Item 2.1 - PC Min 4-19-21Item 2.1 OTSEGO PLANNING COMMISSION MEETING OTSEGO PRAIRIE CENTER April 19, 2021 7:00 PM Call to Order. Chair Offerman called the meeting to order at 7:00 PM. Roll Call: Chair Alan Offerman; Commissioners: Charles Foster*, David Thompson, Vern Heidner, and Pam Black*; Absent: Aaron Stritesky, Jim Kolles, Richard Nichols; Present: City Council: CM Tom Darkenwald arrived at 7:02, CM Jeff Dahl arrived at 7:24. City Staff: City Planner Daniel Licht and Deputy Clerk Bethany Benting. (*present via teleconference) 1. Announcements: City Planner Licht stated that some Commissioners are participating via teleconference in accordance with Minnesota Statute 13D.015. Those indicated with a (*) attended via video conference. 2. Consider the following minutes: 2.1 Planning Commission March 15, 2021. Commissioner Heidner motioned to approve the minutes as written. Seconded by Commissioner Thompson. Roll Call: Those for; Offerman, Heidner, Thompson, Black, Foster. Those opposed; None. Motion carried. 3. Public Hearing Items: 3.1 Prairie View Estates: A. Preliminary and final plat approval of 9 single family lots. B. Vacation of existing drainage and utility easement. City Planner Licht presented the Planning Report. Applicant, Ray Marsh, was present via zoom and agreed to the staff report. Chair Offerman opened the Public Hearing at 7:09 PM. Chad Chamberlin, 12120 78th Street NE, asked about what the outlot area is on the map. City Planner Licht said it is the storm water basin and will be owned by the City. Commissioner Thompson asked if the 35-foot set back applies to the garage and house. City Planner Licht said yes. Commissioner Thompson also asked if the storm water basins are treated for mosquitoes. City Planner Licht responded no. Commissioner Heidner mentioned the ghost plat for the property to the east and asked if it would be possible to extend the street and develop there. City Planner Licht replied yes. Commissioner Heidner also asked if utilities would extent on 80th and Marlow Avenue. City Planner Licht said yes. Commissioner Thompson mentioned emailed question regarding extension of 79th Street and asked who will be following up with them. City Planner Licht said the City Engineer will follow up with the property owner before and during construction. Commissioner Black motioned to recommend approval of vacation of drainage and utility easements and the preliminary plat and final plat of Prairie View Estates, subject to the following conditions as stated in the report. Seconded by Commissioner Foster. Roll Call: Those for; Offerman, Heidner, Thompson, Black, Foster. Those opposed; None. Motion carried. 5-0 3.2 JK Storage: A. PUD-CUP and site/building plan review for self-storage use B. Vacation of drainage and utility easements C. Final plat to combine 2 lots. City Planner Licht presented the Planning Report. Applicant, Brenton Kent was present via Zoom and agreed to the staff report. Chair Offerman opened the Public Hearing at 7:21 PM. There were no public comments. Chair Offerman closed the Public Hearing at 7:22 PM. Commissioner Thompson asked if there were any waste containers on site. City Planner Licht said no. Mr. Kent said there are no waste containers because they become a maintenance issue and not having them on site has never been a problem. City Planner Licht stated that all storm water issues are subject to approval of the City Engineer and he will ask their office to review again. Commissioner Thompson motioned to recommend approval of vacation of existing drainage and utility easements, a preliminary and final plat for Otsego Industrial Park 7th Addition, and a PUD-CUP and site/building plans for JK Secure Storage, subject to the following conditions as stated in the report. Seconded by Commissioner Heidner. Roll Call: Those for; Offerman, Heidner, Thompson, Black, Foster. Those opposed; None. Motion carried. 5-0 3.3 5887 Queens: A. Zoning Map amendment rezoning from I-1, Limited Industrial District to I-3, Special Industrial District. B. PUD-CUP for multiple principal buildings and building coverage. C. Site and building plan review for a self-storage use. City Planner Licht presented the Planning Report. Applicant, Todd Jones, was present and agreed to the staff report and described the project. Commissioner Thompson asked Mr. Jones what the fence adjacent to the outdoor storage parking stalls will be made of. Mr. Jones explained it would be an opaque wood fence. Commissioner Heidner asked about the current occupants of the buildings. Mr. Jones explained that the tenant who currently is occupying the two north buildings will be vacating on May 1st. Commissioner Heidner asked about the existing drainage and utility line through this property and the property to the south. City Planner Licht explained that there has already been a review of the existing storm water pipe and easement, including vacation of a portion of the easement on the property to the south. Chair Offerman opened the Public Hearing at 7:43 PM. There were no public comments. Chair Offerman closed the Public Hearing at 7:44 PM. City Planner Licht said it was not, that property is to the south then the east. Commissioner Black motioned to recommend approval of a Zoning Map amendment rezoning the subject site from I-1 District to I-3 District. Seconded by Commissioner Thompson. Roll Call: Those for; Offerman, Heidner, Thompson, Black, Foster. Those opposed; None. Motion carried. 