These regulations were developed by a City Council advisory committee and adopted by the City Council as part of the City Code. The Public Safety Commission has discussed complaints made to the Wright County Sheriff's Office regarding use of ATVs and golf carts upon City streets. Under Minnesota Statutes and the City Code, use of ATVs, utility vehicles, and golf carts are prohibited because the City has not adopted provisions specifically allowing them on City streets. WSCO Deputies believe that their interaction with individuals they deal with that are operating these vehicles upon City streets may be more effective if the City Code stated that ATVs, utility vehicles. and golf carts are not allowed to be operated on City streets. The Public Safety Commission stated that they would discuss at a future meeting whether to recommend that the City Council consider allowing recreational vehicle and special use vehicles to operate on City streets. In the interim, City staff has drafted an update to Section 7-3-4 of the City Code to specifically state that operation of recreational vehicles and special use vehicles is not allowed on City streets inside or outside of the established Designated Areas, except for ATVs outside the Designated Area as allowed by DNR rules. The proposed ordinance also includes an update of the designated areas map to include more information regarding the regulation of the Designated Area and adds the south 40 acres of the Harvest Run East subdivision tothe Designated Area. Section 7-3-1 of the City Code (Snowmobiles and Other Recreational Vehicles - Definitions) is hereby amended to read as follows: 7-3-1: INTENT: It is the intent of this chapter to supplement Minnesota Statutes sections 84.81 through 84.88 and chapter 169 with respect to operation of snowmobiles, and Minnesota Statutes sections 84,787 through 84.8045 and sections 84.92 through 84.928 with respect to recreational motor vehicles and Minnesota Statutes 169.045 with respect to special vehicle use on roadways. Section 2. Section 7-3-2 of the City Code (Snowmobiles and Other Recreational Vehicles - Definitions) is hereby amended to include the following definitions: ALL TERRAIN VEHICLE: A motorized vehicle, includes a class 1 all -terrain vehicle defined by Minnesota Statutes 84.92, Subd. 9 and class 2 all -terrain vehicle defined by Minnesota Statutes 84.92 Subd. 10, but not including a golf cart, mini -truck, dune buggy, or go-cart or a vehicle designed and used specifically for lawn maintenance, agriculture, logging, or mining purposes, with A. Not less than three (3), but not more than six (6) low pressure or non -pneumatic tires; B. A total dry weight of two thousand (2,000) pounds or less; and C. A total width from outside of tire rim to outside of tire rim that is sixty five (65) inches or less. NEIGHBORHOOD ELECTRIC VEHICLE: An electrically powered motor vehicle that has three or four wheels, and has a speed attainable in one mile of at least 20 miles per hour but not more than 25 miles per hour on a paved level surface. OFF -HIGHWAY MOTORCYCLE: A motorized, off -highway vehicle traveling on two (2) wheels and having a seat or saddle designed to be straddled by the operator and handlebars for steering control, not including a vehicle that is registered under Minnesota Statutes chapter 168 for highway use if it is also used for off -highway operation on trails or unimproved terrain. UTILITY TASK VEHICLE: A side -by -side, four-wheel drive, off -road vehicle that has four (4) or six (6) wheels, is propelled by an internal combustion engine with a piston displacement capacity of one thousand two hundred (1,200) cubic centimeters or less, and has a total dry weight of one thousand eight hundred (1,800) but less than two thousand (2,600) pounds. Section 2. Section 3. Title 7-3-5 City Code (Snowmobiles and Other Recreational Vehicles - Exceptions) is hereby amended to add the following provision: C. The City of Otsego may operate utility task vehicles upon all public rights-af-way in accordance with Minnesota Statutes 169.045. Section 4. Title 7-3-7 City Code (Snowmobile Designated Areas) is hereby amended to read as following and revise the map of designated areas as shown on Exhibit A attached hereto: 7-3-7: DESIGNATED AREAS: Section 5.
