No Held by Planning Commission 15 June 2020 BACKGROUND/J USTI FICATION: Cummings Property Management II, LLC owns Outlots A and B, Otsego Industrial Park 5th Addition. The developer is proposing to acquire adjacent property and replat the entire area as 2 lots. The subdivision action by the developer requires consideration of a Zoning Map amendment, preliminary/final plat, and vacation of existing public right-of-way. GCC of America (GCC Dacotah, Inc.) has concurrently submitted plans for development of Lot 1, Block 1 Otsego Industrial Park Sixth Addition as a cement storage and transfer facility. The property is located north of 65th Street (CSAH 37) west of Jansen Avenue, south of 1-94. The applications required for development of the subject site include site and building plan review and a conditional use permit for the height of proposed silos greater than 48 feet. Public hearings to consider the applications were held by the Planning Commission on 15 June 2020. Representatives of GCC attended the Planning Commission meeting via teleconference and agreed with the staff report. A resident south of CSAH 37 had questions regarding traffic generation and screening. City staff addressed the capacity of CSAH 37 as a major collector roadway. City staff also stated that the rail car storage area will be screened by trees as a condition of approval pending finalization of the wetland impact plan. The public hearing was closed. The Planning Commission discussed the height of the proposed silos with City staff noting that they will be shorter than Water Tower #2 on the north side of 1-94. The Planning Commission voted 7-0 to recommend approval of the applications. City staff has drafted findings of fact and decision consistent with the Planning Commission recommendation. The zoning and subdivision approvals are to be subject to execution of agreements drafted by the City Attorney that to be approved by the City Council at a future meeting. The developer is working with Burlington Northern Santa Fe (BNSF), Wright County, and MN/DoT regarding possible improvements for the railroad crossings at CSAH 19, CSAH 37, and Main Street within Albertville. The use of the subject site is permitted under the Zoning Ordinance and the City does not have the ability to impose conditions on the use of the property related to the railroad issues. Wright County is addressing these issues based on their jurisdiction for approval of the separate Otsego Industrial Park Sixth Addition plat. Wright County will require the GCC of America and Cummings Property Management II LLC to execute a separate development agreement addressing the required railroad crossing improvements. The proposed use at startup will generate 4 movements across CSAH 19 and CSAH 37 for each delivery/pick up with no rail traffic anticipated over winter months. Once the siding is constructed at the GCC site, the trains will cross CSAH 19 and CSAH 37 only 2 times per delivery/pick up. MN/DoT has evaluated the crossings at CSAH 19 and CSAH 37 and determined that flashing lights and gates must be installed based on the increased rail traffic proposed by BNSF, the high volume of vehicle traffic, and the lack of appropriate sight lines at both crossings. On CSAH 19, the crossing lights/gates will be synchronized with the traffic signals to the north of the crossings. GCC of America, Cummings Property Management II LLC, and/or BNSF's will be responsible for the cost of the rail crossing improvements. BNSF is working to change the current rail service times for this rail line from between 1:OOAM and 4:OOAM to 10:OOPM and 11:00PM to minimize noise impacts in Albertville and Otsego. Albertville has initiated establishment of Quiet Zone Crossing Zones for the 2 City street crossings in Albertville and will request the same for the CSAH 19 and CSAH 37 crossings. City staff has initiated discussions with Albertville staff regarding participating with them on the Quiet Zone Study as well as trail costs Albertville would incur at CSAH 19 and CSAH 37 due to the installation of rail crossing signals. Outlots A and B, Otsego Industrial Park 5" Addition are zoned 1-2, General Industrial District. The abutting parcel to be included within the proposed preliminary/final plat is zoned A-1, Agriculture Rural Service District. A Zoning Map amendment rezoning proposed Lot 1, Block 1 to 1-2 District is requested and is to be evaluated based upon the criteria established by Section 11-3-2.F of the Zoning Ordinance: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Comment: The subject site is guided by the 2012 Comprehensive Plan for commercial uses within the West Sewer District. The commercial designation is based upon anticipation of construction of an interchange