RESOLUTION NO: 2020-53
VACATIING EXISTING DRAINAGE AND UTILITY EASEMENT
WITHIN THE PLAT OF COUNTRY RIDGE
WHEREAS, the City Council approved the final plat of County Ridge on 17 June 1992; and,
WHEREAS, the approved plat includes dedication of drainage and utility easements as required by the
Subdivision Ordinance; and,
WHEREAS, Robert Theisen, as the property owner, has initiated vacation of a portion of the existing
drainage and utility easements within Lot 7, Block 7 Country Ridge, as described by Exhibit A; and,
WHEREAS, the City Council held a public hearing at their regular meeting on 24 August 2020 to consider
the vacation, preceded by required published and mailed legal notice; and,
WHEREAS, the City Council heard all parties interested therein and closed the public hearing; and,
WHEREAS, those drainage and utility easements proposed to be vacated as shown on Exhibit A serve no
useful public purpose; and,
WHEREAS, the City Council having considered all information received related to the proposed vacation
finds that vacating the existing drainage and utility easements would be in the public interest; and,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA THAT:
1. That the drainage and utility easement as dedicated described by Exhibit A is hereby vacated.
2. The City Council hereby determines that the vacation of said drainage and utility easement shall
cause no damage to any abutting or nearby property owners and therefore no damages are
awarded to any such property owners.
ADOPTED by the Otsego City Council this 24th day of August, 2020.

5,00 feet of sold Lot 7, and lying northerly of the following described line:
Commencingat the Southeast corner of sold Lot 7; thence North 00 degrees 23 minutes 29 seconds West, assumed bearing, along
the easterly line of sold Lot 7, a distance of 60,00 feet to the point of beginning of said line to be described; thence North 85
degrees 00 minutes 00 seconds West, 263,89 feet to the West ]]no of said Lot 7 and said line there terminating.
