BACKGROUND/J USTI FICATION:
The final plat of Parkview Retail was approved by the City Council on 12 November 2019. Included in the
plat was right-of-way previously dedicated for CSAH 39. This right-of-way is no longer necessary based on
the right-of-way, trail easement, and drainage and utility easements dedicated with the Parkview Retail
plat.
The Wright County Board, at their meeting on 2 February 2021, approved transfer of jurisdiction for the
right-of-way from Wright County to the City. The City has initiated vacation of the public right-of-way on
behalf of the property owner. The vacation of the public right-of-way effects only that property within the
Parkview Retail plat.

RESOLUTION NO: 2021-18
APPROVING VACATION OF EXISTING PUBLIC RIGHT-OF-WAY
WITHIN THE PLAT OF PARKVIEW RETAIL
WHEREAS, the City Council approved a final plat to be known as Parkview Retail on 12 November 2019;
and
WHEREAS, on 2 February 2021, Wright County adopted Resolution 21-10 transferring jurisdiction to the
City of Otsego for right-of-way for 90th Street (County State Aid Highway 39 (CSAH 39)) within the
Parkview Retail plat as described by Exhibit A attached hereto; and
WHEREAS, the right-of-way dedicated with plat of Parkview Retail make unnecessary that right-of-way
described by Exhibit A transferred by Wright County to the City; and
WHEREAS, the City has initiated vacation of the right-of-way described by Exhibit A transferred to it by
Wright County; and
WHEREAS, the City Council held a public hearing at their regular meeting on 8 March 2021 to consider
the vacation, preceded by required published and mailed legal notice; and
WHEREAS, the City Council heard all parties interested therein and closed the public hearing; and
WHEREAS, the right-of-way described by Exhibit A serves no useful public purpose; and
WHEREAS, the City Council having considered all information received related to the proposed vacation
finds that vacating the right-of-way described by Exhibit A would be in the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA:
1. That the right-of-way located in the City of Otsego, Wright County, State of Minnesota described
by Exhibit A is hereby vacated.
2. The City Council hereby determines that the vacation of said existing right-of-way and drainage
and utility easements shall cause no damage to any abutting or nearby property owners and
therefore no damages are awarded to any such property owners.
ADOPTED by the Otsego City Council this 8th day of March, 2021.