at 1-94 and KadlerAvenue. MNDOT, Wright County, and the City have no timeline for when this interchange may be constructed. That portion of Lot 1, Block 1 platted as Outlots A and B, Otsego Industrial Park 5th Addition are zoned 1-2 District. Rezoning the balance of proposed Lot 1, Block 1 for development of an industrial use under the provisions of the 1-2 District is consistent with the policies of the Comprehensive Plan. 2. The proposed use's compatibility with present and future land uses of the area. Comment: The table below summarizes the existing and planned land uses in the area. The proposed industrial use of the subject site will be compatible with existing rural uses in the area and planned future industrial and low density residential uses. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Comment: The proposed preliminary/final plat complies with the requirements of the Subdivision Ordinance, Zoning Ordinance, and Engineering Manual. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Comment: The subject site abuts 65th Street (CSAH 37) and is accessed via Jansen Avenue. CSAH 37 is designated as a major collector road by the Wright County Long 100 Range Transportation Plan and has adequate design capacity to accommodate traffic generated by an industrial use of Lot 1, Block 1. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Comment: The subject site is planned for industrial uses and will utilize on -site utilities to minimize demand for City services consistent with the 2012 Comprehensive Plan and Capital Improvement Plan. Access. The subject site abuts 65th Street (CSAH 37), which is designated by the Wright County Transportation Plan as a major collector roadway. Wright County has reviewed the preliminary and final plat and stated that direct lot access to CSAH 37 will not be allowed from Lot 1, Block 1. The preliminary and final plat must also provide a minimum of 50 feet of right-of-way for the north one-half of CSAH 37. Lot 1, Block 1 also has access to Jansen Avenue at the northeast plat line. Right-of-way to extend Jansen Avenue was dedicated with the Otsego Industrial Park 5th Addition. The developer is proposing to vacate the Jansen Avenue right-of-way within the subject site so as to allow for construction of a rail spur along the west line of Lot 1, Block 1 from the Burlington Northern Rail that runs along the north line of the plat parallel to 1-94. The developer has acquired permanent easements for the existing cul-de-sac turnaround at its current location, subject to review and approval of the City Engineer. The developer has provided a sketch plan for Outlot A showing development of the site with 2 industrial users accessing directly from CSAH 37 via a shared driveway. The access to Outlot A must be shifted west to be 1,320 feet from the centerline of Jansen Avenue per Wright County spacing guidelines. Direct private driveway access to CSAH 37 for a future industrial use is subject to review and approval of Wright County or the developer would be required to construct a public street accessing development of Outlot A, which would be required to be extended to the west line of Outlot A. Lot Requirements. Lots within the 1-2 District are required to be a minimum of 2.0 acres in area and have 200 feet of frontage to a public street in accordance with Section 11-86-7 of the Zoning Ordinance. Proposed Lot 1, Block 1 is 18.48 acres in area and has 320.85 feet wide measured at 65th Street (CSAH 37), which complies with the requirements of the 1-2 District. Setbacks. The site plan submitted with the separate development application for Lot 1, Block 1 complies with these setback requirements of the 1-2 District: 1-94/CSAH 37 Side Wetland 30ft. 20ft. 40ft. 3 Utilities. The subject site is within the West Sewer District. Sewer utilities are not available to the area south of 1-94. Interim use of on -site septic and well utilizes for Lot 1, Block 1 is acceptable in accordance with Section 8-1-3 of the City Code. Grading. A grading plan has been submitted with the separate development application for Lot 1, Block 1. The developer has submitted a Wetland Impact Plan to fill existing wetlands within Lot 1, Block 1 to allow for the proposed site plan. The Wetland Impact Plan has been preliminarily approved by the Technical Evaluation Panel but is subject to a 30 day comment period ending 9 July 2020. Remaining wetlands within Lot 1, Block 1 are required to provide a 20 foot buffer as required by Section 11-16-5.F.4 of the Zoning Ordinance and be platted in outlots deeded to the City as required by Section 10-8-12.D of the Subdivision Ordinance. All grading, drainage, wetland impacts, and erosion control issues for the subject site are subject to review and