12-07-20 Planning Commission MinutesOTSEGO PLANNING COMMISSION MEETING OTSEGO CITY HALL December 07, 2020 7:00 PM Call to Order. Vice Chair Stritesky called the meeting to order at 7:00 PM. Roll Call: Vice Chair Aaron Stritesky; Commissioners: Charles Foster, David Thompson; Present via teleconference: Vern Heidner, Richard Nichols and Pam Black; Absent: Chair Alan Offerman, Commissioner Jim Kolles; Present: City Staff: City Planner Daniel Licht and Deputy City Clerk Bethany Benting. 1. Announcements: City Planner Licht stated that some Commissioners are participating via teleconference in accordance with Minnesota Statute 13D.015. 2. Consider the following minutes: 2.1 Planning Commission October 05, 2020. Commissioner Black motioned to approve the minutes as written. Seconded by Commissioner Foster. Roll Call: Those for; Foster, Heidner, Thompson, Stritesky, Black, Nichols. Those opposed; None. Motion carried. 6-0 3. Public Hearing Items: 3.1 Kittredge Crossings 7th/TC Homes A. PUD Development Stage Plan amendment to allow a reduction in the required setback between the building and private drive. City Planner Licht presented the Planning Report. Applicant, Brian Tutt, TC Homes, Inc., was present and agreed to the staff report. Vice Chair Stritesky opened the Public Hearing at 7:09 PM. Theodore Schotzko, 10676 74th Street NE, is concerned about the buildings not complying with the 25 -foot setback. Mr. Schotzko also noted complaints regarding site grading and dirt stockpiles. Mr. Schotzko objected to parking on 74th Street. Vice Chair Stritesky closed the Public Hearing at 7: 16 PM. Commissioner Foster asked Mr. Tutt when he became aware of this problem. Mr. Tutt replied in September when the City made it aware to him. Commissioner Foster feels Minutes of the Otsego Planning Commission December 07, 2020 Page 2 there is responsibility on the builder part to be aware of requirements such as setbacks and to build things correctly. Commissioner Thompson is opposed to continuing to build with 16 -foot driveways that do not meet requirements. Commissioner Thompson asked about the City Planner's recommendation to not allow parking in the driveway. City Planner Licht said the homeowner association would have to enforce parking on the driveway aprons but that the drive aisles could be posted fire lanes and enforced to prevent obstructions. Commissioner Heidner said it is not realistic to ask someone not to be able to park in their own driveway. Commissioner Thompson added that there are things we have to consider to make it livable for the people wanting to buy these units. Commissioner Heidner asked how many more units need to be built still. City Planner Licht explained there are a total of 14 units still to be built within 2 buildings. Vice Chair Stritesky asked the developer if they were given the setback standards. Mr. Tutt said he was given many documents and said he met with City staff to make sure they were in compliance. Vice Stritesky stated it's the builders responsibly that they get know the requirements and comply. Commissioner Heidner stated builders are given info when they buy property and therefore it is the builders responsibly. Commissioner Heidner is not willing to go to the 15 feet. Vice Chair Stritesky also agreed he is not okay with reducing the setback to 15 feet and establishing a precedent. Commissioner Nichols suggested a 20 -foot setback would be reasonable in this situation. Commissioner Black mentioned a situation of a house that had a short driveway and during the winter it was a problem for snow removal. Vice Chair Stritesky asked if a 20 -foot driveway would still require a remodel design? Mr. Tutt said modifications to the current plan may allow for a 20 -foot driveway. Commissioner Foster agrees they need to resolve this but doesn't feel 20 feet is the best answer. Commissioner Nichols motioned to recommend approval of a PUD Development Stage Plan amendment for Kittredge Crossing 7th addition, subject to the following conditions as stated in the report, as amended: Minutes of the Otsego Planning Commission December 07, 2020 Page 4 Commissioner Heidner asked about the building on the property and if it could be used. City Planner Licht said it is an existing building that likely as building code issues that would need to be corrected before it could be occupied. Commissioner Heidner is concerned about it being turned into an automotive shop. City Planner Licht explained that the building and property can only be occupied by uses allowed within the A-2 District. Commissioner Thompson motioned to recommend City Council approval a Zoning Map amendment rezoning the subject site from A-1 District to A-2 District based on a finding that the request is consistent with the Comprehensive Plan. Seconded by Commissioner Black. Roll Call: Those for; Foster,, Heidner,, Thompson,, Stritesky,, Black,, Nichols. Those opposed; None. Motion carried. 6-0 Commissioner Thompson motioned to recommend approval a conditional use permit subject to the conditions outlined in the Planning Report,. and: 7. Occupancy of the existing building on the subject site shall be subject to review and approval of the Building Official for compliance with the Building Code and dwelling unit requirements of the Zoning Ordinance. 8. All nuisance conditions defined by the City Code or outdoor storage regulated by the Zoning Ordinance that do not comply with the City Code shall be abated by 1 July 2021, subject to review and approval of the Zoning Administrator. Motion carried. 6-0 City Planner Licht said the application will go to the City Council meeting on December 14, 2020. 3.3 Lennar/Hunter Hills A. PUD -CUP amendment to reduce the minimum required attached garage area for single family villa dwellings from 420 to 400 square feet. City Planner Licht presented the Planning Report. Josh Metzer, Lennar, was present as the applicant via zoom and agreed to the staff report. Vice Chair Stritesky opened the Public Hearing at 8:08 PM. Commissioner Foster asked for an explanation of the garage dimensions. Mr. Metzer explained the option to add 2 feet to the front of either a 2 or 3 stall garage. Vice Chair Stritesky questioned the dimensions of the of the garages. City Planner Licht explained that the information is the maximum depth/width of the garages, not the dimensions used to calculate area. Commissioner Heidner also asked about the dimensions and how they are calculated. Mr. Metzer and City Planner Licht explained the measurements and how they are calculated for Zoning Ordinance compliance. Commissioner Foster motioned to recommend the City Council approval of a PUD -CUP amendment for Hunter Hills, subject to the conditions as stated in the report. Seconded by Commissioner Black. Roll Call: Those for; Foster,, Heidner,, Stritesky, Black,, Nichols. Those opposed; Thompson. Motion carried. 5-1 City Planner Licht said this application will go to the City Council meeting on December 14, 2020. 3.4 City of Otsego/Water Tower #4 A. Conditional Use Permit for construction of City Water Tower #4. City Planner Licht presented the Planning Report. Vice Chair Stritesky opened the Public Hearing at 8:22 PIM. Tom Kohnen, 13108 70th Street NE, asked for clarification of the map sent with the public hearing notice. City Planner Licht explained that the map showed the properties within 350 feet of the subject site that received notice. Mr. Kohnen asked if a siren would be placed on the site. City Planner Licht no siren would be placed on the site as sirens have been located elsewhere based on a study completed to provide full coverage of the City. Motion carried. 6-0 City Planer Licht said this application will go to the City Council at a future meeting at such time as plans and specifications are presented to authorize advertisement for bids for the Water Tower #4 project. 4. Update on City Council actions. City Planner Licht updated the Planning Commission on recent City Council actions. 5. Update on future Planning Commission Agenda items. City Planner Licht provided an update on possible future agenda items. 6. Adjourn. Commissioner Black motioned to adjourn. Seconded by Commissioner Foster.
