prairieview Elementary and Middle School is located at the northeast quadrant of MacIver Avenue and 80th Street. The Pavement Condition Index (PCI) rating for 80th Street is 61-70, with 70 being the threshold at which an overlay is planned and reconstruction is planned when the PCI rating is under 50. The Transportation Plan designates 80th Street as a minor collector street with current capacity for up to 1,500 vehicles per day due to the lack of 6 foot shoulders, which provides direct lot access as well as moves traffic between neighborhoods and higher capacity roadways. The City Engineer has determined based on the traffic study completed as part of the EAW that 166 dwellings can be developed within the subject site using the existing access via 80th Street based on current traffic volumes. The developer will be required to overlay 80th Street between Labeaux Avenue (CSAH 19) and Lander Avenue and from Street 8 to MacIver Avenue as a condition of approval for the any preliminary plat after this initial 59 lots to accommodate the traffic being generated within the subject site. The developer will also be required to improve the remaining sections of 80th Street within or abutting the subject site to an urban section design with concrete curb and gutter. The Transportation Plan identifies 85th Street as an east -west residential collector street through the central area of Otsego. The section of 85th Street between Labeaux Avenue (CSAH 19) and MacIver Avenue bisects the subject site. Final plat approval for more than 166 dwellings (including phase 1) will require the developer to acquire right-of-way and construct 85th Street as a residential collector street from Labeaux Avenue (CSAH 19) to the east line of the subject site at their cost to accommodate full development of the overall concept plan. Direct lot access to 85th Street is prohibited by Section 10-8-4.M of the Subdivision Ordinance and street intersections with 85th Street as shown on the overall concept plan must be spaced a minimum of 500 feet apart as required by Section 10-8-5.B.4.c of the Subdivision Ordinance. Intersection spacing requirements established by the Wright County Long Range Transportation Plan specify minimum one-half mile distances between intersections to Labeaux Avenue (CSAH 19). The City Transportation Plan anticipates maintaining full intersections to Labeaux Avenue (CSAH 19) at 77th Street and future 85th Street with 80th Street becoming limited to right- in/right-out only. In order to minimize through traffic using 80th Street, the City intends to vacate that portion of the roadway between Lander Avenue and Street 1. Through traffic would need to follow a route using Lander Avenue/Street 3/Street 4/Street 8 when the second phase of the overall concept plan is developed, as shown below. 5 L-I_LL1J- 111-11�I-1``-r�; 1 I I I r*1AAIi A �- - -I L - _J L_ rT7-r1—FT ., 1000' FEEDLOT SEr ALK The developer will be required to construct a driveway for the existing house at 11511 80th Street to the Lander Avenue/80th Street intersection. The City would retain a drainage and utility easement and outlot in place of the right-of-way and City staff recommends that a trail be provided between Lander Avenue and Street 1. Lots 13 and 14, Block 2 and Lot 1, Block 4 will be required to be platted as outlots until the Lander Avenue/Street 3/Street 4/Street 8 connection is constructed and the section of 80th Street between Lander Avenue and Street 1 is removed. Streets. The overall concept plan identifies the street layout for development of the subject site logically related to the topography and wetlands so as to result in usable lots and reasonable grades and to discourage through traffic. Connections to properties to the west, north, and east are provided at several points on the overall concept plan at the boundaries of the subject site as required by Section 10-8-5.A.7 of the Subdivision Ordinance. Streets within the subject site are planned to be public designed with 60 foot rights-of-way as required by Section 10-8-5.B.1 of the Subdivision Ordinance. Notably, the overall concept plan does not include any cul-de-sac streets. There is to be a 5 foot wide concrete sidewalk on 1 side of the City streets as required by Section 10-5-8.D. The sidewalk on Lander Avenue is to be shifted to the east side of the roadway to connect with the recommended trail to be provided within vacated right-of-way for 80th Street with a street crossing at the northwest and northeast corners of the Lander Avenue/80th Street intersection to provide connection to the existing sidewalk on the west side of Lander Avenue south of 80th Street. The sidewalk along Street 8 is to be shifted to the east side of the street so as to minimize street crossings. R All street and sidewalk design and construction plans are subject to review and approval of the City Engineer. Blocks. Section 10-8-3.A of the Subdivision Ordinance establishes that blocks within a subdivision are to be a minimum of 300 feet and not more than 1,200 feet in length. The blocks within the preliminary plat and overall concept plan comply with these requirements except where dictated by wetlands. Lot Requirements. Section 11-66-6.A of the Zoning Ordinance requires single family lots within