approval of the City Engineer. The developer is required to pay a stormwater impact fee for Otsego Creek for Lot 1, Block 1 in accordance with Section 8-4-1 of the City Code upon approval of a final plat. Easements. The preliminary/final plat illustrates drainage and utility easements at the perimeter of the subject site and over stormwater drainage facilities within the subject site. All drainage and utility easements are subject to review and approval of the City Engineer. Park Dedication. The Park System Master Plan does not identify acquisition of land for public parks within the area of the subject site. For industrial uses, no park dedication fee in lieu of land is required. Outlot A. The balance of the subject site outside of Lot 1, Block 1 is proposed as Outlot A. There is a farmstead within the Outlot A that includes a single family dwelling. Section 11-16- 3.G of the Zoning Ordinance prohibits buildings from being within outlots and prohibits issuance of any building permits. If the farmstead buildings are to remain, the preliminary/final plat must be revised to designate Outlot A as Lot 2, Block 1. The lot is to remain zoned A-1 District and is limited to those uses allowed within that District. Development Agreement. The City Attorney will draft a development agreement to provide for completion of all public improvements, establishment of required securities, and payment of applicable fees. The Development Agreement is to be adopted by resolution of the City Council concurrent with the final plat approval and executed prior to recording of the final plat. Section 10-5-3-B.8 of the Subdivision Ordinance requires recording of the final plat within 100 days of City Council approval. RECOMMENDATION City staff recommends approval of the preliminary/final plat for Otsego Industrial Park as outlined below. E POSSIBLE ACTIONS Decision 1— Zoning Map amendment A. Decision 2 — Vacation of Right-of-Way/Easements and Preliminary/Final Plat A. Motion to recommend vacation of existing right-of-way and drainage and utility easements and approval of a Preliminary/Final Plat for Otsego Industrial Park Sixth Addition, subject to the following conditions: Right-of-way dedication and access to CSAH 37 shall be subject to review by the City Engineer and approval of Wright County. 2. Lot 1, Block 1 shall be accessed from Jansen Avenue subject to approval of the City Engineer. 3. Dedication of right-of-way and construction of a permanent cul-de-sac for Jansen Avenue shall comply with the Subdivision Ordinance or the developer shall acquire permanent right-of-way easement for the cul-de-sac at its present location, subject to review and approval of the City Engineer. 4. The preliminary/final plat shall be subject to approval of the submitted Wetland Impact Plan. 5. The preliminary/final plat shall be revised to plat wetlands and required wetland buffers within Lot 1, Block 1 as outlots to be deeded to the City. 6. The developer shall pay a stormwater impact fee for Otsego Creek for the area of Lot 1, Block 1 as required by the City Code. Payment of a stormwater impact fee for Outlot A shall be deferred until such time as the lot is rezoned for a use consistent with the Future Land Use Plan. 7. All grading, drainage, and erosion control issues shall be subject to review and approval of the City Engineer. 8. All utility issues shall be subject to review and approval of the City Engineer. 9. All easements shall be subject to review and approval of the City Engineer. 10. The preliminary/final plat shall be revised to designate Outlot A as Lot 2, Block 1. 11. The developer shall enter into a development agreement as drafted by the City Attorney and approved by the City Council. 12. The final plat shall be recorded within 100 days of City Council approval as provided for Section 10-5-3.B.8 of the Subdivision Ordinance. B. The City or project developer will need to verify that all existing drainage patters and system affecting Wright County Highway right of way will be perpetuated. 5) It was brought to our attention that this proposed new development may cause an increase in rail traffic that could impact the RR Crossings on Highway 19 and Highway 37 in Albertville. These crossings currently have "Exempt" status (less than 10 trains/year) with no signals or cross -arms, etc. These crossings must undergo a diagnostic review through the MN/DOT Rail office to determine the appropriate level of warning at the crossing. Wright County will require all RR crossing mitigation improvements needed to be paid for at no cost to the County. Identification of RR Crossing improvements needed and impacts to Highways 19 and 37 will require review and approval by Wright County. A funding mechanism for all RR Crossing