Recreational and Special Use Vehicles 3601 Thurston Avenue Anoka, MN 55303 763.231.5840 TPC@PlanningCo.com MEMORANDUM TO:OtsegoPublicSafetyCommission FROM:D.DanielLicht,AICP DATE:3November2020 RE:OtsegoΑCityCode;RecreationalandSpecialUseVehicles TPCFILE:101.01 B ACKGROUND Title7,Chapter3oftheCityCodeestablishesregulationsforoperationofsnowmobilesand recreationalvehicleswithintheCity.TheseregulationsweredevelopedbyaCityCouncil advisorycommitteeandadoptedbytheCityCouncilon12October1994aspartoftheCity primarilyforthepurposeofallowingsnowmobileuse Code.Theseregulationsweredeveloped uponpublicstreetsandrightsofwaywithintheCity.Theregulationsalsoprovidefor limitationsonuseofallterrainvehiclesexceptonprivatepropertywithindesignatedareas generallycorrespondingtotheSewerDistrictsandresidentialneighborhoodswithintheLong RangeUrbanServiceAreasestablishedbytheComprehensivePlan.Useofallterrainvehicles inruralareasisallowedonpublicstreetsandrightsofwayinaccordancewithDNRRules. ThePublicSafetyCommissionheardfromOtsegoresidentsattheirmeetingon13October 2020interestedinbeingabletouseamotorizedgolfcartuponwithintheirneighborhood.The WrightCounty{ŷĻƩźŅŅ͸ƭOfficehasfrequentlyencounteredpeopleridingrecreationalvehicles andgolfcartsuponCitystreets.UnderMinnesotaStatutes169.045approvedin1997, operationofallterrainvehicles,utilitytaskvehicles,ormotorizedgolfcartsisprohibitedunless theCityadoptsanordinancespecificallyallowingtheiruseandestablishingrequirementsfora permittobeissuedbytheCityandanyotherregulationsitdeemsappropriatethatdonot conflictwiththeStatute. Exhibits: Vehicleexamples MinnesotaStatutes169.045 1 A NALYSIS Definitions.Thefollowingdefinitionsdescribethevehiclestowhichthediscussionof recreationalandspecialvehiclesundertheCityCodeapplies: ALLTERRAINVEHICLE:Amotorizedvehicle,includesaclass1allterrainvehicledefined byMinnesotaStatutes84.92,Subd.9andclass2allterrainvehicledefinedby MinnesotaStatutes84.92Subd.10,butnotincludingagolfcart,minitruck,dunebuggy, orgocartoravehicledesignedandusedspecificallyforlawnmaintenance,agriculture, logging,orminingpurposes,with A.Notlessthanthree(3),butnotmorethansix(6)lowpressureornonpneumatic tires; B.Atotaldryweightoftwothousand(2,000)poundsorless;and C.Atotalwidthfromoutsideoftirerimtooutsideoftirerimthatissixtyfive(65) inchesorless. MINITRUCK:Amotorvehiclethathasfourwheels;ispropelledbyanelectricmotor witharatedpowerofseventhousandfivehundred(7,500)wattsorlessoraninternal combustionenginewithapistondisplacementcapacityofsixhundredsixty(660)cubic centimetersorless;hasatotaldryweightofninehundred(900)totwothousandtwo hundred(2,200)pounds;containsanenclosedcabinandaseatforthevehicleoperator; commonlyresemblesapickuptruckorvan,includingacargoareaorbedlocatedatthe rearofthevehicle;andwasnotoriginallymanufacturedtomeetfederalmotorvehicle safetystandardsrequiredofmotorvehiclesintheCodeofFederalRegulations,title49, sections571.101to571.404,andsuccessorrequirements,butnotincludinga neighborhoodelectricvehicleoramediumspeedelectricvehicle,oramotorvehicle thatmeetsorexceedstheregulationsintheCodeofFederalRegulations,title49, section571.500,andsuccessorrequirements. MOTORIZEDGOLFCART:Avehiclewithanelectricorgasolinepoweredengine typicallyusedforcarryinggolfersandtheirequipmentoveragolfcourseorusedto carrypassengers,butnotincludingautilitytaskvehicleorneighborhoodelectric vehicle. NEIGHBORHOODELECTRICTVEHICLE:anelectricallypoweredmotorvehiclethathas three(3)orfour(4)wheels,andhasaspeedattainableinonemileofatleasttwenty (20)milesperhourbutnotmorethantwentyfive(25)milesperhouronapavedlevel surface. 