the R-5 District to be a minimum of 9,000 square feet in area and 60 feet in width. The developer is requesting approval of a PUD -CUP with the preliminary plat for the first phase of 59 lots to allow for 65 foot wide single family lots ranging in area from 8,765 square feet to 13,296 square feet and 55 foot wide single family villa lots that ranging in area from 7,150 square feet to 10,096 square feet. The mean area of the single family lots is 9,780 square feet and the mean area of the single family villa lots is 7,620 square feet. The mean area for all of the proposed single family and single family villa lots lots is 9,010 square feet, which exceeds the minimum R-5 District lot area requirement. The City has allowed averaging of minimum lot area requirements for subdivisions including single family and single family villa homes by PUD -CUP in order to provide a greater range of housing choices within each neighborhood consistent with the housing policies of the 2012 Comprehensive Plan. The proposed 55 foot width of the single family villa lots has also been allowed for these dwelling types in other subdivisions by PUD -CUP for the same reason. Setbacks. The table below specifies the principal building setback requirements of the R-5 District provide for in Section 11-66-6.0 of the Zoning Ordinance, the wetland setback established by Section 11-16-5.F.4.b of the Zoning Ordinance, and the reciprocal feedlot setback established by Section 11-27-9 of the Zoning Ordinance: 85th Street Local interior Interior Wetland Registered (Collector) Street Side Rear Feedlot 65ft. 25ft. house 7ft. 20ft. 40ft. 1,OOOft. 30ft. garage The setbacks shown on the preliminary plat and listed on Sheet 13 of the preliminary plans submitted comply with the setback requirements above. The 40 foot building setback from the delineated wetland boundaries must be shown on the preliminary plat. 7 The 1,000 foot setback required from the registered feedlot building is also shown on the preliminary plat. This setback applies only to principal buildings within the residential lots. The survey for each of the lots within the restricted area will be required to identify the setback and we recommend a notice be filed with the deed for each lot specifically identify the setback provision to future owners. The setback requirement is reciprocal in that upon approval of a final plat, the registered feedlot cannot be expanded in a direction that would reduce the 1,000 foot setback. FWLT SE1BAM 4-- — _ --- -- —__ — --- - Grading. The developer has submitted plans for grading of the subject site. Wetlands to be preserved are required by Section 11-16-5.F of the Zoning Ordinance to be protected by a 20 foot buffer with the wetland and wetland buffer platted within an outlot deeded to the City. The wetland buffer within Outlot B is encroached on by Lot 4, Block 3. The City Engineer must determine if the depth of the proposed buffer in this area is sufficient and that the total required buffer area is maintained through averaging. All grading, drainage, wetland impacts, and erosion control issues are subject to review and approval of the City Engineer. The subject site is within the Otsego Creek watershed and payment of a stormwater impact fee as established by Section 8-4-1 of the City Code is required at the time of final plat approval in accordance with the fee schedule in effect. Utilities. The developer has submitted plans for extension of sanitary sewer and water utilities for the first phase of 59 lots. All utility plans are subject to review and approval of the City Engineer. Payment of utility availability charges are due at the time of final plat approval and payment of utility connection charges are due at the time a building permit is issued for each lot in accordance with Title 6, Section 1 of the City Code. Park Dedication. The Parks System Master Plan does not identify acquisition of park land from the subject site. The proposed development is within the park service areas of Beaudry Meadows Park to the south and Prairieview Elementary School (and future middle school) to the east. Park dedication requirements for the subject site will be satisfied as payment of a cash fee in lieu of land for use by the City in acquiring land and/or developing the park system as provided for by Section 11-18-15 of the Subdivision Ordinance. The Parks Master Plan identifies that an existing 20 acre stand of trees at the northwest corner of the subject site should be acquired by the City in the future to be preserved. Acquisition of this parcel would also likely include future acquisition of land for active park land to the east of the tree stand that would also serve the proposed development of the overall concept plan for the subject site. The City will acquire Outlot R shown on the overall concept plan for the subject site for stormwater management purposes, which abuts the south side of the parcel with the tree stand to be preserved. To facilitate future park land acquisition to the north of the subject site, Street 19 shown on the overall concept plan should be straightened to intersect the north line of the subject site at an angle more easterly of its current location or terminated as a permanent cul-de-sac. A trail corridor must also be