improvements must be identified and secured prior to Wright County approving/signing the plat. Daniel Licht, AICP 5 August 2020 23 September 2020 Otsego — Otsego Industrial Park; GCC of America 101.02 GCC of America has submitted plans for development of Lot 1, Block 1 Otsego Industrial Park Sixth Addition as a cement storage and transfer facility. The lot is to be platted by a separate application that has been submitted to the City. The property is located north of 65th Street (CSAH 37) west of Jansen Avenue, south of 1-94. The applications required for development of the subject site include site and building plan review and a conditional use permit for the height of proposed silos greater than 48 feet. A public hearing to consider the applications was held by the Planning Commission at their meeting on 15 June 2020. The subject site is guided by the 2012 Comprehensive Plan for commercial uses within the West Sewer District. The commercial designation is based upon anticipation of construction of an interchange at 1-94 and Kadler Avenue. MNDOT, Wright County, and the City have no timeline for when this interchange may be constructed. The proposed use is being located specifically to utilize access to the existing Burlington Northern - Santa Fe Rail line that is parallel to the south side of 1-94 along the north line of the subject site. The access to rail is a unique element of the project unavailable in areas of the City planned for industrial use. Expansion of industrial uses is further consistent with the City's economic development goals to add employment and expand tax base. Development of the proposed use is consistent with the 2012 Comprehensive Plan. Zoning. The proposed use involves unloading of cement materials from a rail spur off of the abutting BNSF rail line, storage within silos and a 20,000 square foot building, and transport of site by truck. Portions of the subject site are currently zoned 1-2, General Industrial District with the portion outside of the Otsego Industrial Park 5th Addition zoned A-1, Agriculture Rural Service District. The entire subject site is proposed to be zoned 1-2 District as part of the separate application for the Otsego Industrial Park Sixth Addition. Upon rezoning to 1-2 District and platting of the subject site, the proposed cement storage and transfer site would be allowed as a permitted use in accordance with Section 11-86-2.E of the Zoning Ordinance. Surrounding Uses. The table below summarizes the existing and planned land uses in the area. The proposed industrial use of the subject site will be compatible with existing industrial and rural uses in the area, as well as planned future commercial uses to the west and low density residential uses south of 65th Street (CSAH 37). The subject site abuts 65th Street (CSAH 37) and the temporary cul-de-sac terminus of Jansen Avenue with planned access to both. The Wright County Long Range Transportation Plan designates 65th Street (CSAH 37) as a major collector street. Wright County has commented as part of their review of the Otsego Industrial Park Sixth Addition final plat that direct lot access from Lot 1, Block 1 to 65th Street (CSAH 37) will not be allowed. The site plan must be revised to remove the proposed access to 65th Street (CSAH 37). Approval of the Otsego Industrial Park Sixth Addition plat will provide for acquisition of permanent easements for the Jansen Avenue cul-de-sac at its current location. N Off -Street Parking. The submitted site plan identifies 4 designated off-street parking stalls. Section 11-21-13 of the Zoning Ordinance requires warehouse uses to provide 1 off street parking stall per 200 square feet of office and 1 off-street parking stall per 1,000 square feet of warehouse area. The architectural plans detail a 2,184 square foot, 2 story office building and 20,000 square foot storage building that require the following number of off-street parking stalls: ■ Office: 2,184sf. x 10% net area reduction / 200sf. per stall = 10 stalls ■ Storage: 20,000 x 10% net area reduction / 1,000sf. per stall = 18 stalls The site plan must be revised to show proof -of -parking for 24 additional off-street parking stalls. The site plan identifies that 1 of the 4 proposed off-street parking sis to designated ADA compliance and be van accessible; 2 ADA parking stalls are required for the full 28 parking stalls to be shown on the site plan. The off-street parking stalls have dimensions of 9 feet by 18 feet with a 2 foot front over hang as required by Section 11-21-7.A of the Zoning Ordinance. The parking area and drive aisles within the subject site are proposed to be cement. A cement curb is required at the perimeter of the parking areas and drive aisle by Section 11-21-7.D of the