No Yes — Being Held 23 July 2020 BACKGROUND/JUSTIFICATION: Capstone Homes received preliminary plat approval for Harvest Run East, located east of Queens Avenue and south of 651h Street abutting Harvest Run, Riverpointe, Wokson Hills, and Autumn Woods, on 13 May 2019 and final plat approval on 11 May 2020. The developer is proposing to revise 3 lots within the final plat to adjust lot width and building envelope. ■ Zoning. The subject site is zoned R-4 Residential Single Family District. Single family lots are a permitted use within the R-4 District. ■ Preliminary Plat Consistency. The final plat consists of 3 single family lots accessed by public streets in a configuration consistent with the preliminary plat. ■ Lot Requirements. The proposed lots within the final plat comply with the minimum lot area and width requirements of the R-4 District. There is a reasonable area within the lot to construct a single family dwelling that complies with the setback requirements of the R-4 District. ■ Streets. The proposed lots will be accessed by local public streets that are to be 28 feet wide with concrete curb and gutter within a 60 foot wide right-of-way that will be constructed as part of the Harvest Run East final plat approval. Landscaping. The developer submitted a landscape plan for the preliminary plat that has been approved as compliant with Sections 11-19-2.13 and C of the Zoning Ordinance. The developer will install the landscaping as shown on the approved plan within the final plat as construction of houses on each lot progresses. The security for the landscaping will be collected at the time of building permit for each lot. ■ Easements. The final plat illustrates drainage and utility easements at the perimeter of each single family lot and overlaying stormwater facilities as required by Section 10-8-12.A of the Subdivision Ordinance. Existing drainage and utility easements within the subject site dedicated with the Harvest Run East final plat no longer serve a public purpose and will be vacated. All drainage and utility easements are subject to approval of the City Engineer. ■ Grading and Drainage Plans. The developer has submitted grading and drainage plans for Harvest Run East, including the subject site, that will not be affected by the proposed final plat. ■ Utilities. The developer has submitted utility plans for the Harvest Run East final plat that are not affected by the proposed final plat. The developer has paid Utility Availability Charges for the proposed 3 lots at the time of final plat approval for Harvest Run East. Utility connection charges are to be paid when a building permit is issued for each lot in accordance with the fee schedule in effect at that time. ■ Park and Trail Dedication. Park dedication requirements for the proposed final plat were satisfied as a cash fee in lieu of land paid with the final plat of Harvest Run East. Development Agreement. There are no public improvements to be installed as part of the proposed final plat that are not addressed by the prior Harvest Run East final plat and development agreement. No additional development agreement is required for the proposed final plat. ■ Recording. Section 10-5-3-B.8 of the Subdivision Ordinance requires recording of the final plat within 100 days of City Council approval. CITY COUNCIL MEETING: 23 July 2020 FINDINGS: Based upon review of the application and evidence received, the City Council of the City of Otsego now makes the following findings of fact: A. The legal description of the property is Lots 4-6, Block 5, Harvest Run East, City of Otsego Wright County, State of Minnesota. B. The property lies within the East Sewer Service District and is guided for low density residential land uses by the 2012 Otsego Comprehensive Plan, as amended. C. The property is zoned R-4, Residential Single Family District and R-5, Residential Single and Two Family District, which allows single family dwellings as a permitted use. D. The City Council approved an application for preliminary plat approval and a PUD-CUP on 13 May 2019. E. The City Council approved application for final plat approval on 28 October 2019 and an application for an amended final plat on 11 May 2020. F. The applicant is proposing a second revision to final plat 32 lots and 9 outlots. G. The Request for Council Action dated 23 July 2020 prepared by the City Planner, The Planning Company LLC, is incorporated herein. H. Final plat applications are processed in accordance with Section 10-3-3 of the Subdivision Ordinance and do not require a recommendation by the Planning Commission. DECISION: Based on the foregoing information and applicable ordinances, the application is hereby APPROVED subject to the following conditions: All of the lots within the Harvest Run East 2nd Addition Final Plat shall comply with the following minimum setbacks: Lot Area Lot Width Lot Depth Setbacks Front Side Rear Lots 1-3, Block 1 12,000sf. 75ft. 100ft. 35ft. 10ft. 20ft. 2. All easements are subject to review and approval of the City Engineer. 3. The final plat shall be recorded by 31 October 2020 as provided for Section 10-5-3. B.8 of the Subdivision Ordinance. Stockamp, Mayor 2 CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2020-46 VACATIING EXISTING DRAINAGE AND UTILITY EASEMENTS WITHIN THE PLAT OF HARVEST RUN EAST WHEREAS, the City Council approved the final plat of Harvest Run East on 11 May 2020; and, WHEREAS, the approved plat includes dedication of drainage and utility easements as required by the Subdivision Ordinance; and, WHEREAS, Capstone Harvest Run LLC has submitted a final plat for Harvest Run East 2nd Addition to replat Lots 4-6, Block 5 Harvest Run East; and WHEREAS, the dedication of drainage and utility easements with the proposed final plat supersede and make unnecessary the existing drainage and easements; and, WHEREAS, Capstone Harvest Run LLC has initiated vacation of the existing drainage and utility easements; and, WHEREAS, the City Council held a public hearing at their regular meeting on 27 July 2020 to consider the vacation, preceded by required published and mailed legal notice; and, WHEREAS, the City Council heard all parties interested therein and closed the public hearing; and, WHEREAS, all existing drainage and utility easements as dedicated Lots 4-6, Block 5 Harvest Run East, Wright County, Minnesota as shown on Exhibit A serve no useful public purpose; and, WHEREAS, the City Council having considered all information received related to the proposed vacation finds that vacating the existing drainage and utility easements would be in the public interest; and, 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA THAT: 1. That all drainage and utility easements as dedicated over Lots 4-6, Block 5, Harvest Run East, Wright County, Minnesota are hereby vacated. 2. The City Council hereby determines that the vacation of said drainage and utility easement shall cause no damage to any abutting or nearby property owners and therefore no damages are awarded to any such property owners.