identified between future 85th Street and Outlot R for access to a future park. Outlots. The overall concept plan includes 19 outlots with a total area of 57.5 acres, of which 50.97 acres will be preserved as HOA open space, wetlands, wetland buffers, and stormwater basins. Outlot A within the preliminary plat is intended as private open space. Outlots must be final platted for any basins constructed for stormwater management for the first phase of development as required by Section 11-18-12.D of the Subdivision Ordinance. The balance of the subject site not developed with the first phase final plat is to be platted as an outlot excluding the required dedication of right-of-way for future 85th Street. Outlot Purpose Ownership A,H-K, M Private open space, buffer yard HOA B- G, L, N, O -S Wetland, wetland buffer, stormwater basin Deed to City Easements. Section 10-18-12.A of the Subdivision Ordinance requires 10 foot drainage and utility easements at the perimeter of all lots (overlying side lot lines) and over any stormwater management facilities, wetlands, and wetland buffers not platted within outlots deeded to the City. The preliminary plat provides for dedication of required easements, which are to be subject to review and approval of the City Engineer. Single Family Villa Lots. Lennar has provided representative plans for the slab on grade single family homes to be constructed on the 55 foot wide single family villa lots (Lots 1-8, Block 1 and Lots 1-13, Block 2). The garages for the proposed homes to be constructed on the single family villa lots range in area from 442 square feet to 473 square feet, which is adequate for parking 2 vehicles, but less than the 480 square feet required for traditional single family homes. Homeowners of these lots will be responsible for individual yard and structure maintenance. E The 55 foot wide villa lots are planned to comprise 16 percent of the 579 dwellings shown on the overall concept plan. There are an additional 88 single family villa lots shown on the overall concept plan (15 percent) that are 65 feet wide that will accommodate a 3 stall garage with an area ranging from 646 square feet to 678 square feet. The City has allowed single family villa homes to be exempt from the 480 square foot minimum garage area for single family villa type homes in other subdivisions by PUD -CUP to expand housing options. Landscaping. Section 11-19-2.B.2 of the Zoning Ordinance requires that 2 shade trees be provided per lot at the time of house construction. Section 11-19-3.13 of the Zoning Ordinance further requires establishment of a residential buffer yard for those lots abutting future 85th Street. Landscape plans for the required residential buffer yard will be required to be submitted at the time of preliminary plat application for those areas of the overall concept plan abutting future 85th Street. RECOMMENDATION The proposed preliminary plat of 59 single family lots is consistent with the provisions of the 2012 Comprehensive Plan and complies with the requirements of the Zoning Ordinance and Subdivision Ordinance. The overall concept plan submitted for the subject site provides the ability to master plan future phases of development related to land use, utility capacity, and transportation infrastructure consistent with the growth management policies of the 2012 Comprehensive Plan to be implemented through future applications for zoning and subdivision approvals. City staff recommends approval of applications for Hunter Hills as outlined below. POSSIBLE ACTIONS Decision 1— Environmental Assessment Worksheet A. Motion to recommend that approval of a negative declaration on the need to prepare an EIS for the Hunter Hills preliminary plat and overall concept plan. B. Motion to recommend that an EIS be prepared for the Hunter Hills preliminary plat and overall concept plan. C. Motion to table. Decision 2 — Zoning Map Amendment A. Motion to recommend approval of a Zoning Map amendment rezoning the subject site to R-5 District based on a finding that the criteria established by Section 11-3-2.F of the Zoning Ordinance are satisfied. 10 B. Motion to recommend the application be denied based on a finding that the request is inconsistent with the Comprehensive Plan and intent of the Zoning Ordinance. Decision 3 — PUD-CUP/Preliminary Plat A. Motion to recommend approval of a PUD -CUP and Preliminary Plat for Hunter Hills and vacation of existing public right-of-way, subject to the following conditions: Approval of the preliminary plat shall not guarantee access to sanitary sewer service. The City shall only allocate sanitary sewer capacity to approved final plats with signed development contracts to assure the City of timely development. 2. Approval of a preliminary plat for the subject site subsequent to the initial 59 lots shall require that the developer to improve 80th Street with an overlay between Labeaux Avenue (CSAH 19) and the west plat line and from the east plat line to MacIver Avenue, subject to review and approval of the City Engineer. 3. Final platting of more than 166 dwelling units within the subject site shall require the developer to acquire right-of-way and construct 85th Street as a major collector street from Labeaux Avenue (CSAH 19) to the east line of the subject site, subject to review and approval of the City Engineer. 