REQUESTOR: MEETING DATE: Andy MacArthur, City Attorney, January 5, 2014 REVIEWED BY: I ITEM #: Lori Johnson, City Administrator 2 AGENDA ITEM DETAILS NON RECOMMENDATION: Council review appraisals ordered earlier for right of way and easements as revised relative to the 70h Street project, and approve offers to property owners based upon those appraisals or request further modification of the appraisals. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No. I No. BACKGROUND/JUSTIFICATION: The City previously ordered appraisals for 70th Street. The City Council previously reviewed approximately half of the appraisals, and requested certain modifications. The appraiser has made the requested modifications and has also finished the appraisals for the County portion of the project. The Council will meet in a closed session under Minnesota Statute 13D.05, Subd. 3, c, 2 & 3 to review the appraisals and direct staff as to how to proceed. Minnesota statutes allow the City to close a meeting in order to formulate offers for real property. The appraisals are considered non-public data. The closed meeting must be recorded. The Council review and direction to staff is necessary to initiate acquisition of the parcels. The appraisals originally ordered begin at the western edge of the project and end near the proposed roundabout. The appraisals for land included within the roundabout and easterly to Odean have now been completed due to the final decision regarding the location and configuration of the roundabout. The three appraisals related to trail only on the western end of the project have been eliminated due to project modification. Offers can now be made to the property owners since the Project memorandum has received final approval from the State and the Feds. Since the appraisals are non --public data they will be provided to the Council at the closed meeting in summary form. I will also have available the entire appraisals for purposes of questions from the Council.