Zoning Ordinance. Rail Spur. Integral to the proposed facility is construction of a rail spur for delivery of cement materials via the BNSF rail line that has been rehabilitated. The single rail extends south into the site to an elevator near the northwest corner of the storage building for off-loading the rail cars into the storage silos. The spur then extends south and branches off into 5 separate rails for storage of 68 rail cars and space an additional rail expansion for another 32 rail cars. Storage Silos. There are 6 storage silos to be located on the property where cement materials unloaded from rail cars is to be stored. The site plan illustrates turning movements for semi- tractor/trailers to access the silos for loading from the north, driving through below the silos and exiting between the office building and storage building. The silos are 96 feet in height and the elevator legs that distribute the materials from the rail cars to the silos are 140 feet in height at the central peak. Structures within the 1-2 District are limited to a height of 48 feet. Section 11-17-3.A of the Zoning Ordinance allows increases in height above the district limits subject to approval of a conditional use permit provided the following criteria are met: Demonstrated need is established for the increase in height, and said increase will not violate the intent and character of the zoning district in which the structure is located. Comment: The height of the proposed silos is based on the storage capacity needs of the proposed use and the height of the elevator legs is necessary for the functionality of the storage systems. 2. The site is capable of accommodating the increased structure size. Comment: The subject site complies with applicable requirements for lot area, width, setbacks and building coverage indicating the site is capable of supporting the increased height of the silos and elevator legs. 3. The potential increased intensity and size of use does not cause an increase in traffic volumes beyond the capacity of the surrounding streets. Comment: The subject site is accessed via local industrial streets and a major collector street with adequate capacity to accommodate traffic generated by the proposed use. 4. Public utilities and services are adequate. Comment: The proposed increase height for the silos and elevator legs will not effect public service capacity. 5. For each additional story over the district limitation or for each additional ten feet (10') above the maximum allowed per district, front and side yard setback requirements shall be increased by ten percent (10%). Comment: The silos will be required to be setback an additional 27 feet from 65th Street (CSAH 37) and an additional 18 feet from the east and west lot lines. The construction does not limit solar access to abutting and/or neighboring properties Comment: The increased structure height will not impede solar access for surrounding properties. Office and Storage Buildings. The proposed office building and storage building are constructed using precast concrete panels with integral color. The exterior finish materials comply with the requirements of Section 11-17-4.E.1 of the Zoning Ordinance. Both the office building and storage building have flat roofs. The height of the office building is 23 feet and the storage building is 32 feet in height, which are both within the 48 foot building height allowed within the 1-2 District. Landscaping. A landscape plan for the subject site has been submitted that illustrates installation of a berm and row of coniferous trees to be installed along the north property line. Wetland and wetland mitigation areas along the south lot line prevent installation of additional trees for screening along 65th Street (CSAH 37). The sizes and types of proposed plantings comply with Section 11-19-2.B of the Zoning Ordinance. We recommend that a double row of evergreens be added to the south and west of the rail car storage area to screen the rail cars from view of CSAH 37, existing rural residential dwellings, and future residential development to the south of the subject site. The revised landscape plan is to be subject to review and approval of the Zoning Administrator. M The areas of the subject site not taken up by buildings, parking/driveways, and wetlands is proposed to be seeded with a MNDoT specification low maintenance mix. Planting this seed mix for a more natural grasses is allowable under Section 5-2-3.F of the City Code. Establishment of the natural grasses will supersede the need for irrigation required by Section 5-2-3.C.2 of the City Code. Lot Requirements. Lots within the 1-2 District are required to be a minimum of 2.0 acres in area and have 200 feet of frontage to a public