4. Inclusion of those areas of the subject site outside of the gravity sewer limits of the West Waste Water Treatment Facility shall require approval of a Comprehensive Plan amendment to expand the boundaries of the West Sewer District, which may be made by the City Council subject to conditions it determines to be necessary for consistency with the policies of the 2012 Comprehensive Plan. Vacation of 80th Street: Right-of-way for 80th Street shall be not be vacated until such time as the construction of Lander Avenue to Street 3 to Street 4 to Street 8 between 80th Street is completed. Lots 13 and 14, Block 1 and Lot 1, Block 4 shall be platted as outlots until such time as 80th Street is vacated between Lander Avenue and Street 1. C. The vacation of 80th Street between Lander Avenue and Street 1 shall retain drainage and utility easement over the south one -have of the right- of-way. 11 d. The developer shall be required to construct a private driveway accessing 11511 80th Street between the terminus of the existing driveway and the Lander Avenue/80th Street intersection. e. The north one-half of the existing right-of-way shall be platted as an outlot and deeded to the City within which the developer shall be required to construct a 10 foot wide bituminous trail from Lander Avenue to Street 1, subject to review and approval of the City Engineer. f. The portions of 80th Street not to be vacated abutting the subject site shall be improved to an urban section by the developer as a condition of final plat approval, subject to review and approval of the City Engineer: (1) 80th Street from the west plat line to Lander Avenue shall be designed as a minor collector street. (2) 80th Street from Street 8 to the east plat line shall be designed as a local street. 6. All street and sidewalk design and construction plans are subject to review and approval of the City Engineer, including revising the preliminary street plan to: Shift the sidewalk on Lander Avenue to Block 2. Provide pedestrian crossings at the northwest and northeast corners of the Lander Avenue and 80th Street intersection. C. Shift the sidewalk on Street 8 to Block 6 and Block 7. 7. All lots within the preliminary plat shall comply with the following setbacks: Local Interior Interior Wetland Street Side Rear 25ft. house 7ft. 20ft. 40ft. 30ft. garage 8. Feedlot setback: Principal buildings constructed on lots within Block 6 and Block 7 shall be subject to the setback required from a registered feedlot by Section 11-27- 9 of the Zoning Ordinance. b. The feedlot setback shall remain in effect so long as the feedlot is maintained in accordance with Section 11-27-2 of the Zoning Ordinance. 12 C. Notice of the registered feedlot location and setback requirement shall be recorded with the deeds to all lots within Block 6 and Block 7. 9. All grading, drainage, wetland impacts, and erosion control issues shall be subject to review and approval of the City Engineer. 10. A stormwater impact fee for Otsego Creek as established by Section 8-4-1 of the City Code shall be paid the time of final plat approval in accordance with the fee schedule then in effect. 11. All utility plans shall be subject to review and approval of the City Engineer. 12. Utility availability charges shall be paid at the time of final plat approval in accordance with the fee schedule then in effect. 13. Park dedication requirements for the preliminary plat will be satisfied as payment of a cash fee in lieu of land as provided for by Section 11-18-15.1 of the Subdivision Ordinance. 14. The overall concept plan shall be revised subject to review and approval of City staff to: Revise Street 19 to intersect the north line of the subject site at an angle more easterly of its current location or terminate in a cul-de-sac. Provide a trail corridor between future 85th Street and Outlot R. Provide a residential buffer yard landscape plan as required by Section 11-19-3.B of the Zoning Ordinance. 15. A homeowners association shall be established at the time of final plat approval for ownership and maintenance of Outlots A, H, I, J, K, and M, as shown on the preliminary plat and overall concept plan, subject to review and approval of City staff. 16. Outlots B, C, D, E, F, G, L, N, O, P, Q, R, and S as shown on the overall concept plan shall be deeded to the City for stormwater management purposes. 17. However, the street is not constructed to State Aid Standards which would accommodate 2500 ADT (average daily traffic) but is currently constructed to a standard capable of handling up to 1500 ADT west of Lander Ave. East of Lander the street capacity is equivalent to a local residential street which is 1000 ADT. Using current PM peak volumes, a current ADT of 470 is being seen on 80th west of Lander Avenue. This street will hit the threshold of 1500 ADT with 103 additional lots. Again, using existing PM peak volume to negate the school AM peak influence that will drop if 80th St is rerouted, the number of lots allowed would be an additional 63 for a total of 166 to meet the City's self-imposed threshold for both portions of 80th St. Any lots beyond 166 lots will require 85th St be constructed and connected to CSAH 19.