5-0 Commissioner Heidner motioned to recommend a PUD-CUP and site/building plans for Extra Space Storage, subject to the following conditions as stated in the report. Seconded by Commissioner Black. Roll Call: Those for; Offerman, Heidner, Thompson, Black, Foster. Those opposed; None. Motion carried. 5-0 3.4 Zoning Ordinance amendment: A. Amendment of Section 18 of the Zoning Ordinance regulating accessory outdoor storage and waste containers. City Planner Licht presented the Planning Report. Chair Offerman opened the Public Hearing at 7:50 PM. No Comments were made. Chair Offerman closed the Public Hearing at 7:51 PM. Commissioner Thompson feels garbage cans should not be stored outside but he understands why the Ordinance needs to be amended. Chair Offerman asked about the RV requirements in R-4, R-5 and R-6. City Planner Licht said they still need to be paved and noted that these lots have always been required to have paved driveways. Commissioner Thompson motioned to recommend approval of amendments to the Zoning Ordinance as presented. Seconded by Commissioner Heidner. Roll Call: Those for; Offerman, Heidner, Thompson, Black, Foster. Those opposed; None. Motion carried. 5-0 4. Planning Items: 4.1 Discussion of accessory dwellings. Minutes of the Otsego Planning Commission April 19, 2021 Page 5 City Planner Licht presented the Planning Report. Commissioner Thompson said years ago there was a similar situation with farmers to do this and he agrees that this does make sense. Commissioner Thompson asked about the tiny houses ordinance that Otsego has. City Planner Licht said the State mandated all cities must allow them unless they adopt an ordinance specifically prohibiting them, which Otsego has done. Commissioner Heidner brought up the concern about when you sell the property what would the use of the building be and would it become a rental. Commissioner Heidner asked why not split the lot. City Planner Licht said that the example lot could not be split hence the reason for asking to build an accessory building with a secondary dwelling unit. Chair Offerman talked about the City being forced into approving subdivision of a non- conforming lot. City Planner Licht explained the ordinance could have a criteria that could have restrictions to size of lot, use of the building as an accessory structure only and that it would have to be sold with property and not be split. Commissioner Heidner asked if City Planner Licht would put a limitation of how far this accessory building would need to be built from the main dwelling. City Planner Licht said yes. Commissioner Thompson asked where the accessory building would be built on the example property being discussed. Owner Shannon Ambrose, 8451 Nashua Avenue, said south of the driveway to the east of the dwelling. City Planner Licht stated that the accessory building can be closer to Nashua Avenue than the house but is subject to a 65-foot setback. Commissioner Thompson said they should discuss minimum lot size requirements. Commissioner Heidner, Commissioner Black, and Chair Offerman said they would be comfortable with at least 5 acres or more. Commissioner Heidner said they should make sure it’s sharing a septic. Commissioner Offerman agreed. City Planner Licht said that the comments from the Planning Commission will be used to draft a proposed Zoning Ordinance amendment. Ms. Ambrose asked about timing. City Planner Licht said this item could be considered by the Planning Commission and adopted by the City Council in May. City Planner Licht noted that Ms. Ambrose could apply for a building permit to construct the detached accessory building without the Minutes of the Otsego Planning Commission April 19, 2021 Page 6 secondary dwelling unit to get started. Council Member Darkenwald noted that the property owner would be proceeding at their own risk regarding the secondary dwelling unit pending a City Council decision on any proposed Zoning Ordinance amendment. 5. Updates: 5.1 Updates on City Council actions. CM Darkenwald updated the Planning Commission on recent City Council actions. 5.2 Updates on future Planning Commission items. City Planner Licht updated the commissioners on possible future agenda items. 6. Adjourn. Chair Offerman motioned to adjourn. Seconded by Commissioner Heidner.