street in accordance with Section 11-86-7 of the Zoning Ordinance. Proposed Lot 1, Block 1 is 18.48 acres in area and has 320.85 feet wide measured at 651h Street (CSAH 37). The proposed lot complies with the requirements of the I- 2 District. Setbacks. Section 11-86-8 of the Zoning Ordinance establishes a 50 percent building coverage limit for lots within the 1-2 District. The area of the subject site covered by the office building, storage building, and silos is approximately 28,510 square feet or 24.8 percent of the area of the subject site. The proposed site and building plans comply with the building coverage limits of the 1-2 District. Fence. The site plan indicates that there is to be a fence at the perimeter of the subject site. Fences for industrial uses are allowed to be up to 8 feet in height by Section 11-19-4.1-1 of the Zoning Ordinance. A gate is to be installed across the driveway access from Jansen Avenue. The gates must be setback from the right-of-way sufficient distance to allow for a semi- tractor/trailer to be stopped at the gate without impeding traffic on the public street as stated by Section 11-19-4.H.3.c of the Zoning Ordinance. Installation of the fence and gates requires a fence permit prior to installation subject to review and approval of the Zoning Administrator. Exterior Lighting. A photometric lighting plan has been submitted with the proposed site and building plans. The freestanding and wall mounted fixtures both have 90 degree horizontal cut- offs. Lighting cast at all property lines is less than 0.4 foot-candles of illumination as required by Section 11-16-6.C.1 of the Zoning Ordinance. There is an adjustable floodlight fixture that 5 must be installed so as to only cast light downward with a 90 degree horizontal cut-off to comply with Section 11-16-6.C.3.a of the Zoning Ordinance. Signs. The submitted plans indicate that an 80 square foot monument sign is to be placed at the site entrance from Jansen Avenue. A GCC sign is painted onto one of the storage silos so as to be visible from 1-94. Section 11-37-6.F of the Zoning Ordinance allows a 200 square foot wall sign, 200 square foot free standing sign up to 50 feet in height. Section 11-37-5.C.6.a of the Zoning Ordinance would allow a second free standing sign up to 64 square feet in area and 15 feet in height to be located at the site entrances. A sign permit subject to review and approval of the Zoning Administrator is required prior to installation of any signs upon the property. Waste Storage. The site plan does not identify storage for waste other than a receptacle within the electrical room of the office building. Any outdoor storage of trash or recycling containers will require construction of an enclosure meeting the requirements of Section 11-18-4.0 of the Zoning Ordinance. Grading. The developer has submitted plans for grading of the subject site. The proposed rail spur includes tracks for rail car storage that requires filling of wetlands in the southern portion of the subject site. A separate wetland impact plan application has been submitted and is being reviewed by the Technical Evaluation Panel. The plat application includes a condition that wetlands and wetland buffers be platted as outlots deeded to the City. The change to the plat will require revision of the site plan as well. All grading, drainage, erosion control, and wetland impacts are subject to review and approval of the City Engineer. Utilities. There are not municipal sewer and water utilities available to the subject site. Until municipal utilities are available, use of an on -site septic system and well are to be used for services. The septic system is required to provide a primary and secondary drainfield site. Plans for the septic system and well will be subject to review and approval of the Building Official at the time of application for a building permit. RECOMMENDATION The proposed GCC of America site and building plans are a unique opportunity to utilize available access to rail for an industrial business that will add employment and expand tax base. The proposed development complies with the requirements of the Zoning Ordinance including the conditional use permit for the proposed height of the storage silos. City staff recommends approval of the requested applications as outlined below. POSSIBLE ACTIONS A. Motion to recommend approval of site and building plans and a conditional use permit, subject to the following conditions: The site and buildings shall be developed in accordance with the plans on file with the City except as modified herein or approved by City staff. 2. No direct lot access to 65th Street (CSAH 37) shall be allowed as determined by Wright County. The site plan shall be revised to identify 28 off-street parking stalls. 