AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends that a cost sharing request for trunk watermain lowering along CSAH 42 near the entrance to the Riverbend North development be denied. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: At the June 8, 2020 City Council meeting, City staff reviewed with the City Council a request from the developer of Riverbend North to share the costs associated with lowering the trunk watermain along CSAH 42 near the entrance to the respective development. The City Council requested additional information regarding the request, and tabled the matter to a future meeting. After further review, City staff summarizes: - The developer was previously paid $17,000 for an easement for the watermain. - The watermain requiring lowering is located within said easement. - The City has not had any issues with the watermain freezing since it was constructed in 2006. - Riverbend North is required as a condition of their project approvals to 1) construct a turn lane; and 2) construct a pedestrian trail. - The City Attorney has reviewed the Development Agreement, which states that the Developer shall install and pay for all required improvements. It is those improvement requiring the watermain to be lowered, and under the terms of the Agreement, the city is not legally obligated to approve the Change Request submitted by the Developer. Based on the information above, City staff recommends that the City not participate in the cost sharing.
