BACKGROUND/JUSTIFICATION:
In the summer of 2019, City staff met with a League of Minnesota Cities Loss Control Specialist to review
current ADA compliance within the City's parks and facilities. During that meeting, several areas of concern
were identified as not being compliant. For this reason, developing and implementing an ADA transition
plan for the parks, municipal buildings and parking lots was included in the 2020 Capital Improvement Plan.
In February of 2020, the City entered into a contract with Julee Quarve-Peterson Inc. to provide ADA
consulting services.
The purpose of this plan is to ensure that the City is complying with the federal laws that mandate that
barriers to discrimination be removed to provide persons with disabilities equal opportunity to participate.
The following laws, codes, and design guidelines specifically pertain to the City:
• Section 504 of the 1973 Rehabilitation Act
• Americans with Disabilities Act, Title II
• Americans with Disabilities Act 2010 for Accessible Design
• Minnesota Building Code 1341 (March 2020)
• Architectural Barriers Act (Best Practice)
JQP Inc. began their assessment this spring by meeting with staff and touring all involved facilities. From
their assessment, they have developed a comprehensive report detailing their findings. JQP Inc. has also
provided priority classifications to each improvement item. The priority categories are as follows:
1. Priority 1 are issues that should be addressed within 2 years
2. Priority 2 are issues that should be addressed within 2-8 years
3. Priority 3 are issues that should be addressed within 9-15 years
4. Priority 4 are issues that should be addressed when other work is taking place as part of
maintenance or a larger project
Overall, JQP inc. felt that the City has done a good job of providing program access to facilities and park
amenities. Through their process, they have been able to identify areas where the City excels, such as
facilities (City Hall and Prairie Center) and newer park locations (Lefebvre Creek), as well as amenities
that call for additional improvement (parking, baseball fields and soccer fields).
JQP Inc. observed that throughout the locations surveyed, modifications have been made to increase
accessibility or being included at the time of development, such as:
• Remodeling toilet rooms to provide a minimum of 1 accessible toilet location in each building
• Identifying and designating accessible parking spaces
• Providing play equipment with ground level events and transfer systems to elevated play events
• Providing picnic tables that allow for a forward approach located on an accessible route
• Park amenities connected to accessible routes
JQP Inc. also noted reoccurring areas that require additional modifications such as:
• Relocating signs designating accessible parking spaces
• Lowering amenities such as dog waste bags so they are located within reach range
• Providing a 2"d drinking fountain for standing users
• Modifying the entry into the defined play areas
• Creating an accessible route to boundary of the play area at soccer fields
• Replacing the portable toilet facilities
• Providing an accessible route to baseball fields
Two other recommendations from JQP Inc. include: 1) creating a policy/ procedure to respond to resident,
visitor, or employee's request for accessibility upgrades; and 2) to assign an ADA Coordinator.

B. Within 10 working days after the Grievant becomes aware of the alleged violation, he or she
should submit the grievance to the ADA Coordinator. The grievance may be submitted on
the grievance form or by describing the alleged violation, the building involved, the date of
the alleged violation, and the name and address of the person filing the grievance. The
grievance may be made in writing, orally or by any other means that ensures that the
grievance is communicated to the ADA Coordinator.
C. The ADA Coordinator will investigate and provide a written report with findings of fact,
conclusions, and a proposed resolution within ten (10) working days of final submission of
the complaint. The ADA Coordinator will provide a copy of the written report to the
Grievant.
D. If the Grievant does not agree with the findings of fact, conclusions and proposed resolution,
the Grievant may ask for a reconsideration of the grievance by the ADA Coordinator. The
Grievant must forward the request for a reconsideration to the Coordinator within ten
working days of the date the Grievant receives the report of the Coordinator. The
Coordinator may affirm, reverse, or modify the terms of the issued report.
E. The Grievant and ADA Coordinator may agree to extend any of the timelines set out in the
grievance procedure but must do so in writing.