4. The landscape plan shall be revised to provide for a double row of evergreen trees along the south and southwest edge of the rail car storage area, subject to review and approval of the Zoning Administrator. 5. Fences shall comply with Section 11-19-4.1-1 of the Zoning Ordinance and shall require a fence permit prior to construction, subject to approval of the Zoning Administrator. 6. All exterior light fixtures shall be installed so as to only cast light downward with a 90 degree horizontal cut-off in compliance with Section 11-16-6.C.3.a of the Zoning Ordinance. All signs shall comply with Chapter 37 of the Zoning Ordinance and require a sign permit prior to installation, subject to review and approval of the Zoning Administrator. 8. All grading, drainage, erosion control, and wetland impacts are subject to review and approval of the City Engineer. 9. The existing Jansen Avenue right of way is being vacated with the Otsego Industrial Park 6th Addition plat. The existing cul-de-sac at the east property line was only intended at a temporary cul-de-sac until Jansen Avenue was continued to the west. This cul-de-sac shall be made permanent; developer shall obtain permanent easement over the existing cul-de-sac and the cul-de-sac shall be modified to meet current Otsego standards, or; a new permanent cul-de-sac shall be constructed in the Otsego Industrial Park 71h Addition plat. 11. The driveway connection to CSAH 37 will not be allowed by Wright County per their letter dated June 5, 2020. The construction plans shall be updated — currently only overall site plan shows these conditions. 12. The wetland setback and buffer as well as the required rail road and CSAH 37 setbacks shall be included in the table on Sheet C-101. Completed on Overall Site Plan sheets 13. The 2-yr and 10-yr HWL labels shall be provided in the plans for all ponds and the NWL and HWL for the wetlands shall also be provided (grading and storm sewer sheets too). Drainage and utility easements must be expanded along the east property line to cover existing wetlands not impacted plus buffer. Post -Construction Stabilization/SWPPP (C-201 & C-202) 15. Update to match overall site plan. Overall Grading Plan (C-301, C-302, C-303) 16. There are several low areas/drainage swales that hold water as they drain through storm pipe. An emergency overflow (EOF) with elevation shall be identified in the plans for each of these areas and for all the ponds/wetlands. Any adjacent buildings lowest openings shall be a minimum of 1.5' above these EOFs whenever possible. If not possible the buildings lowest openings shall be a minimum of 1.5' above the 100-yr high water elevation. NOT DONE 17. Some of the proposed slopes appear to be very steep. A number of 3:1 slopes are called out and are allowed/encouraged along wetland areas to minimize impacts where feasible but all other slopes must be a maximum of 4:1 slopes. In no case should a 3:1 be exceeded. NOT DONE 18. It is difficult to determine the drainage pattern from the contours along the sides of the tracks and driveway south of Jansen Avenue. A larger scaled drawing shall be provided for this area. The following few items shall be addressed; a. It appears that the proposed grading will trap water in the wetland to the north of CSAH 37 and west of the driveway. b. The existing drainage for the area south of Jansen Avenue appears to drain to the east along the south side of Jansen Ave through ditches and culverts to a storm pond in Otsego Industrial 1" Addition. The proposed drainage/stormwater calculation and models show this water draining to the west of the site though a series of wetlands instead. Drainage direction shall be verified and potentially the stormwater calculations will need to be revised. 19. Update to match overall site plan. Overall Utility Plan (C-401 & C-402) 20. This culvert as well as FES 11 to FES 12 will be major culverts for this proposed site as well as future sites to the west and even south of CSAH 37. These culverts shall be covered by a drainage and utility easement. Civil Details (C-801 & C-802) 23. No comments. SURFACE WATER MANAGEMENT 24. See comment 15.b. The drainage maps for both existing and proposed drainage depict the ultimate drainage going to the NW (both north and south of Jansen Ave). A 24" culvert is being proposed from the south side of Jansen Avenue to the wetland to the SW. This culvert is flat and at 962 elevation. This will allow the drainage to flow to the Jansen Avenue ditches and not to the NW as shown in the maps. 25. The wetland in the SW of the project and over the adjacent property (Pond 20) has an existing 100-yr HWL of 964.3 which is shown to rise to 964.51 with the proposed development. Both