The applications included vacation of existing drainage and utility easements overlaying the subject site. A public hearing had been held on 21 September 2020 to consider the vacation with the first proposed development of the subject site, but a resolution was not adopted to affect the vacation. With approval of the final plat based on the revised development plan for the subject site, the vacation resolution is to be adopted prior to recording the final plat and development agreement. Rl1DGET INFORMATION ;FUNDING: i BUDGETED+ t N/A RESOLUTION NO.: 2021-30 CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA APPROVING VACATION OF EXISTING DRAINAGE AND UTILITY EASEMENTS OVER OUTLOT H. KITTREDGE CROSSINGS. WHEREAS, the property owner has initiated vacation of existing drainage and utility easements dedicated over the property legally described as Outlot H, Kittredge Crossings, City of Otsego, County of Wright, State of Minnesota; and, WHEREAS, the City Engineer has reviewed the request and determined that the existing drainage and utility easements are unnecessary for public purposes; and, WHEREAS, the Planning Commission held a public hearing at their regular meeting on 21 September 2020 to consider the vacation, preceded by required published and mailed legal notice, and, WHEREAS, the Planning Commission heard all parties interested therein, closed the public hearing and recommended that the existing drainage and utility easements be vacated; and, WHEREAS, the existing drainage and utility easements serves no useful public purpose; and, WHEREAS, the City Council having considered all information received finds that the existing drainage and utility easements serve no useful public purpose and vacating the existing drainage and utility easements would be in the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA: 1. That the existing drainage and utility easements dedicated over Outlot H, Kittredge Crossings, City of Otsego, County of Wright, State of Minnesota are hereby vacated. 2. The City Council hereby determines that the vacation of said existing right-of-way and drainage and utility easements shall cause no damage to any abutting or nearby property owners and therefore no damages are awarded to any such property owners.