2 OFFHIGHWAYMOTORCYCLE:Amotorized,offhighwayvehicletravelingontwo(2) wheelsandhavingaseatorsaddledesignedtobestraddledbytheoperatorand handlebarsforsteeringcontrol,notincludingavehiclethatisregisteredunderMinnesota Statutes168forhighwayuseifitisalsousedforoffhighwayoperationontrailsor unimprovedterrain. UTILITYTASKVEHICLE:Asidebyside,fourwheeldrive,offroadvehiclethathasfour (4)wheels,ispropelledbyaninternalcombustionenginewithapistondisplacement capacityofonethousandtwohundred(1,200)cubiccentimetersorless,andhasatotal dryweightofonethousandeighthundred(1,800)butlessthantwothousandsix hundred(2,600)pounds. SpecialVehicles.MinnesotaStatutes169.045providesthattheCitymayadoptanordinance toallowtheoperationofmotorizedgolfcarts,aswellasallterrainvehicles,utilitytaskvehicles, orminitrucks(definedasͻƭƦĻĭźğƌǝĻŷźĭƌĻƭͼΜondesignatedroadwaysorportionsthereofunder itsjurisdiction.AuthorizationtooperatethesevehiclesrequirestheCitytoestablisha permittingprocessandoperationissubjecttothefollowingrequirementsestablishedby MinnesotaStatute: VehiclesmayonlybeoperatedonCitystreetsbetweensunriseandsunset. Aslowmovingvehicleemblemmustbedisplayed. OperationissubjecttoMinnesotatrafficlawsexceptwherenotpracticalforthese vehicles. Theoperatormusthavevehicleinsurancethesameasrequiredforpassengervehicles. NeighborhoodElectricVehicles.MinnesotaStatutes169.244allowsfortheoperationof neighborhoodandmediumspeedelectricvehiclestooperateuponallCitystreetswithout furtheractionbytheCity. OffRoadMotorcycles.MinnesotaStatutesrequiresmotorcyclestoregistrationinaccordance withMinnesotaStatutes168tobeoperateduponpublicstreetsandhighways.Thereisno exceptiontoallowforalocalordinancepermittingoperationofoffroadmotorcyclesto otherwiseoperateonCitystreets. CityOrdnance.UpondirectionfromthePublicSafetyCommission,Citystaffwilldraftan ordinanceamendingSection734oftheCityCodetoallowforoperationofspecialvehicles and/ormotorizedgolfcartsuponCitystreets.ThescopeoftheprovisionsfortheCity regulationofspecialvehiclesandmotorizedgolfcartsonCitystreetswouldinclude: 3 Nomodificationofthecurrentregulationsallowing: o Useofrecreationalvehiclesuponprivatepropertybytheownerorwiththe ƚǞƓĻƩ͸ƭwrittenpermission. o Operationofallterrainvehiclesinruralareaswithinpublicrightsofwayin accordancewithMinnesotaRules. Operationofallterrainvehicles,utilitytaskvehicles,andmotorizedgolfcartswouldbe alloweduponallcitystreetssubjecttothefollowingconditions: o Hoursofoperationaretobebetweensunriseandsunsetconsistentwith MinnesotaStatutes. o AnadministrativepermitissuedbytheCityisrequired: Theowneroftherecreationalvehiclemustapplyforthepermit. ThevehiclemustbelicensedasrequiredbytheState. Theownermustprovideproofofinsurance. Thepermitwouldbevalidforthemaximum3yearsallowedby MinnesotaStatutes. AnyfeeforthepermitwouldbeestablishedbytheCityCouncil. ApermitmayberevokedbytheCityCouncilatanytimeupon recommendationfromtheWrightCounty{ŷĻƩźŅŅ͸ƭOfficeforfailureto operatethevehicleonCitystreetsinasafemanner. o OperatorsmustpossessavalidMinnesotaClassDdriverslicense. o OperationuponCitystreetsissubjecttoalltrafficlaws;operatorsmaycrossa WrightCountyroadwayintersectingaCitystreet. o Operationonpublicboulevards,sidewalks,ortrailsisprohibited. o EquipmentrequiredbyStatutespecifiesonlyaslowmovingvehicleemblem. TheCitymayconsiderrequiringadditionalequipmentatitsdiscretion,including: Atleast1headlightand1taillightturnsignals. Exteriorand/orinteriormirrors. 4 Awindshield. Seatbelts. Parkingbrake. ThescopeofadraftordinanceisforreviewanddiscussionbythePublicSafetyCommission regardingallowanceofallterrainvehicles,specialvehicles,andmotorizedgolfcartstobe operateduponCitystreets.ThePublicSafetyCommissionmayalsowishtoconsiderseeking additionalpublicinputregardinguseofrecreationalvehiclesuponCitystreetsbyposting informationintheCitywebsite,socialmedia,andincludinginformationinanupcomingedition oftheOtsegoView. SurroundingCities.Citystaffreviewedthecitycodesforsurroundingcitiesregarding vehiclesuponthoseĭźƷźĻƭ͸streets.ThecitiesofBigLakeandRamseyallow allowanceofspecial forATVs,utilitytaskvehicles,andmotorizedgolfcartstobeoperatedonCitystreets. MonticelloallowsforClass2ATVs(andsnowmobiles)tobeoperatedonCitystreetsina Albertville,Dayton,Elk mannerconsistentwithhƷƭĻŭƚ͸ƭcurrentsnowmobileregulations. River,Rogers,andSt.MichaelallowonlyATVstobeoperatedonpublicrightsofwayandonly totheextentallowedbyDNRrules. C ONCLUSION ThePublicSafetyCommissionagendafortheirmeetingon10November2020istoinclude discussionofallowingallterrainvehicles,utilitytaskvehicles,andmotorizedgolfcartsupon citystreets.Citystaffisseekingdirectionatthistimewhethertoproceedwithdraftinga proposedordinanceforfurtherreviewbythePublicSafetyCommissionatafuturemeeting.
