ITEM 3.2A 10.12.2020 MinutesITEM 3.2A OTSEGO CITY COUNCIL MEETING OTSEGO PRAIRIE CENTER MONDAY, OCTOBER 12, 2020 Call to Order. Mayor Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Tom Darkenwald, Corey Tanner (*), Tina Goede, and Jason Warehime. Staff; City Administrator/Finance Director Adam Flaherty, Dave Kendall, City Attorney (*); Daniel Licht, City Planner; Ron Wagner, City Engineer (*); and Tami Loff, City Clerk. This meeting is proceeding under MN State Statute 13D.021 allowing members to appear by telephone or video conference due to the ongoing health pandemic and state of emergency. For the record, the Mayor, three Council members, and certain City staff were present in -person. Those indicated with a (*) attended via video conference. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum: Special Presentation: The City Council presented City Employee Kathy Grover with a proclamation and thanked her for her 19 years of service. Joel Cornell, running for City Council, submitted a letter including a data practices request from his attorney to the City Administrator and City Council. City Attorney advised the City Council not to respond to the letter until he was able to review the letter. Mike and Tracy Reischl, 14754 89th Street NE; Mayor Stockamp said they will be given an opportunity to speak during on this topic during the Item 4.1 public hearing. 2. Consider Agenda Approval. City Administrator/Finance Director Flaherty distributed at the dais this evening an updated Exhibit A for Item 4.1. CM Warehime motioned to approve. Seconded by CM Goede. Roll Call: Voted in favor; Goede, Darkenwald, Stockamp, Warehime and Tanner. Voted against; none. Motion carried 5-0. 3. Consent Agenda. 3.1 Approve Claims List. 3.2 Approve City Council Meeting Minutes. A. September 28, 2020 Meeting. 3.3 Approve City Council Special Pay for September 2020. 3.4 Project Payments: A. Pay Estimate #2 (Final) for the Micro Surfacing Project. 3.5 Approve Resolution 2020-66 Adopting Assessment Roll for Delinquent UtilityBills. 3.6 Elect to Not Waive Monetary Limits on Municipal Tort Liability. 3.7 Approve a PUD-CUP for Lot 1, Block 1 and Lot 1, Block 2, Sausser Addition, CM Warehime motioned to approve. Public Hearing: 4.1 Proposed Assessment - Unpaid Administrative Fines and Service Charges. A. City Clerk Attests to Legal Notice. B. Presentation of Proposed Assessment Roll by City Planner. C. Open Hearing for Public Comments. D. Close Public Hearing. E. Consider Resolution 2020-67 Adopting Assessment Roll for Unpaid Special Charges. City Clerk Loff attested to the legal notice being completed. Associate City Planner Elizabeth Stockman was present for this item. City Planner Daniel Licht presented the staff report. Explained that the City does code enforcement on a complaint basis. Mayor Stockamp opened the Public Hearing at 7:42 PM. Mike and Tracy Reischl, 14754 89th Street NE, spoke regarding their code enforcement violation of off street parking of a semi -tractor — and trailer that is larger than a gross weight of 14,000. Ms. Reischl questioned when this code was placed into effect and why she was not noticed. City Planner Licht explained the regulation was adopted by the City Council in 1991 and then expanded in 2019. He further explained that the City is only required to post notice in the public paper. Associate City Planner Stockman explained the code and the violations. Ms. Reischl questioned what their option is as this is their livelihood. Rayman James Richter, 8767 Odean Avenue NE, spoke regarding his code enforcement violation he received for outdoor junk & debris and building without a permit. He stated that the building structure has been removed. He questioned the outdoor junk & debris. CM Warehime asked if TPC has been responsive to phone calls and getting back to Mr. Richter. He stated Associate City Planner Stockman has yes. CM Warehime also stated he has an issue if the City goes out on their property to find other items of code violations when the original citation has been corrected. CM Goede agreed. Mayor Stockamp closed the public hearing at 8:22 PM. Mayor Stockamp asked City staff how the Council could help foster the Reischl' s need for parking space of the semi -trailer being it's their livelihood. After discussion the City Council agreed that the Planning Commission should explore the current Ordinance and bring back a possible solution. CM Tanner stated he would like to see a different way of Code Enforcement other than complaint basis. The City Council seemed to agree. CM Warehime motioned to approve Resolution 2020-67 adopting the assessment roll for unpaid special charges with removal of 118-042-001050; 118-214-001020; 118-018- 005060 and 118-026-003010. Seconded by CM Tanner. Roll Call: Voted in favor; Goede, Darkenwald, Stockamp, Warehime and Tanner. Voted against; none. Motion carried 5-0. 5. Administration: 5.1 General Obligation Improvement Refunding Bonds, Series 2020A. A. Presentation by City Administrator/Finance Director. B. Consider Resolution 2020-68 Accepting Proposal on the Negotiated Sale. Northland Securities, Inc. Representative Jessica Green presented. CM Goede motioned to approve Resolution 2020-68 accepting proposal on the negotiated sale of General Obligation Improvement Refunding Bonds, Series 2020A. Seconded by CM 10/12/20 Warehime. Roll Call: Voted in favor; Goede, Darkenwald, Stockamp, Warehime and Tanner. Voted against; none. Motion carried 5-0. 6. City Council Reports and Updates. Mayor Stockamp said at the Otsego Candidate Forum it was questioned if local builders and national builders are given any favoritism one way or the other. City Planner Licht stated that is all set forth in the Zoning and Subdivision Ordinance and it is the same criteria. CM Tanner said he will be attending a second Wright County task force on economic development and that the Otsego Heritage Preservation Commission will be holding their meeting Tuesday night by Zoom. Mayor Stockamp gave an update of the success of the City's drive thru pumpkin patch held last Saturday. Parks and Recreation Director Demant said the City gave away around 600 pumpkins. CM Warehime gave an update on the Albertville Fire Board meeting and that the Otsego Public Safety Commission will be meeting this Tuesday evening starting at 6:00 PM for road cleanup. 7. Staff Reports and Updates. City Clerk Loff stated staff has received over 3600 Absentee Ballot requests. City Planner Licht stated there is no Planning Commission meeting on October 19, 2020 due to lack of agenda items. City Engineer Wagner gave some project updates. Regarding that topic CM Warehime questioned road closure signage for Queens Avenue. He stated there has been no notice to residents. Street Operations Manager Lamson will follow up with the contractor. 8. Adjourn. CM Darkenwald motioned to adjourn. Seconded by CM Warehime.