models do not consider the flow to the east through Jansen Avenue ditches. Also, the proposed storm sewer plan shows 24" culvert between this ditch and the wetland which shall also appear in the storm model as we believe will act as the control for this areas HWL. WETLANDS 26. The wetland delineation and replacement plans are currently out for comments until July 9, 2020. Due to the unique nature of this project the proposed wetland impacts has been approved with the replacement plan. OTHER CONSIDERATIONS 27. A statement certifying the environmental condition of the site including the presence of any hazardous substance as defined in Minnesota Statutes 115B.02, Subd 8 is required. SUMMARY AND/OR RECOMMENDATION We recommend approval contingent upon the above items being addressed. The applicant is proposing to construct storage silos on the subject site that exceed the height allowances within the 1-2 District and has requested a conditional use permit in accordance with Section 11-17-3.A of the Zoning Ordinance to allow the height increase. F. The Planning Commission and City Council must take into consideration the possible effects of the request with their judgment based upon (but not limited to) the criteria outlined in Section 11-4-2.F of the Zoning Ordinance: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Finding: Expansion of industrial uses is consistent with the City's economic development goals to add employment and expand tax base. Development of the proposed use is consistent with the 2012 Comprehensive Plan. 2. The proposed use's compatibility with present and future land uses of the area. Finding: The proposed industrial use of the subject site will be compatible with existing industrial and rural uses in the area, as well as planned future commercial uses to the west and low density residential uses south of 65`h Street (CSAH 37). 1 3. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Finding: The proposed use complies with the criteria for allowance of additional building height stipulated in Section 11-17-2.A of the Zoning Ordinance. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Finding: The subject site is accessed by 651h Street (CSAH 37) and from the cul-de-sac terminus of Jansen Avenue. The Wright County Long Range Transportation Plan designates 651h Street (CSAH 37) as a major collector street. Existing streets serving the property have adequate capacity to accommodate the proposed use. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Finding: The proposed use will be accommodated by existing public services, facilities, and infrastructure. G. The planning reports dated 11 June 2020 and 5 August 2020 prepared by the City Planner, The Planning Company LLC, are incorporated herein. H. The engineering review date June 10, 2020 and September 9, 2020 prepared by the City Engineer, Hakanson Anderson, Inc. is incorporated herein. The Otsego Planning Commission conducted a public hearing at their regular meeting on 15 June 2020 to consider the application, preceded by published and mailed notice; based upon review of the application and evidence received, the public hearing was closed and the Planning Commission recommended by a 7-0 vote that the City Council approve the request based on the aforementioned findings. DECISION: Based on the foregoing information and applicable ordinances, the request is hereby APPROVED, subject to the following conditions: 1. The site and buildings shall be developed in accordance with the plans on file with the City except as modified herein or approved by City staff. 2. No direct lot access to 65th Street (CSAH 37) shall be allowed as determined by Wright County. 3. The site plan shall be revised to identify 28 off-street parking stalls. 4. The landscape plan shall be revised to provide for a double row of evergreen trees along the south and southwest edge of the rail car storage area, subject to review and approval of the Zoning Administrator. 5. Fences shall comply with Section 11-19-4.1-1 of the Zoning Ordinance and shall require a fence permit prior to construction, subject to approval of the Zoning Administrator. 6. All exterior light fixtures shall be installed so as to only cast light downward with a 90 degree horizontal cut-off in compliance with Section 11-16-6.C.3.a of the Zoning Ordinance. E 7. All signs shall comply with Chapter 37 of the Zoning Ordinance and require a sign permit prior to installation, subject to review and approval of the Zoning Administrator. All grading, drainage, erosion control, and wetland impacts are subject to review and approval of the City Engineer. 9. Plans for installation of on -site septic and well utilities shall be subject to review and approval of the Building Official.
